Abstract

Menempatkan dan menjadikan Pancasila sebagai sumber dari segala sumber hukum negara dalam pembentukan peraturan perundang-undangan adalah sebuah keniscayaan yang harus diperhatikan dan dilaksanakan oleh setiap lembaga yang berwenang dalam membentuk undang-undang dalam hal ini adalah Anggota Dewan Perwakilan Rakyat dan Pemerintah. Sebab, Pancasila merupakan ediologi atau pandangan hidup bangsa dan sekaligus sebagai dasar negara. Sehingga dalam hierarki pembentukan peraturan perundang-undangan Pancasila merupakan norma tertinggi yang harus menjadi rujukan. Namun demikian jika melihat perkembangan judicial review di Mahkamah Konstitusi (MK) banyak sekali Undang-undang yang dihasilkan oleh anggota legislatif bersama dengan pemerintah dibatalkan oleh MK karena dianggap bertentangan dengan Undang-undang Dasar NRI Tahun 1945 yang notabenya pasti juga bertentangan dengan Pancasila sebagai norma tertinggi. Dalam artikel ini akan mengkaji tentang argumentasi hukum terkait posisi Pancasila sebagai sumber dari segala sumber hukum negara dalam kaitannya dengan upaya mempertahankan eksistensi Pancasila sebagai sumber dari segala sumber hukum negara. Pendekatan teoritis dipilih dalam pendekatan ini guna menjawab persoalan di atas.

Abstract

Pemilu merupakan bagian dari negara yang menganut sistem demokrasi dalam menjalankan kegiatan pemerintahan. Pemilu juga merupakan cara memilih dan menentukan kepala negara yang juga kepala pemerintahan. Pasal 22E (2) UUD 1945 sebagai dasar hukum utama penyelenggaraan pemilu. Diselenggarakannya pemilu untuk menghasilkan anggota (DPR), (DPD) dan (DPRD). Pelaksanaan pemilu yang bersih, terbuka dan adil merupakan amanah tegas konstitusi untuk menciptakan pemilu yang demokratis dan berkualitas. Namun, pelanggaran, kecurangan, dan penyalahgunaan kekuasaan masih saja terjadi dalam praktik pemilihan umum. Politik uang merupakan salah satu isu hukum yang kuat hingga saat ini dan jumlahnya terus bertambah dari tahun sebelumnya dalam pemilihan umum, pemilihan kepala daerah dan pilkades. Politik uang merupakan usaha untuk membuat orang lain (masyarakat) empati dengan menggunakan materi sebagai imbalan dalam transaksi perdagangan suara sebelum dan selama pemilu. Dalam artikel ini, membahas tentang pengenaan sanksi hukum sebagai upaya hukum untuk mencegah praktik politik uang yang terjadi ketika sebuah pesta demokrasi diselenggarakan.

Abstract

Pada prinsipnya setiap warganegara berkedudukan sama untuk turut serta dalam pelaksanaan Pemilukada baik untuk memilih maupun dipilih, namun demikian, guna menciptakan prinsip demokrasi dan birokrasi yang baik maka perlu adanya instrument hukum yang mengatur hal tersebut khususnya yang berkaitan dengan banyaknya dinasti politik yang terus berkembang hingga saat ini. Pemilu dan pilkada serentak pada tahun 2024 berpotensi terhadap meningkatnya angka dinasti politik Indonesia. Dalam artikel ini terdapat dua isu hukum yang akan dikaji, pertama, legalitas dan kedudukan politik dinasti dalam sistem hukum ketatatanegaraan Indonesia, kedua, terkait upaya konstitusional dalam memutus mata rantai dinasti politik di Indonesia. Hasil penelitian menunjukkan bahwa secara hukum dinasti politik adalah legal hal ini dipertegas dengan adanya putusan MK No. 33/PUU-XIII/2015 yang membatalkan Pasal 7 huruf r UU No. 8 tahun 2015 karena dianggap bertentangan dengan UUD. Upaya konstitusional yang dapat dilakukan guna mencegah dinasti politik ada beberapa aspek pertama, masyarakat untuk bersama-sama tidak memilih calon yang berangkat dari dinasti politik, kedua, partai politik untuk tidak menunjuk calon yang memiliki hubungan dengan penguasa dan yang ketiga pada penyelenggara pemilu (KPU dan Bawaslu) untuk memberikan sanksi tegas bila ditemukan calon yang berkampanye dengan memanfaatkan jabatan keluarganya dan fasilitas negara.

