Abstract

Forests are a mandate and gift from God Almighty bestowed on the Indonesian people. SAD live in groups in a community, and their lives cannot be separated from the forest and its natural surroundings. The root of conflict and neglect of MHA rights in forest areas is the lack of legal certainty regarding acknowledging the existence of MHA, customary areas, and traditional rights. The state also does not recognize the boundaries of customary territories, which results in the seizure of indigenous peoples' territories. This study aims to examine and analyze the certainty of land rights of indigenous tribal communities in forest areas. This research is normative legal research, using a statutory approach and sources of primary and secondary legal materials with data collection techniques, namely literature study, and analyzed qualitatively. The results obtained are that for the sake of realizing legal certainty, the rights of the SAD community must first be determined that SAD is included as one of the MHA and these elements meet the SAD to be recognized as MHA. However, in reality, SAD is not recognized as MHA; the rights to justice, protection, and legal clarity have been hampered by efforts to defend and defend their ulayat rights. Abstract

Usaha Mikro, Kecil dan Menengah (UMKM) has an important and strategic role in national economic development. The importance of the legality of brand rights as an effort to legally protect UMKM, and the creation of a guide on procedures for processing legality documents for brand rights for UMKM. This activity is important because law is an inseparable part of human existence. This is in line with the adage ubi societas ibi ius which means where there are humans, there is law. Remembering that the legality of trademark rights is a legal umbrella for a business entity. However, there are still quite a lot of UMKM industry players in Madiun City who have not registered their trademarks due to limited capital and lack of understanding of the benefits of trademark registration for the UMKM industry. Thus, UMKM that do not register their trademarks do not receive legal protection, because a trademark will receive legal protection if the trademark has been registered. Thus, a policy is needed that regulates the UMKMindustry in Madiun City to obtain legal protection for its trademarks. So this research will examine the legality of brand rights as an effort to legally protect UMKM in Madiun City and how to create a guide on procedures for processing legality documents for brand rights for UMKM in Madiun City. This research uses normative research methods.

Abstract

Problem/Background (GAP): Building Construction Permit is a permit granted by the City/Regency Government to building owners to modify, build new, reduce and maintain buildings in accordance with administrative requirements and technical requirements. In its implementation, the aim of the IMB is to create an orderly layout and layout that is in accordance with the land use designation so that it will create harmony and balance between the environment and the building. To optimize public services to the community in the licensing sector which utilizes advances in information technology, the Boyolali Regency Investment and One-Stop Integrated Services Service has used a regionally managed online service system known as PTSP Online. This online service system was only implemented in 2020, where previously the Construction Building Permit (IMB) processing service was still carried out manually or offline. With this site, it is hoped that the quality of IMB licensing services can be improved more quickly and effectively. Objective: The purpose of this research is to determine and analyze the implementation of online-based Building Permit service policies and to determine the obstacles that occur in online-based Building Permit services. Method: The research design used in this research is qualitative research using descriptive methods and a deductive approach. Data collection techniques use interviews and documentation. Then the data collected was analyzed using data reduction techniques, data presentation and drawing conclusions. Results/Findings: The results of this research indicate that the implementation of the online building permit service policy in Boyolali Regency, Central Java Province has not been optimal because there are still obstacles in implementing the policy such as lack of socialization and information about online IMB regulations, the technology used is not optimal, lack of a technical team In the field, there are still brokers in online IMB processing. Conclusion: Based on the research conducted, the author suggests to DPMPTSP Boyolali Regency to carry out scheduled socialization so that the community is able to understand existing policies, increase supervision so that brokering practices are minimized, carry out repairs and maintenance of network systems, and recruit a team of technical employees.
