Abstract

Radikalisme agama telah menjadi kekhawatiran bangsa karena praktik keberagamaantersebut merapuhkan kebhinekaan dan kedamaian bangsa. Gerakan purifikasi itu mengingkariunsur lokalitas yang turut membentuk Islam Indonesia. Karenanya keberagamaan inimenafikan pluralisme sedemikian rupa, cenderung intoleransi, eksklusifisme, anti-keragaman(multikulturalisme) dan pada titik kritis bisa melahirkan terorisme. Fenomena radikalismeagama ini sudah menyebar hingga ke seluruh pelosok negeri dengan berbagai variannya. Perlukerjasama dengan berbagai pihak dalam menangkal radikalisme, salah satunya adalah peranulama dan kyai. Penelitian ini mencobamendeskripsikan peranan ulama dan kyai dalammenangkal radikalisme agama serta memberi gambaran bagaimana para ulama dan kyaimemberikan pendidikan keagamaan kepada masyarakat khususnya pemahaman agam diwilayah Kabupaten Batang. Penelitian ini masuk dalam kategori riset lapangan (field researchdengan pendekatan kualitatif. Setelah melakukan penelitian dengan teori dan metodologi yangdigunakan, peneliti menemukan gambaran bahwa ulama dan kyai di kabupaten Batangsetidaknya mempunyai tiga peran dalam menangkal radikalisme agama. Pertama,membimbing umat. Kedua, menyampaikan pesan keamanan dan ketertiban masyarakat danKetiga, mitra pemerintah. Adapun materi pendidikan keagamaan yang diberikan oleh ulamadan kyai kepada masyarakat bertolak pada tiga hal; pertama, ajaran Islam Rahmatan Lil‘Alamin. Kedua, penanaman dasar-dasar ibadah, dan Ketiga, nasionalisme. Berangkat daripemahaman inilah ulama dan kyai mempunyai andil yang cukup penting dalam menangkalpaham radikalisme agama yang dimungkinkan masuk ke wilayah kabupaten Batang.

Abstract

Human nature does not just want to be successful in material and social standard. In fact, he has desire to find the ultimate meaning of life based on his own perspective. The quest for the meaning of life could not be enough if just be done using external dimension—it could be reached by spiritual dimension. This study is intended to describe spirituality among the members of Majelis Zikir Kanzus Sholawat in Pekalongan City, Central Java, the form of spirituality, its formative factors, and motivation of the members to attend and join the collective praying. By using a qualitative approach and public opinion surveys, this study shows that the forms of spirituality of Majelis Zikir Kanzus Sholawat could be categorized into three point: (1) meaningful life; (2) more active worship, and (3) a more positive social life. These forms are influenced by two factors: (1) practice the teachings of zikir; (2) understanding the teachings of the leader of majelis zikir. This study also found that there are three motivation among the member of member of Majelis Zikir: a desire to reach spiritual enlightenment, a wish to gain barokah, and a longing for the mursyid (guide) in the tariqa.

Abstract

This study aims to describe the “gaduh sapi” collaboration in terms of practice and review of mu’āmalah fiqh in Tanjung Kulon Village, Kajen Country, Pekalongan District. This research is using descriptive qualitative research. The sources used in this study are data from interviews, observations, documentation, and literature data. The subjects of this study were cattle managers and owners of capital. Data collection techniques used non-participant observation methods, structured interviews, and documentation. The data analysis used is qualitative by using the deductive method. The study results show that the practice of “gaduh sapi” in Tanjung Kulon Village follows the habits of the village community both in terms of how to manage, provide capital, and share profits. The model of rowdy practice is carried out with two events, namely fattening and breeding. The “gaduh sapi” collaboration carried out by the community as a means of helping. The practice of “gaduh sapi” cooperation carried out by the community is in accordance with the rules of fiqh mu’āmalah, namely using a muḍārabah contract. Because the capital owner gives the business manager the freedom to manage his business, develop it without limiting the type, time, and place. The capital used in this rowdy cooperation practice is goods, namely cows. This follows one of the conditions for muḍārabah capital: it can be in the form of money or goods that are valued (cows are included). So that at the end of time the distribution of results can be distinguished from profits. Where cattle capital remains the right of the owner of the capital, then the fattening and breeding results are shared. The provisions of the benefits carried out by the people of Tanjung Kulon Village are by the rules of al-ghunmu bi al- ghurmi (risks are balanced with benefits). This study also confirms that there are no contracts containing gharar in the “gaduh sapi” practice.Penelitian ini bertujuan untuk mendeskripsikan “gaduh sapi” dari segi praktik dan tinjauan fiqh mu’āmalah di Desa Tanjung Kulon, Kecamatan Kajen, Kabupaten Pekalongan. Penelitian ini termasuk penelitian kualitatif yang bersifat deskriptif. Sumber yang digunakan dalam penelitian ini yaitu data hasil wawancara, observasi, dokumentasi, dan data literatur. Subjek penelitian ini adalah pengelola sapi dan pemilik modal. Teknik pengumpulan data menggunakan metode observasi non-partisipan, wawancara terstruktur, dan dokumentasi. Analisis data yang digunakan adalah kualitatif dengan menggunakan metode deduktif. Hasil penelitian menunjukan bahwa praktik “gaduh sapi” di Desa Tanjung Kulon mengikuti  kebiasaan  masyarakat  desa baik  dari  segi  cara  pengelolaan,  penyediaan modal, dan pembagian keuntungan. Model praktik gaduh yang dilakukan dengan dua acara yaitu penggemukan dan pengembangbiakan. Kerjasama “gaduh sapi” yang dilakukan oleh masyarakat sebagai sarana tolong menolong. Praktik kerjasama “gaduh sapi” yang dilakukan masyarakat sudah sesuai dengan aturan fiqh mu’āmalah, yaitu menggunakan akad muḍārabah. Pengelola usaha diberi kebebasan oleh pemilik  modal  untuk  mengelola  usahanya,  mengembangkan  tanpa  memberi batasan  jenis,  waktu  serta  tempat. Modal yang digunakan dalam praktik kerjasama gaduh ini adalah barang yaitu sapi. Hal ini sudah sesuai dengan salah satu syarat modal muḍārabah yaitu dapat berbentuk uang atau barang yang dinilai (sapi termasuk di dalamnya). Pada waktu akhir pembagian hasil dapat dibedakan dari keuntungan. Dimana modal sapi tetap menjadi hak pemilik modal, selanjutnya hasil penggemukan dan pengembangbiakan yang dibagihasilkan. Ketentuan keuntungan yang dilakukan masyarakat Desa Tanjung Kulon telah sesuai dengan kaidah al-ghunmu bi al-ghurmi. Hasil penelitian ini juga menegaskan bahwa tidak ditemukan akad yang mengandung gharār dalam praktik “gaduh sapi” disana.