Abstract

Simultaneous elections in 2024 will soon take place, this is marked by the start of several election stages starting from the formation of election commissions/organizers to the drawing of serial political party numbers. The holding of democratic elections in accordance with the principles of elections is a must to be realized, especially in the simultaneous elections in 2024. So that concrete efforts are needed in monitoring, overseeing and supervising and supporting stages by stages in the implementation of elections. Constitutionally, Bawaslu is an institution whose job is to supervise the implementation of elections. However, the involvement and participation of the public/community in terms of monitoring the implementation of elections is important to do by looking at the form, number and characteristics of massive and systematic violations. Public involvement is a constitutional right in overseeing and giving control over the holding of democratic elections in order to ensure people's sovereignty in the holding of elections. There are several important and crucial stages in the election stage, namely the collection of voter list data which is often found by fictitious voters and unregistered voters and the second crucial stage is the implementation of voting in the field. The 2024 simultaneous elections will be more complicated and take up a lot of time and energy so that the existence and involvement of the public/community in terms of oversight and monitoring functions is absolutely necessary in order to assist the Bawaslu in carrying out its duties and functions so that quality elections can be created with intelligent voters by being able to suppress and minimize the number of election violations.

Abstract

Indonesia is a constitutional state with a democratic government where all citizens get equal rights in a democratic party with the principle of fairness and justice. However, in implementation of the election there were many violations, for example money politics, power and influence of power. This study aims to find out what the right strategy is to deal with corruption in general elections and local elections in 2024. Normative juridical research methods are used to investigate, find, and describe quality in the upcoming 2024 election. There were many violations in the 2019 election and found 6,649 offenders who committed corruption. Based on ICW data, there were 579 corruption cases that have been prosecuted in Indonesia throughout 2022. There are strategies and steps in eradicating corruption in elections in Indonesia, namely with a sanction and criminal system that has been regulated in Law No. 7 of 2017 maximize criminal sanctions for money politics. In an effort to prevent money politics from occurring in the upcoming 2024 parliamentary elections, this research offers several aspects of law enforcement and the constitution which include limits on campaign funds for both candidates and political parties as well as a prohibition on former corruption convicts from running again. The second side focuses on 3 aspects, namely election organizers who are independent and consistent, political parties that do not provide recommendations for candidates who do not have integrity and capacity and finally voters who have integrity without being tempted by transactional politics which makes election.

Abstract

The birth of the Islamic Boarding School Law Number 18 of 2019 provides a breath of fresh air for the world of education and Islamic boarding school institutions. Apart from the birth of this law, Islamic boarding school institutions have become stronger and juridically legal because they have their own legal umbrella and apart from this, good things will also have an impact on graduates. or students whose legality is recognized and equalized, such as Ma'had Aly, for example. In terms of funding, Islamic boarding school institutions cannot be separated from the government's attention so that in the provisions of Articles 46 and 48, the Central Government and Regional Governments are obliged to participate in providing services and facilitating activities organized by Islamic boarding schools. The local government is also obliged to provide assistance in terms of human resource development in the Islamic boarding school environment, one of which is the object of research for this article is PP Salafiyah Syafi'iyah Sukerjo or commonly abbreviated as P2S3. From the results of this research, it is stated that the independence and development of the P2S3 Islamic boarding school is extraordinary even though previously there was no regional government intervention. It is hoped that the Situbondo Regional Government can immediately finalize the Regional Regulation on Islamic Boarding Schools so that in acting and providing service facilities there are standard procedures and in accordance with the provisions of laws and regulations, especially Law 18 of 2019 concerning Islamic Boarding Schools.

