Abstract

Purchasing motorbikes on credit involves third parties, namely consumer finance as financing lenders (creditors), while the party receiving the financing loan is called the debtor. The parties who bind themselves in the fiduciary guarantee deed under the hand do not have legal certainty for the parties, it is different from the fiduciary guarantee deed based on Law Number 42 of 1999 concerning Fiduciary Guarantees that have legal certainty. Fiduciary guarantees are guarantees for rights to movable or immovable objects other than land and buildings which are not included in mortgage rights. Through normative juridical research, research has been produced that the legal consequences of a fiduciary guarantee deed made privately are the frequent executions of unilateral interests, namely the creditor when there is a breach of contract made by the debtor. It is urgent to make a fiduciary guarantee deed which is notarized and registered at the fiduciary guarantee registration office to obtain a fiduciary certificate that has legal force.

Abstract

Penelitian ini memiliki tujuan untuk menganalisis pembatalan akta pemberian hak tanggungan dan perlindungan hukum pada kreditur. Penelitian ini menggunakan penelitian Doktrinal yang bersumber pada undang-undang atau peraturan hukum yang berlaku. Berdasarkan hasil dari penelitian dapat disimpulkan bahwa Pembatalan Sertifikat Hak Tanggungan di Pengadilan dengan pencoretan catatan sertifikat hak tanggungan pada buku hak atas tanah oleh Kantor Pertanahan, serta ditarik dan bersama-sama buku tanah hak tanggungan tersebut dinyatakan tidak berlaku lagi. Tidak hanya berakibat pada pencoretan catatan sertifikat hak tanggungan pada buku tanah hak atas tanah oleh Kantor Pertanahan, pembatalan ini berakibat secara langsung terhadap kreditor. menyebabkan kreditur tidak lagi memiliki hak jaminan yang kuat untuk memberikan kepastian hukum akan dilunasinya piutang yang ia salurkan kepada debitor. This study aims to analyze the cancellation of the deed of mortgage rights and legal protection for creditors. This study uses doctrinal research that originates from applicable laws or legal regulations. Based on the results of the research, it can be concluded that the cancellation of the mortgage certificate in court by crossing out the mortgage certificate record on the land title book by the Land Office, and withdrawing it and together with the mortgage land book is declared no longer valid. This does not only result in the abolition of the mortgage certificate record in the land book of land rights by the Land Office, this cancellation has a direct impact on creditors. causing the creditor to no longer have strong collateral rights to provide legal certainty that the receivables distributed to the debtor will be paid.
