Abstract

The dismissal of the Executor of the Will follows the rules for the dismissal of a guardian in Indonesia. Guardianship in Indonesia is inseparable from the rules of family law. In this case, it can be carried out by the Balai Harta Peninggalan which oversees supervising the Executor of the Will who has been appointed by the Heirs in dividing and separating their inheritance to the heirs. In the mentoring process, it does not deny that the Executor of the Will commits fraud and is not in accordance with his work responsibilities so that the full heirs of the ab intestato can apply for the dismissal of the Executor of the Will in accordance with the rules in article 1022 of the Civil Code. With the support of statements of experts quoted from interviews which state that the expulsion of the Executor of the Will can be submitted by all heirs ab intestato. Dismissal can be carried out if the executor of the will does not want to carry out his duties, or he carries out his duties half-heartedly. This is regulated in Article 1022 of the Civil Code. Meanwhile, in relation to the role of the Balai Harta Peninggalan, the BHP has the authority to oversee the implementation of the will and propose the dismissal of the Executor of the Will if the will is not implemented.

Abstract

A notary is a public official who is authorized by the state to make an authentic deed. If one of the parties feels aggrieved by the deed made by the Notary, that party can sue the Notary for the unlawful act committed. Notaries as public officials who have an important role in people's lives. In carrying out his position, it is not enough for a Notary to only have legal expertise but must also be based on responsibility and appreciation of the nobility of dignity and ethics. Its role and authority are very important for legal traffic in society. Therefore, a notary must carry out his profession professionally, highly dedicated and uphold the dignity and worth of by upholding the code of ethics of a notary. By enforcing the notary's code of ethics, it is very important for the notary to better understand the extent to which the act can be regarded as a violation of the code of ethics, and provide education so that things do not happen that can harm the notary and the community he serves. This study aims to examine the accountability of the Notary to the deed of guarantee delivery agreement that he has made based on Decision Number 61/Pdt.G/2019/PN.Gin. This research uses In this study the legal research method used is normative juridical. The approach used is a statutory approach. The analytical method used is qualitative, and the results of the research used are analytical explanatory. The findings in this study are the responsibility of the notary in making the guarantee agreement deed, proven to have committed an unlawful act and violated the provisions of Article 1365 of the Civil Code. The legal consequences given are the cancellation of the deed and dishonorable dismissal. It is recommended that the notary be more careful in making the deed so that problems do not occur in the future.

Abstract

Permasalahan tanah yang tidak termanfaatkan dan diambil alih oleh spekulan tanah menjadi kendala dalam pembangunan infrastruktur di Indonesia. Untuk mengatasi permasalahan tersebut, pemerintah merancang peraturan tentang bank tanah. Penelitian ini membahas mekanisme pembentukan bank tanah di Indonesia menurut rancangan peraturan tersebut dan proses distribusi tanah bila bank tanah sudah terbentuk.Berdasarkan penelitian, mekanisme pembentukan bank tanah di Indonesia dilakukan dengan membentuk lembaga Batanas yang bertujuan untuk pengelolaan, penyediaan dan pendistribusian tanah secara terpadu. Batanas berbentuk Badan Layanan Umum yang berperan dalam pembangunan, pemerataan ekonomi dan kepentingan umum atau fungsi sosial. Proses distribusi tanah dilakukan oleh pemerintah dan digunakan untuk kepentingan umum. Proses distribusi dilakukan dengan inventarisasi dan identifikasi obyek tanah, termasuk apakah tanah tersebut bebas konflik atau tidak, baik horisontal atau vertikal. Setelah itu, dilakukan inventarisasi dan identifikasi subyek, yaitu orang atau kelompok yang sangat membutuhkan tanah dengan kriteria tertentu yang telah ditetapkan. Kemudian dilakukan sinkronisasi luas tanah dan jumlah subyek, dan ditentukan berapa masing-masing yang diperoleh oleh subyek. Terakhir, dilakukan identifikasi alas hak. Dalam kesimpulannya, bank tanah diharapkan dapat membantu mengatasi permasalahan tanah yang tidak termanfaatkan dan mengurangi tindakan spekulan tanah. Proses distribusi tanah harus dilakukan secara transparan dan adil untuk mewujudkan kepentingan umum dan fungsi sosial tanah. Diharapkan pemerintah dapat segera melaksanakan rancangan peraturan tentang bank tanah untuk mengoptimalkan pemanfaatan tanah di Indonesia.
