Abstract

Berkenaan dengan penyeragaman hukum di bawah OHADA, pertanyaan penting harusdiajukan adalah dapatkah OHADA menjembatani antara sistem common law dan sistem civil law?Apakah OHADA kompatibel dengan hukum umum? Apakah OHADA memiliki kapasitas untukmenangani keragaman tradisi hukum dan peradilan Afrika? Apakah OHADA mempertimbangkannorma budaya dan tradisional Afrika? Tampaknya jika tidak, maka proses integrasi akan menjadipernikahan yang tidak nyaman. Dapatkah sifat bujural Kamerun dipertahankan, apalagidipromosikan, dalam konteks OHADA? Dapatkah reformasi yang berarti mempertimbangkankekhasan nasional? Hal yang menjadi perhatian lebih, mampukah OHADA mengakomodir kondisimasyarakat kontemporer yang kontradiktif, serta tantangan globalisasi dan modernisasi?Pendekatan yang tepat seharusnya adalah dengan mempromosikan hukum, prinsip, dan praktikyang sesuai dengan standar keadilan dan keadilan yang ortodoks dan diterima secara universalyang dimodifikasi agar sesuai dengan kenyataan di Kamerun dan Afrika. Artikel ini akanmembahas latar belakang sejarah Kamerun kerangka hukum, sifat dan tren Uniform Law saat inireformasi serta tantangan pembangunan dan implementasi Perjanjian OHADA dan Uniform Act.Akhirnya, di sesuai dengan semangat dan filosofi bahwa sistem hukum dimaksudkan untukberfungsi sebagai batu ujian keadilan dan kesetaraan, Pasal ini mengusulkan caranya maju denganPerjanjian OHADA dan Undang-Undang Seragam yang telah datang ke tinggal

Abstract

Many things are still being debated to ratify the law on the transportation of goods by seain Indonesia. International legislation is like the international agreement Hague / Hague-Visby /Hamburg / Rotterdam. These four conventions have been mostly implemented by most of the world'smaritime countries, leaving several countries to defend their versions, including Indonesia.Indonesia still adheres to the 1898 code inherited from the Dutch colonial era. The comparativeanalysis resulted in similar implementations of versions of the four UNCITRAL conventions adoptedby many countries. This strongly prompted Indonesia to replace the 1898 commercial code with thecurrent international practice that conveys Indonesia's best interests

Abstract

A report from Research and Markets estimates that the global maritime safety industry willgrow from US$16.71 billion in 2016 to US$23.67 billion in 2021 through factors such as compliancewith regulatory standards and guidelines, increased maritime awareness, and an increasing numberof incidents of piracy and terrorism.” (Research and Markets: 2016). Abstract

Countries that enter into international agreements have several tools to increase the strength and credibility of their commitments, including the ability to make the agreement a formal agreement rather than soft law, provide for mandatory dispute resolution procedures, and establish monitoring mechanisms. How does international law deal with the problems of large-scale cooperation that countries in the world are facing now and will continue to face in the future? Friedmann argues that international law is moving, and must move, from the law of international coexistence, which governs diplomacy between states, to the law of international cooperation. At the same time, international contract law theorists have not shown much interest in reaching out to legal philosophers for enlightenment. Given these issues, this article aims to examine international law as a viable field of study for philosophy of law in the context of legal pluralism and also to understand the ramifications of its development for the international order. Therefore, it is necessary to discuss international treaty arrangements from the perspective of legal philosophy. This study discusses the direction of drafting contracts whose elements must be fulfilled from a legal, philosophical point of view. One way that could be used is to adopt Dworkin's strategy and incorporate the concept of law into moral arguments, this aligns with the distinction between analytical and normative jurisprudence on domestic law and the way many moral philosophers engage with questions of moral justification. The discussion of the problem in this paper uses normative juridical research methods using a descriptive research approach.
