Abstract

ABSTRAK Tujuan Penelitian ini ialah untuk menjabarkan bahwa Mahkamah Konstitusi (MK) sebagai pengawal konstitusi (guardian of constitution), yang berfungsi menjaga bekerjanya prinsip saling mengawasi dan mengimbangi (checks and balances), maka putusannya harus benar-benar dipastikan dapat dijalankan. Pengabaian terhadap Putusan MK dapat dianggap sebagai contempt of court dan contempt of constitution. Oleh sebab itu, keberlakuan semua putusan MK adalah bersifat final, tak terkecuali putusan MK dalam proses pemberhentian Presiden dan/atau Wakil Presiden. Untuk itu, perlu dilakukan revisi terhadap semua pengaturan yang mengakibatkan tidak finalnya putusan MK dalam proses tersebut, yaitu Pasal 39 ayat (2) UU No. 17 Tahun 2014 dan Pasal 19 ayat (4) Peraturan MK No. 21 Tahun 2009, atau setidak-tidaknya MK harus menegaskan sifat final putusannya dalam pertimbangan hukum pada perkara pemberhentian Presiden dan/atau Wapres. Kata kunci : Mahkamah Konstitusi, Presiden, Pemberhentian, Dewan Perwakilan Rakyat. ABSTRACT The purpose of this study is to explain that the Constitutional Court (MK) as a guardian of the constitution, which functions to maintain the operation of the principle of mutual supervision and balance (checks and balances), must ensure that its decisions are truly enforceable. Disregard for the Constitutional Court's decision can be considered as contempt of court and contempt of constitution. Therefore, the applicability of all decisions of the Constitutional Court is final, including the decisions of the Constitutional Court in the process of dismissing the President and/or Vice President. For this reason, it is necessary to revise all arrangements that result in the final decision of the Constitutional Court in the process, namely Article 39 paragraph (2) of Law no. 17 of 2014 and Article 19 paragraph (4) of the Constitutional Court Regulation No. 21 of 2009, or at least the Constitutional Court must confirm the final nature of its decision in legal considerations in cases of dismissal of the President and/or Vice PresidentKeywords: Constitutional Court, President, Dismissal, House of Representatives.
