Abstract

This article is the result of research on the cultural heritage of the Bugis people of Luwu, South Sulawesi. The research questions that were raised were: how is inheritance practiced among the indigenous people of Bugis Luo, what is the meeting point of inheritance between Islamic law and customary law, and how do Islamic law and customary law combine to create gender. Primary data was collected through in-depth and structured interviews, as well as on-site observation. The analysis was performed using interpretive methods. The study was conducted by analyzing the regulations related to the legal issues discussed by analyzing the laws and comparing the decisions of the Luwu and Bugis courts with the perspective of customary law and Islamic law. The analysis used in this study resulted in women and men being equal. Bugis Luwu Sulawesi has a pluralistic hereditary system with both Islamic and traditional elements. Equal rights and rules are general ideas. This research is based on the proposed mixed inheritance model: masssideppungeng that links the heirs to family, government, and religious customary authorities, the distribution of assets to field conditions, and proportionally identifies the needs, wants, and goals of the inheritors.

Abstract

This study aims to find out how the juridical review of marriage registration services using simkah at the Office of Religious Affairs of Manggala District, Makassar City, The type of research used is qualitative, which is a form of research that aims to provide an overview of various types of data collected from the field objectively with a descriptive research type. The data collection techniques used were observation, interviews with a number of informants and documentation. The results of this research are in the background of the presence of an innovation in marriage registration services using the Marriage Management Information System or Simkah at the Manggala District Religious Affairs Office, this Simkah is a policy program issued by the government in an effort to facilitate the process of presenting marriage data in all KUA Districts in Indonesia, this Simkah has been integrated with Dukcapil, so that recording errors can be minimized, the implementation of the policy has been implemented and can be accepted by the community. However, there are several obstacles, especially the readiness of KUA human resources in Manggala District, Makassar City. In some cases, it was found that there were difficulties when using this application, the only difficulty in importing marriage data.

Abstract

This thesis discusses the Pemmali of Twin Marriages in Sibling Relationships Case Study of Cenning Village, West Malangke District, North Luwu Regency. This study aims to determine and understand the implementation and review of Islamic law in the twin marriage contract of sibling relationships. This type of research is qualitative research with an an empirical and historical juridical approac approach. The data sources used in this research are primary and secondary data. Then the data collection techniques in this research are observation, interviews, and documentation, data management techniques, namely using inductive methods, deductive methods, comparative methods and drawing conclusions. The results of the study found that the implementation of a twin marriage contract in a sibling relationship is the same as a marriage contract general; the only difference is that one of the brides does the marriage contract one day before the reception, and the other bride does the contract on the day of the reception because the people of Cenning village believe that if the marriage contract is carried out simultaneously, it will result in problems from for one of the twin marriage brides. Meanwhile, in the review of Islamic law, pemmali twin marriages in sibling relationships are permissible, because based on the results of research in their implementation.
