<![CDATA[Tujuan penelitian menganalisis penyelesaian pembagian harta warisan pasangan suami istri yang beda agama dalam persfektif hukum Islam dan KUHPerdata dan status hukum hak waris pasangan suami istri perspektif hukum Islam dan KUHPerdata Penelitian ini adalah tipe yang digunakan adalah penelitian hukum normatif. Hasil penelitian menunjukkan bahwa penyelesaian pembagian harta warisan pasangan suami istri yang beda agama dalam persfektif hukum Islam dan KUHPerdata yaitu baik menurut hukum waris perdata maupun menurut hukum kewarisan Islam sama-sama menganut sistem kewarisan individual, artinya sejak terbukanya waris (meninggalnya pewaris). Dalam perkara waris beda agama sejumlah hakim mengeluarkan putusan hukum dengan pertimbangan wasiat wajibah dengan alasan keadilan dan kemanusiaan sedangkan status hukum hak waris pasangan suami istri perspektif hukum Islam dan KUHPerdata kiranya dengan adanya pemberitahuan kepada masyarakat muslim tentang pembagian harta warisan kepada orang yang beda agama dapat menjadi sebuah pelajaran yang penting. The research objective is to analyze the settlement of the distribution of inheritance for married couples of different religions from the perspective of Islamic law and the Civil Code and the legal status of the inheritance rights of married couples from the perspective of Islamic law and the Civil Code. The results of the study indicate that the settlement of the division of inheritance between husband and wife of different religions in the perspective of Islamic law and the Civil Code, that is, both civil inheritance law and Islamic inheritance law adhere to the individual inheritance system, meaning that since the opening of inheritance (death of the heir). In the case of inheritance of different religions, a number of judges issue legal decisions with consideration of mandatory wills for reasons of justice and humanity, while the legal status of the inheritance rights of husband and wife from the perspective of Islamic law and the Civil Code, presumably with notification to the Muslim community about the distribution of inheritance to people of different religions can be an important lesson.]]>
