Abstract

In 2024, general elections and regional head elections will be held in Indonesia. Given the large number of state civil servants, it can be expected that the participants in the general election will compete for support from the state civil apparatus, even though various regulations regulate the neutrality of the state civil apparatus. This study wants to explain the efforts to maintain the neutrality of the state civil apparatus in the general election and regional head elections in 2024. This research is a normative legal research and uses secondary data consisting of primary legal materials and secondary legal materials. The data were analyzed by interpreting, giving judgments and opinions and then drawing conclusions. The results of this study show that efforts to maintain the neutrality of the state civil apparatus in the general election and regional head elections in 2024 can be carried out through the synergy of several institutions namely the State Civil Apparatus Commission, Bureaucratic Leaders, Regional Inspectorate, General Election Commission, Election Supervisory Body so that it can run smoothly. optimal. Coordination between these institutions should be carried out from the beginning of the stage of holding the general election to strengthen awareness of the importance of maintaining the neutrality of the state civil apparatus and develop new methods that prioritize preventive measures so that violations of the provisions on neutrality of the state civil apparatus do not occur.

Abstract

Abstrak Dalam negara kesejahteraan, negara berperanan penting dalam memberikan pelayanan sosial kepada warganya. Penyelenggaraan pemerintahan berhubungan dengan pelayanan publik yang merupakan salah satu wujud dari fungsi pegawai negeri sipil sebagai pelayan masyarakat. Pemberian tunjangan tambahan penghasilan dimaksudkan untuk meningkatkan kualitas kerja pegawai negeri sipil, termasuk pegawai negeri sipil di Dinas Kependudukan dan Catatan Sipil Kabupaten Trenggalek. Penelitian ini adalah peneltian hukum empiris yang menggunakan data primer sebagai data utama dan didukung data sekunder. Data yang didapatkan dianalisis secara kualitatif, kemudian dilakukan penarikan kesimpulan dengan metode berpikir induktif. Hasil penelitian menunjukkan bahwa pemberian tunjangan tambahan penghasilan sangat berpengaruh terhadap produktivitas kerja pegawai negeri sipil di Dinas Kependudukan dan Catatan Sipil Kabupaten Trenggalek. Tidak ada kendala bagi pemerintah Kabupaten Trenggalek dalam memberikan tunjangan tambahan penghasilan. Kendala yang berujung pada keterlambatan pembayaran berasal dari pegawai negeri sendiri karena terlambat dalam pengisian Sasaran Kinerja Pegawai. Kata Kunci: Tunjangan Tambahan Penghasilan, Kinerja, Pegawai Negeri Sipil Abstract In a welfare state, the state plays an important role in providing social services to its citizens. The administration of government is related to public services which is one manifestation of the function of civil servants as public servants. The provision of additional income allowances is intended to improve the work quality of civil servants, including civil servants at the Department of Population and Civil Registry Service, Trenggalek Regency. This research is an empirical legal research using primary data as the main data and is supported by secondary data. The data obtained was analyzed qualitatively, then conclusions were drawn using inductive thinking methods. The results of the study show that the provision of additional income allowances greatly influences the work productivity of civil servants at the Department of Population and Civil Registry, Trenggalek Regency. There are no obstacles for the Trenggalek Regency government in providing additional income allowances. Obstacles that lead to delays in payment come from civil servants themselves because they are late in filling in Employee Performance Targets. Abstract

Abstrak Netralitas PNS dalam kegiatan politik diatur dalam sejumlah regulasi. Pada satu sisi, PNS sebagai warga negara memiliki hak asasi manusia yang berupa hak atas kebebasan untuk berserikat, berkumpul dan menyatakan pendapat, namun di sisi lain, sebagai aparatur negara, PNS tidak dapat sepenuhnya menggunakan hak tersebut. Tujuan penelitian ini adalah untuk mengetahui apakah peraturan netralitas PNS tersebut melanggar hak asasi manusia yang telah dijamin oleh Undang-Undang Dasar 1945. Penelitian ini adalah penelitian hukum normatif yang menggunakan data sekunder sebagai data utama. Data yang diperoleh dianalisis dengan deskripsi hukum positif, sistemasi hukum positif, analisis hukum positif, interpretasi hukum positif, dan menilai hukum positif. Hasil penelitian ini menunjukan bahwa adanya aturan netralitas bukan merupakan pelanggaran hak asasi manusia, karena aturan tersebut dimaksudkan agar seorang PNS dapat fokus pada tugas-tugas pemerintahan yang telah dibebankan sehingga dapat memberikan pelayanan yang adil tanpa terpengaruh oleh pertimbangan politik dan mencegah campur tangan yang tidak adil dalam pemilihan suara. Aturan tersebut merupakan konsekuensi hukum bagi seorang pegawai negeri sipil memiliki hubungan dinas publik dengan pemerintah. Ketika seseorang memutuskan untuk menjadi PNS, maka harus siap mengikuti dan mematuhi aturan yang ada. Kata Kunci: Hak Asasi Manusia, Netralitas, Pegawai Negeri Sipil Abstract The neutrality of civil servants in political activities is regulated in a number of regulations. On the one hand, civil servants as citizens have human rights in the form of the right to freedom of association, assembly and expression, but on the other hand, as state officials, civil servants cannot fully exercise these rights. The aim of this research is to find out whether the neutrality regulations for civil servants violate human rights which are guaranteed by the 1945 Constitution. This research is normative legal research which uses secondary data as the main data. The data obtained was analyzed by describing positive law, systemizing positive law, analyzing positive law, interpreting positive law, and assessing positive law. The results of this research show that the existence of neutrality regulations is not a violation of human rights, because these regulations are intended so that a civil servant can focus on the government tasks that have been assigned so that they can provide fair services without being influenced by political considerations and prevent unfair interference. in voting. This rule is a legal consequence for a civil servant having a public service relationship with the government. When someone decides to become a civil servant, they must be ready to follow and comply with existing rules. Keywords: Human Rights, Neutrality, Civil Servants
