Abstract

Realitas yang ada di tengah masyarakat menunjukkan bahwa masalah kekerasan terhadap perempuan dan perlindungan perempuan korban kekerasan dalam bidang hukum masih sangat rendah. Ada banyak faktor yang mempengaruhi proses penegakan hukum, yaitu:substansi, struktur dan budaya. Dalam substansi, produk hukum yang tersedia saat ini adalah Undang-UndangNomor 23 Tahun 2004 tentang Penghapusan KekerasanDalam Rumah Tangga, dan UU Nomor 21 Tahun 2007tentang Tindak Pidana Perdagangan dalam artikel Persons. Tulisan ini mencoba untuk melihat berbagai jenis kekerasan terhadap perempuan baik di rumah, tempat kerja  dan juga dalam masyarakat sebagai manifestasi dari ketidakseimbangan daya tawar yang dimiliki perempuan dalam relasi  pria dan wanita. Melalui metode penelitian kualitatif peneliti ingin mengetahui bentuk kekerasan terhadap perempuan termasuk fisik,seksual, ekonomi, politik, dan penampilan psikologis yang dapat dilakukan baik oleh individu, masyarakat dan negara. Artikel ini menunjukkan bahwa penegakan hukum untuk melindungi perempuan masih rendah. kata kunci: Perlindungan hukum, perempuan, korbankekerasan The Real life of the community showed that in the legal field,the problem of violence against women and protection ofwomen victims of violence are not sufficient. Various factorsaffect the law enforcement process, namely: the substance,structure and culture. In substance, legal products availabletoday are Law Number 23 of 2004 on the Elimination ofDomestic Violence, and the Law Number 21 Year 2007concerning the Crime of Trafficking in Persons.This articlefocused on kinds of  violence against women either athome, the workplace, and in society as a manifestation ofthe bargaining power imbalance in the relationship betweenmen and women. Through qualitative research method theresearcher would like to know forms of violence againstwomen include physical, sexual, economic, political, andpsychological appearence which can be done either byindividuals, communities and countries. This article showsthat the law enforcement to protect the women is still low.Keywords: legal protection, women, violence victims

Abstract

Ecosides have become an international discourse since the 1970s, as a result of concerns about human behavior towards the environment. In the last 10 years ecocide has appeared so clearly as part of a structured, systematic and massive exploitative action. The development of environmental crimes in the form of ecocides has not been followed by concrete efforts in the form of an international consensus to define ecocides as the most serious crime that can threaten environmental destruction. In the midst of this situation, there are 2 (two) interesting approaches to be developed further within the framework of explaining, analyzing and understanding ecocides, namely the loss of ecological service and environmental crime approaches. Therefore this study will focus on 2 (two) issues, : What is the history, concept and significance of ecocides in the framework of environmental protection and human rights; and what about ecocide analysis in the loss of ecological service and environmental crime approaches in the dimensions of international criminal law and reform of Indonesian criminal law? The results of the study show that formulating ecocides as a normative construct is very important in order to provide further steps in protecting both the environment and humans. The duality of approaches in understanding ecocide has the opportunity to be developed in the context of an integrative approach, thereby guaranteeing certainty of response to ecocide internationally, including in developing effective criminal policies in Indonesia.
