<![CDATA[AbstractThis article aims to find out what are the problems that hamper the protection of legal rights of book copyrights at Surakarta City's Sriwedari bookstore. The research methodology used is a non-doctrinal research method or Empirical research, which is researching secondary data at first, then continuing research on primary data in the field. The Law of the Republic of Indonesia Number 28 of 2014 concerning Copyright confirms that books are one of the creations that must be protected. Copyright creators and apprentices also get protection for their creations, namely protection of moral rights and economic rights. The result is the protection of the rights of authors and book copyrights holders in the Surakarta city of Sriwedari bookstore, which has not been protected to the maximum because there are deficiencies in the application and there are 3 inhibiting factors is lack of socialization about Copyright, LMK that has not been running optimally and the low legal culture of the community . Many booksellers and photocopier businesses do not know about the protection of the creator regulated in the Law of the Republic of Indonesia Number 28 of 2014. Based on the results of the study and discussion, the researcher concluded that the implementation of the protection of the creators and holders of book copyrights at the Surakarta Bookstore Sriwedari was still not optimal and harmed the creators.Key Words: Protection; Copyrights; Creator; Copyright Holder; Sriwedari BookStoreAbstrakArtikel ini bertujuan untuk mengetahui apa saja problematika yang menjadi penghambat perlindungan hukum Hak Cipta buku di kios buku Sriwedari Kota Surakarta. Metodologi penelitian yang digunakan adalah metode penelitian non doktrinal atau penelitian Empiris, yaitu meneliti data sekunder pada awalnya, untuk kemudian dilanjutkan penelitian terhadap data primer di lapangan. Undang-Undang Republik Indonesia Nomor 28 Tahun 2014 tentang Hak Cipta menegaskan bahwa buku adalah salah satu ciptaan yang harus dilindungi. Pencipta dan Pemagang Hak Cipta juga mendapatkan perlindungan atas ciptaannya yaitu perlindungan atas Hak Moral dan Hak Ekonomi. Hasilnya perlindungan hak pencipta dan pemegang Hak Cipta buku di kios buku Sriwedari Kota Surakarta ,masih belum dilindungi dengan maksimal karena terdapat kekurangan pada penerapan dan terdapat 3 faktor penghambatnya yaitu kurangnya sosialisasi tentang Hak Cipta, LMK yang belum berjalan dengan maksimal serta rendahnya budaya hukum masyarakat .Terlebih lagi para pedagang buku dan pelaku usaha fotokopi masih banyak yang tidak mengetahui tentang perlindungan pencipta yang diatur dalam Undang-Undang Republik Indonesia Nomor 28 Tahun 2014. Berdasarkan hasil penelitian dan pembahasan, peneliti mendapatkan kesimpulan bahwa pelaksanaan perlindungan pencipta dan pemegang Hak Cipta buku di kios buku Sriwedari Kota Surakarta masih belum maksimal dan merugikan pencipta.Kata Kunci: Perlindungan; Hak Cipta; Pencipta; Pemegang Hak Cipta; Kios Buku Sriwedari.]]>
