Abstract

The rise of Internet and social media users in Indonesia has made e-commerce (online) business transactions grow. The increasing number of buying and selling online indirectly also has an impact on the development of the rule of law. In running an online business or conducting online transactions, there are several legal aspects of e-commerce and buying and selling online or electronically that must be known. Online transactions are usually interpreted as electronic contracts, namely legal ties or relationships that are carried out electronically which combine networks of computer-based information systems with systems. Online buying and selling was born because of a buying and selling contract that occurs electronically between the seller and the buyer. However, until now the rules of electronic buying and selling are still not clearly written in the law that applies in the territory of Indonesia. This is because the legal terms of electronic agreements have not been specifically regulated. In principle, the rules are contained in the Civil Code, which is a reference in making contracts for online buying and selling transactions. As long as this contract is made in compliance with the 4 legal terms of the agreement referred to in the Civil Code, the online transaction contract can be considered valid and binding on sellers and buyers.

Abstract

AbstrakPassing off mengakibatkan kerugian bagi pemilik merek sesungguhnya seperti menurunnya reputasi perusahaan, omset penjualan yang menurun, dan tuntutan dari konsumen yang merasa tertipu karena kualitas produk tidak sesuai dengan merek aslinya. Rumusan masalah yang akanpenulis bahas dalam penelitian penelitian ini adalah: 1) Bagaimana perlindungan hukum bagi kosumen atas tindakan passing off yang dilakukan oleh pengusaha?dan2) Bagaimana penyelesaian secara hukum bagi pengusana yang melakukan pemalsuan merek dengan tindakan passing off atas merek terkenal ?. Adapun metode penelitian yang penulis gunakan adalah metode yuridis normatif, yaitu yaitu menganalisis kaitan antara peraturan perundang-undangan yang berlaku dengan teori-teori hukum dan praktek pelaksanaan hukum positif yang menyangkut permasalahan yang dibahas denganmengutamakan data kepustakaan yaitu penelitian terhadap data sekunder. Data sekunder tersebut dapat berupa bahan hukum primer,sekunder maupun tersier. Akhirnya berdasarkan hasil penelitian, penulis menyimpulkan bahwa perlindungan hukum bagi kosumen atas tindakan passing off yang dilakukan oleh pengusaha, yaitu : a) Perlindungan konsumen dari barang tiruan, artinya, konsumen diberikan jaminan atas keamanan dan keselamatan kepada konsumen dalam penggunaan, pemakaian dan pemanfaatan barang dan atau jasa yang dikonsumsi atau digunakan. Jadi para pengguna produk atau konsumen tidak merasa dirugikan oleh pihak pelaku usaha ; b) Perlindungan atas tanggungjawab pelaku usaha terhadap konsumen yang membeli barang tiruan, artinya tiap perbuatan melanggar hukum, yang menimbulkan kerugian bagi orang lain mewajibkan orang yang karena kesalahannya mengakibatkan kerugian itu, mengganti kerugian.” Ketentuan ini memberi perlindungan kepada seseorang terhadap perbuatan melawan hukum (onrechtmatige daad)Kata Kunci: Perlindungan Konsumen, Merek Palsu AbstractPassing off results in losses for the real brand owner such as declining company reputation, declining sales turnover, and demands from consumers who feel deceived because the quality of the product does not match the original brand. The formulation of the problems that the author will discuss in this research is: 1) How is the legal protection for consumers for passing off actions carried out by entrepreneurs?and2) How is the legal settlement for the proposer who commits brand counterfeiting with the act of passing off the famous brand ?. The research method that the author uses is a normative juridical method, namely analyzing the relationship between applicable laws and regulations and legal theories and the practice of implementing positive law which concerns the problems discussed by prioritizing literature data, namely research on secondary data. The secondary data can be in the form of primary, secondary or tertiary legal materials. Finally, based on the results of the study, the author concludes that the legal protection for consumers for the act of passing off carried out by entrepreneurs, namely: a) Consumer protection from counterfeit goods, that is, consumers are given guarantees for security and safety to consumers in the use, use and utilization of goods and or services consumed or used. So product users or consumers do not feel disadvantaged by business actors; b) Protection of the responsibility of the business actor against consumers who purchase counterfeit goods, meaning that any unlawful act, which causes harm to others, obliges the person who by his fault resulted in the loss, to compensate." Abstract

Abstrak Ketentuan pelaksanaan dari Undang-Undang Nomor 28 tahun 2014 tentang Hak Cipta (UU Hak Cipta) adalah Peraturan Pemerintah Nomor 56 tahun 2021 Tentang Pengelolaan Royalti Hak Cipta Lagu dan/atau Musik. Pertimbangan dikeluarkannya Peraturan pemerintah ini adalah : 1) Untuk memberikan pelindungan dan kepastian pemilik Hak Terkait terhadap hak ekonomi atas lagu dan/atau musik serta setiap Orang yang melakukan Penggunaan Secara Komersial lagu dan/atau music dibutuhkan pengaturan mengenai Pengelolaan Royalti Hak Cipta lagu dan/atau musik; 2) Untuk mengoptimalkan fungsi pengelolaan Royalti Hak Cipta atas pemanfaatan Ciptaan dan produk Hak Terkait di bidang lagu dan/atau music sesuai dengan ketentuan Pasal 87, pasal 89, dan pasal 90 UU Hak Cipta, perlu disusun suatu sistem pengelolaan Royalti Hak Cipta lagu dan/atau musik yang dilakukan oleh lembaga manajemen kolektif nasional.Adapun rumusan masalah yang dibahas adalah: Bagaimana bentuk perlindungan terhadap pemegang hak cipta lagu musik terkait hak penerimaan royalty. Kata Kunci: Pemegang Hak Cipta Musik, Perlindungan Hukum, Royalty Abstract The implementing provisions of Law Number 28 of 2014 concerning Copyright (Copyright Law) are Government Regulation Number 56 of 2021 concerning Management of Song and/or Music Copyright Royalties. The considerations for the issuance of this government regulation are: 1) To provide protection and certainty for the owners of Related Rights to the economic rights to songs and/or music as well as any Person who makes Commercial Use of songs and/or music, it is necessary to regulate the Royalty Management of Copyright of songs and/or music. music; 2) In order to optimize the function of managing Copyright Royalties for the use of Works and Related Rights products in the field of songs and/or music in accordance with the provisions of Article 87, Article 89, and Article 90 of the Copyright Law, it is necessary to develop a management system for Copyright Royalties for songs and/or music. or music performed by a national collective management agency. The formulation of the problem discussed is: What is the form of protection for copyright holders of music songs related to the right to receive royalties.
