Abstract

Negara Indonesia merupakan negara yang menganut sistem presidensil. Historis ketatanegaraan kita menjelaskan Indonesia pernah mempraktikkan dua model sistem pemerintahan. Pada tahun 1945-1959 menganut sistem pemerintahan parlementer dan ketika Presiden mengeluarkan dekrit 5 Juli 1959, kembali kepada sistem presidensil. Reformasi mengakibatkan banyak perubahan, perubahan tersebut tak luput pada sistem ketatanegaraan. Fakta ketatanegaraan menunjukkan sistem presidensil dihadapkan pada gejolak politik yang mengarah kearah sistem parlementer, Karena presidensil dihadapkan dengan sistem multipartai. Penelitian ini adalah penelitian kepustakaan, yaitu penelitian yang mengolah data dari berbagai sumber bacaan yang berkaitan dengan penelitian ini. Penelitian ini menggunakan pendekatan perundang-undangan dan historis. Metode yang dipakai dalam analisis penelitian ini ialah metode kualitatif yang bersifat deskriptif. Hasil penelitian ini menunjukkan amandemen terhadap UUD 1945 menegaskan bahwa sistem pemerintahan yang dianut adalah sistem pemerintahan presidensil. Hal ini merupakan tindakan perbaikan terhadap sistem presidensil sebelum UUD 1945 diamandemen. UUD 1945 hasil amandemen menegaskan fungsi dan hak DPR sebagai legislatif dan pengawas kinerja pemerintah. Dipandang dari sisi demokrasi, penggunaan sistem multi partai memang memberikan kesempatan yang luas kepada setiap orang untuk ambil bagian dalam pelaksanaan hak-hak politiknya. Namun dipandang efektivitas penyelenggaraan pemerintahan, sistem ini malah memperlemah pelaksanaan sistem presidensil. Keywords : Demokrasi Presidensil Pasca Amandemen UUD 1945  Presidential Democracy Problems Post Amendment of the UUD 1945 ConstitutionAbstract Indonesia is a country that adheres to a presidential system. Our constitutional history explains that Indonesia has practiced two models of government systems. In 1945-1959 adopted a parliamentary system of government and when the President issued a decree 5 July 1959, returned to a presidential system. Reforms resulted in many changes, these changes did not escape the state administration system. The constitutional facts show that the presidential system is faced with political turmoil that leads to a parliamentary system, because the presidential system is faced with a multi-party system. This research is library research, namely research that processes data from various reading sources related to this research. This research uses a statutory and historical approach. The method used in the analysis of this research is a descriptive qualitative method. The results of this study indicate that the amendment to the 1945 Constitution confirms that the system of government adopted is a presidential system of government. This is a corrective action against the presidential system before the 1945 Constitution was amended. The 1945 Constitution as a result of the amendments affirms the functions and rights of the DPR as a legislature and supervisor of government performance. From a democratic point of view, the use of a multi-party system does provide ample opportunity for everyone to take part in the implementation of their political rights. However, in terms of the effectiveness of the administration of government, this system actually weakens the implementation of the presidential system.Kata Kunci : Presidential Democracy After The Amendment 1945 Constitution

Abstract

Indonesia is a state of law, the basic law for all laws and regulations in Indonesia is the 1945 Constitution of the Republic of Indonesia. In an effort to uphold the constitution and the principles of a democratic rule of law, the Constitutional Court has the authority to examine laws on the 1945 Constitution of the Republic of Indonesia. to find out how the judges of the Constitutional Court considered the decision Number 106/PUU-XVIII/2020 and to find out the impact of the decision. This study uses a normative juridical approach with a descriptive analytical method which will explain the description of the analysis of the data that has been collected. Based on the results of the research on Decision Number 106/PUU-XVIII/2020, it can be concluded that the judge in his decision had careful considerations such as looking at the facts contained in the trial and considering the results of the examination of related parties. The impact of this decision is that the public is prohibited from using class I narcotics for health services. The use of narcotics is only allowed within the scope of the development of science and technology. There is a strong impetus for research on the use of class I narcotics in the government and the private sector.Keywords: Judge's Consideration, Impact of Decision Number 106/PUU-XVIII/2020.