Abstract

The purpose of this research is to describe the spirituality of rural Muslim communities through the routine activities of Jam’iyyah Nahdlatul Ulama from Ngemplak Simongan NU Sub-District. This research is a field research (qualitative) which elaborated phenomenology approach that uses observation, interviews, and documentation as a method of collecting data, which is also equipped with a library research. The research shows that the spirituality of the Muslim community and the Jam’iyyah NU, Ngemplak Simongan Village is also still very much carrying the spirit of local wisdom based on Islamic values to this day. They also still carry out Javanese religious rituals, such as routine recitation activities, tahlil, yasinan, diba’, istighāstah, manāqib, and ziyārah Walisongo, because they believe that basically all of these rituals are part of Islamic teachings and originated from Islamic teachings. Jam’iyyah NU Ngemplak Simongan can also be categorized as “Moderate Muslim” because they still uphold the values of locality in religion. Based on the results, it shows that Jam’iyyah NU, Ngemplak can be used as a miniature of NU moderation in suburban villages of Semarang City. Jam’iyyah NU, Ngemplak, which in fact is a sub-district in the metropolitan city of Semarang, Central Java, they often and routinely carry out Ahlussunnah wal Jama’ah An-Nahdliyyah (Aswaja NU) activities to maintain the spiritual spirit of rural Muslim communities.

Abstract

This research aims to explain the mu’alamah dropshipping system from an Islamic economic perspective. This study uses a literature or library research method which is sourced from authoritative data and sources, such as books and journals that are still relevant to the focus and discussion of this research. The results of the study concluded that allowing transactions that continue to develop in progress in the economy as long as they do not violate and do not contradict Islamic principles, dropshipping transactions which have now become a custom in society are allowed as long as the perpetrator understands the procedures for transactions, because the system is vulnerable and leads to the cancellation of a contract, namely selling goods that do not belong to him, and the development of technology greatly influenced the development of legal edicts that urged them to be issued. However, on many sides, with the legal norms that have been summarized by previous scholars by looking at the equality of legal ‘illat, it can be found that fast and precise legal answers can be found to determine the law in every legal event for which there is no clear legal provision in al- Qur'an and as-Sunnah.

Abstract

Kajian ini menjawab anggapan secara umum masyarakat bahwa perempuan dalam berbagai kajian diposisikan sebagai sosok yang lemah, demikian juga dalam keluarga, peran dan fungsinya kurang diperhatikan. Secara khusus penelitian ini mengkaji tentang pendangan Kiai tentang perempuan. Dengan model kualitatif dan studi lapangan kajian ini ingin menjawab bahwa kedudukan perempuan di bawah laki-laki tidak mutlak sebagaimana dalam literatur kitab-kitab fikih yang menjadi kajian Kiai dan diajarkan kepada santri-santrinya. Suami istri adalah orang yang bekerja sama untuk membangun kehidupan keluarga. Karena itu kehidupan keluarga tidak akan berjalan dengan baik tanpa peran bersama dari kedua pihak.

Abstract

The practice of Islamic inheritance law in Muslim communities in Indonesia experiences many obstacles. One of the reasons is that there is still a tradition of distribution of assets when parents are still alive and the prevailing kinship system. It was found in transferring property to the coastal santri community in Pekalongan City. This paper reveals the method of dividing the prospective inheritance of the coastal santri community and the mechanism for resolving disputes in the event of a dispute. This article uses a qualitative socio-legal studies approach and is descriptive and analytic. This article finds two things. First, the model for distributing the assets of the coastal santri community in Pekalongan City is carried out using grants orally and deliberation for consensus. Prospective inheritance is divided by the grant system equally, without distinguishing between men and women. The dispute resolution mechanism is carried out in negotiation and mediation.

Abstract

This research is motivated by the idea that commodification is a process of changing the value of a product which previously only had a use value and then becomes an exchange value where the demand for the product is determined by the price, designed by the manufacturer. The formulation of the research problem is how to commodify the religion of siwak products through halal labels and how to analyze media and advertisements related to the religious commodification of siwak products. The research method is library research. The results showed that currently siwak has turned into toothpaste. Toothpaste has become one of the people's daily needs. The habit of brushing teeth has existed since ancient times and people prefer to use siwak wood. Currently there are several toothpaste products that offer halal products, which contain the siwak content taught by the Prophet Muhammad and have a halal certificate from Indonesian Ulama Council. From the realm of media, technological, media and economic developments play an important role in the religious commodification. This is also one way of advertising by playing with the psychology of viewers by choosing halal products, it will show high faith.
