Abstract

Changes in the field of law are important matters that cannot be prevented by anyone, including Islamic law related to civil and criminal law. Specifically, in the discussion of Islamic criminal law regarding allegations of adultery (li'an), the accuser who is obliged to bring four male Muslim witnesses can turn into four non-Muslim male witnesses, because it is based on strong arguments so that non-Muslims who were initially illegitimate as witnesses become allowed. The change in law became apparent when an argument that said anyone could be a witness provided that the terms and conditions were sufficient as a witness. The legality of the four non-Muslim male witnesses is very strong when there is an argument based on the word of God regarding four witnesses who are not clearly stated whether they are Muslims or non-Muslims. Likewise, the reason that today's society is a modern and pluralistic society can provide a view of freedom for non-Muslim communities to stand witnesses to defendants in li'an cases or accusations of adultery.

Abstract

Maqashid Syariah Asy-Syatibi is one of the tools to monitor and balance the contemporary reality wherever and whenever. This is because the goal is very universal and can be recorded in various aspects of life, including traditional and contemporary muamalah practices. In contemporary practice, the use of Maqashid Syariah is inseparable from Muslim’s needs so it can be implemented in soul maintenance (hifz an-nafs); e.g. from the threat of death in the practice of trading gecko’s bile which is is believed to cure HIV AIDS. Another implementation is asset protection (hifz al-mal) in the practice of sharia insurance and sharia Reksa Dana (mutual fund). This can guarantee that one’s property will return according to mutual agreement if there is an unfortunate condition. Furthermore, the implementation of Maqashid Syariah Asy-Syatibi can encourage the hifz al-mal by financing through the trading practice using internet, telephone, WhatsApp, Instagram, and SMS.Maqashid Syariah Asy-Syatibi merupakan salah satu alat untuk meneropong dan mengimbangi realitas kontemporer itu di mana dan kapan saja. Ini karena tujuannya sangat universal dan bisa terekam dalam berbagi aspek kehidupan, termasuk dalam praktik muamalah tradisional maupun kontemporer. Dalam praktik kontemporer, penggunaan Maqashid Syariah tidak lepas dari kebutuhan Muslim sehingga diimplementasikan dalam pemeliharaan jiwa (hifz an-nafs); seperti dari ancaman kematian dalam praktik jual-beli empedu tokek yang berkhasiat menyembuhkan HIV AIDS. Implementasi lainnya ialah penjagaan harta (hifz al-mal) yang terekam dalam praktik asuransi syariah maupun reksadana syariah. Ini dapat menjamin harta seseorang akan kembali sesuai perjanjian yang telah disepakati jika terjadi musibah. Selanjutnya implementasi maqashid Syari`ah Asy-Syatibi itu dapat mendorong terpeliharanya harta (hifz al-mal) dengan cara pembiayaan melalui praktik jual beli dengan menggunakan via internet, telepon, WhatsApp, Instagram, dan SMS.

Abstract

People flocked to meet their needs on a large scale in many retailers since the outbreak of the COVID-19 virus, including the Jembatan Baru retail, which is a provider of various products. This study aimed to investigate panic buying activity as well as how its practice in the perspective of Islamic consumption. The study was qualitative descriptive. The findings showed that the practice of panic buying at the Jembatan Baru retail took place from March 24 to March 30, the targeted items or stuffs were primary food products, cleaning and disinfectant liquids, hand sanitizers, and vitamin drinks. The factors which encouraged panic buying were anxiety about the scarcity of goods, rising prices, and the negative news adoption of social media. The practice of panic buying showed an attitude of carelessness and haste in making consumption decisions besides that, this behavior is very excessive and shows greed, although this practice is carried out to fulfill the emergency needs and protection of self and soul, but still this behavior is considered selfish behavior and ignores what other needs. Sejak merebak virus COVID-19 masyarakat berbondong-bondong memenuhi kebutuhannya secara besar-besaran di berbagai retail tidak terkecuali retail Jembatan Baru yang merupakan penyedia berbagai macam produk kebutuhan rumah tangga,,penelitian ini bertujuan untuk mengkaji praktek panic buying yang terjadi di retail Jembatan Baru, Faktor apa yang mendorong terjadinya panic buying, serta bagaimana praktik panic buying dalam perspektif konsumsi Islam. Dalam penelitian ini peneliti menggunakan analisis deskriptif, dan dengan pendekatan kualitatif. Hasil penelitian membuktikan bahwa praktek panic buying di retail Jembatan Baru berlangsung sejak tanggal 24 Maret- 30 Maret, dengan barang yang menjadi incaran seperti produk sembako, cairan pembersih dan disinfektan, handsanitizer, dan minuman bervitamin. Adapun faktor yang mendorong terjadinya panic buying yakni kecemasan akan kelangkaan barang, naiknya harga, dan adopsi berita negative dari media massa. Praktek panic buying di Retail Jembatan Baru ini termasuk kedalam perilaku yang dilarang, karena perilaku ini menunjukkan sikap ketidakhati-hatian dan tergesa-gesa dalam mengambil keputusan konsumsi, selain itu juga perilaku ini sangat berlebih-lebihan dan memperlihatkan ketamakan, meskipun praktek ini dilakukan untuk memenuhi kebutuhan daruriyat dan peerlindungan diri dan jiwa (hifz al-nafs) namun tetap saja perilaku ini terhitung perilaku yang egois dan mengabaikan kepentingan orang lain. Abstract

The purpose of this study is to examine the concept of blessing profit that is widely discussed by observers of the Islamic economy which isclaimed to be a very  abstract matter so that measuring it becomes a very difficult activity  to find, but rather the  right criteria to be able to achieve it. Thus, this study uses a descriptive analysis method to examine more deeply the things that must be done by traffickers, both traders and buyers. The results of  this study show that the  criteria that must be carried out by business people as strong evidence  for them in obtaining blessing profits, namely through the preprocessing stage, process, and postprocess. The preprocess stage is required to base its trade attitude with theological values so that its tendency will give birth to a high devotion to the powerful. Meanwhile, the stages of the process strengthen it by instilling an honest, sincere, professional, friendly sosial, and generous attitude. This honest attitude will encourage  the birth of a sincere attitude of both parties and inturngive birth to a professional attitude so that trade activities run smoothly which is characterized by customers increasing from time to time because it is based on the inten silaturrahim and generous of traders and buyers so that the final stage strengthens the acquisition of blessing profits through evaluation of the trading activities carried outby him through the payment of obligations after reaching one nisab.