Abstract

Dinasti politik adalah kekuasaan politik yang diterapkan oleh sejumlah orang yang masih terikat dalam hubungan keluarga atau pertahana untuk mempertahankan kekuasaan yang telah diwariskan. Pada awalnya dinasti politik telah di atur dalam UU No 8 Thn 2015 tentang pilkada akan tetapi hal tersebut bertentangan dengan UUD NRI 1945 yang selanjutnya dilakukan judicial review di Mahkamah Konstitusi dengan Nomor 33/PUU-XIII/2015 sehingga secara tidak langsung dinasti politik di Indonesia dilegalkan. Fokus kajian dalam penelitian ini ialah untuk mengetahui apa akibat dari putusan tersebut terhadap praktik dinasti politik pemilihan kepala daerah di Indonesia serta upaya yang dapat mencegah terjadinya dinasti politik. Metode yang digunakan dalam penelitian ini adalah kajian kepustakaan. Dari hasil yang di peroleh dalam penelitian ini, dinasti politik berakibat pada pencideraan demokrasi di Indonesia, akan tetapi hal ini tidak bisa dilarang, namun perlu di atur dan dikendalikan agar tidak disalah gunakan. Penulis rasa perlu adanya upaya- upaya yang dapat mencegah terjadinya praktik dinasti politik di Indonesia yang menganut sistem demokrasi.

Abstract

On February 17, 2012, the Constitutional Court granted the lawsuit filed by Hj. Aisyah Mochtar who filed a judicial review of Article 34 Paragraph (1) of Law Number 1 of 1974 concerning Marriage. This lawsuit arose from her marriage to Moerdiono in accordance with Islam which was not officially registered, which gave birth to a son, Iqbal Ramadhan. The Constitutional Court's decision changed the status of illegitimate children, who previously only had a civil relationship with the mother, now also have a civil relationship with the father and the father's family. This decision applies not only to children born from unregistered marriages, but also to children from relationships between men and women without the bonds of marriage which can be proven through technology such as DNA testing. These children are entitled to civil rights protection, such as maintenance and education, but are not related to guardianship issues. In its considerations, the Constitutional Court emphasized that the law must provide fair protection and legal certainty for the status of children, including those born even though their marriage is still disputed. Eliminating discrimination against illegitimate children aims to provide positive value for the future of children. The obligation of alimony that was previously only borne by the mother, is now shared with the father who can be proven to have a blood relationship with the child. If the father neglects to fulfill his obligations, he can be sued in court. The next question is how the Constitutional Court Decision will be implemented regarding the recognition of the lineage of children born outside of legal marriage.

Abstract

Dismissal of a Regional Head can occur due to two factors, the first is 'Objective' in investigating violations of the oath or promise of office carried out by the Regional Head. Second, 'Subjective' in using his authority, namely looking for loopholes to dismiss the Regional Head on sentimental grounds. The reasons for the dismissal of a Regional Head are regulated in Article 78 paragraph (1) and paragraph (2) of Law Number 23 of 2014 concerning Regional Government (UUPD). Some of the problems that often occur in the dismissal of Regional Heads are, the Regional Head is elected directly but the mechanism for dismissal is indirectly (representatively) through the DPRD so that it is not in line with democracy, then regional autonomy is not implemented freely because there is still a role for the central government and there is also no Judicial institutions in regions specifically for the dismissal of Regional Heads. After we analyzed the many articles in the Constitution, the amendments relating to the main duties of the House of Representatives, also in UUMD3 1999 in conjunction with UUMD3 2014, were further emphasized by DPR Standing Orders No. 16/DPR/RI/1999-2000 jucto Regulation of the House of Representatives of the Republic of Indonesia Number 1 of 2014 concerning Rules of Procedure, from the authority and duties of the DPRD above, it can be formulated that the DPRD has three functions, namely the supervisory function, the budget function, and the function of making Law or legislation. In carrying out its functions and duties, the DPRD has several rights that can be used to carry out its duties as government supervisor. Some of the rights in question are the Right to Questionnaire, the Right to Interplation, the Right to Express an Opinion. As for the right to inquiry itself, the definition is contained in Article 79 paragraph (3) of Law Number 17 of 2014 concerning the MPR, DPR, DPD and DPRD.
