Abstract

This article seeks to criticize Khaled Abou el Fadl's negotiating hermeneutics. Abou el Fadl's hermeneutics implicitly follows the Gadamerian, which sees texts subjectively, because of which all resulting interpretations are not final but relative. Thus, Khaled Abou el Fadl's hermeneutics cannot be categorized as an emancipatory critical science. When compared and analyzed using Jurgen Habermas's discourse theory, Abou El-Fadl's hermeneutics has remained within the theoretical discourse model. The legal investigation process is performed by legal experts in monologue and not open dialogue with other interpretation communities. With this, legal decisions are made by a single subject and not Communicated with mutual understanding with the subjects other. Likewise, Abou El-Fadl states that the highest morality in determining law is discourse morality, not merely truth or precision. Using deliberative hermeneutics, the conclusion drawn from this article is that Abou el Fadl's ideas on gender issues with their negotiating hermeneutics have not been able to create an inclusive, egalitarian, and domination-free discourse in realizing a legal decision. This research is a type of qualitative research library (library research). The method used in this research is descriptive-analytical-critical. Descriptive is used to describe Khaled's understanding. Analytics is used to analyze the understanding of Khaled. Moreover, it is critical to criticize what has been described previously

Abstract

This study aims to discuss Nasr Hamid Abu Zayd's thoughts on the Quran as scripture. Using the type of literature study research, this article explains Abu Zayd's thoughts as contained in several of his writings. This study's findings state that Abu Zayd's argument that the Quran as a cultural product and cultural producer (muntaj tsaqafi and muntij tsaqafi) departs from Abu Zayd's approach, which sees Islam as a social fact. There is a big difference between Islam, studied as a social fact, and Islam, seen as a religious doctrine. Islam as a social fact demands objective and positive scientific work. Abu Zayd took a new approach to the Quran by shifting the direction of study from a vertical dimension to a horizontal dimension. The horizontal dimension referred to by Abu Zayd is the canonization in which the teachings of the Quran were spread gradually by the Prophet Muhammad. This article also concludes that Abu Zayd sees it as a text for studying the Quran. It is at this point that Abu Zayd uses a hermeneutic approach. It is at these two points that Abu Zayd said that his study of the Quran is based on the human aspect. What Abu Zayd means by studying the Qur'an, which departs from the human aspect with a horizontal dimension is also what is meant by Islam as a social fact in this article. In the order of writing, the article sequentially discusses the following points. The first part of this article reviews a brief biography of Abu Zayd, along with the social and political conditions that influenced his thinking. The second part explains the Quran as a text. And in the last section describes the Quran as a product as well as a cultural producer

Abstract

This article discusses Imam Al-Ghazali’s views on political ethics and governance. This type of research is literature using analytical methods. The primary source used by researchers is one of Imam Al-Ghazali’s works, namely “Al-Tibbr al-Masbūk fī Naṣīḥah al-Mulk” and several other relevant works. This article answers the problem when in the 16th century, there was a separation between ethics and politics in the West which was pioneered by an Italian statesman named Niccolo Machiavelli which resulted in that the mindset of the government was based on its acceptance of the political system of its time. This discussion becomes important as a response to debates and dialectics about the importance of ethics in politics. This study concludes that Al-Ghazali proposed that the government system be made up of a board of directors in carrying out every government program in order to create productivity and effectiveness in running the government. The Diwan should have three institutions in the country: the deliberative council, the judiciary and the ministerial body. In addition, ethics needs to be included in the political system, this is a critique of scholars who reject ethical participation in politics. Al-Ghazali advised the rulers about the importance of ethics in politics and government. It is formulated in seven principles namely fairness, competence, humility, honesty, responsiveness, sincerity, and gentleness.
