Abstract

Child support rights after divorce constitute a fundamental right that must be protected to ensure children's welfare and development. However, many children do not receive adequate financial support because parents, particularly fathers, fail to fulfill their obligations after divorce. This study aims to analyze the legal regulation of child support rights after divorce and examine the legal protection available when these rights are neglected. The research employs normative legal research using statutory and conceptual approaches. Legal materials were collected through library research, including legislation, legal literature, scholarly journals, and relevant court decisions. The findings show that Indonesian law provides a comprehensive legal framework through the Marriage Law, the Child Protection Law, and the Compilation of Islamic Law, all of which affirm that divorce does not terminate parental responsibilities. Under Islamic law, the obligation to provide child support remains with the father. Legal protection is available through civil and criminal mechanisms, including enforcement claims and criminal liability for child abandonment. However, weak law enforcement, limited supervision of court decisions, and low legal awareness continue to hinder effective protection. Strengthening enforcement, increasing legal awareness, and enhancing state involvement are essential to ensure the fulfillment of child support rights after divorce.

Abstract

In 2018, the Ministry of Religious Affairs of Papua Province initiated the Musabaqah Qiraatul Kutub (MQK) program for Penghulu, yet its effectiveness encountered impediments attributed to various factors. This qualitative study employed data mining techniques such as interviews, observation, and documentation, supplemented by relevant scientific literature as secondary sources. The theoretical framework utilized for analysis was Soerjono Soekanto's effectiveness theory, and data analysis unfolded through sequential stages of reduction, presentation, and verification. The findings delineate two primary inhibiting factors: a prevalent deficiency in reading and understanding the Yellow Book among participating Penghulu and constraints in budget allocation for the activities. This underscores a sociological construct, elucidating obstacles to the effectiveness of the Musabaqah Qiraatul Kutub (MQK) program. The theoretical implications underscore the imperative of enhancing human resources, facilities, and budgetary allocations to augment Penghulu competence in comprehending and interpreting the Yellow Book. It is pertinent to acknowledge the study's limitations, given the absence of an exploration into the Ministry of Religious Affairs of Papua Province's post-program strategy concerning Penghulu lacking proficiency in reading and understanding the Yellow Book.

Abstract

Government Regulation Number 87 of 2014 establishes key family functions as the foundation for developing resilient and high-quality families in Indonesia. However, existing studies tend to describe these functions normatively, with limited analysis of their alignment with Islamic legal objectives, particularly within the framework of Maqasid al-Shariah. This study addresses that gap by examining the extent to which the regulation reflects the core principles of Maqasid al-Sharah, namely the protection of religion, life, intellect, lineage, and property. This research employs a normative legal method using statutory and conceptual approaches, with Maqasid al-Shariah as the primary analytical framework. The findings indicate that the family functions outlined in Government Regulation Number 87 of 2014 religious, affectionate, protective, reproductive, educational, and economic are substantively aligned with the objectives of Maqasid al-Shariah . The study contributes by offering a more critical and integrative interpretation, demonstrating that the regulation not only serves administrative purposes but also embodies fundamental values of protection and welfare. Thus, it confirms the normative coherence between state law and Islamic legal principles in promoting prosperous, harmonious, and sustainable families
