Abstract

This research aims to find out the views of the scholars about the ijtihad of the Prophets in the book of Ijtihad al-Rasul SAW by Abdul Jalil Isa and to find out the description of the actions of the Prophet Muhammad which was considered ijtihad. The type of research is used by qualitative research. The data obtained were clarified and analyzed according to the topic of discussion. From the results of the data collection and analysis can be concluded that are: 1) The Preception of the scholars about ijtihad of the Prophets in the book of Ijtihad al-Rasul SAW are divided into three. Firstly, Abu Ali al-Juba'i argued that the Prophet did not carry out jihad, both in legal matters (sharia) and worldly affairs in. Secondly, Ibn Hazm, Ibn Taymiyyah and Kamal al-Hummam argued that the Prophet had jihad, both in the affairs of the Shariah and world affairs in. Thirdly, Qadhi Iyadh and Ibn Khaldun argued that the Prophet did not carry out jihad in the Shari'ah region, the Prophet only had jihad the in area of world affairs. This difference of opinions are based on the third approach in concluding the Prophet's ijtihad; 2) The act of the Prophet Muhammad SAW which was considered ijtihad in the book of Ijtihad al-Rasul SAW was that there were two, namely: The first, the act which turned out to be wrong then by the Shari was straightened out, and secondly, his decision was not followed by his friend.

Abstract

The occurrence of a marriage based on the consent of the child is a marriage requirement by the compilation of Islamic law article 16 paragraphs 1 and 2 that marriage is based on the consent of the prospective bride and groom, and the form of consent of the prospective bride can be in the form of a firm and real statement in writing, verbally, or with gestures and also by acting. silence as a sign of no objection to the marriage process. As explained in article 98 paragraph 1 of the compilation of Islamic law, "the age limit for a child who can stand alone or be an adult is 21 years", as long as the child is not physically or mentally disabled or has never been married. Library research is a study that studies various reference books and the results of similar previous research which is useful for obtaining a theoretical basis regarding the problem being studied. Based on a review of the literature, it can be explained that parents forcing their children aged 21 years to marry is not permissible based on Article 98 paragraph 1 of the compilation of Islamic law, but it is permissible for children under 21 years of age. In this research, it can be recommended that several factors are behind parents often forcing their children into marriage, namely, local traditions, the desire of parents in the form of responsibility, and on the basis of an antipathetic understanding of one of the concepts of the Imam Madzhab.

Abstract

Penelitian mengenai kegiatan usaha kerajinan Sapu lidi yang dijalankan oleh masyarakat Desa Sumberanyar Dusun Bindung telah memberikan dampak peningkatan/pendapatan terhadap perekononiam masyarakat dalam rumah tangga mereka, tergambar dengan terpenuhinya kebutuhan keluarga sampai dengan terbukanya lapangan pekerjaan bagi masyarakat setempat. Prespektif ekonomi islam tentang usaha sapu lidi adalah tidak melanggar terhadap aturan Syariat Islam, hal ini dapat digambarkan mulai dari proses pengumpulan bahan baku sapu lidi yang tidak merusak alam sekitar, sampai pada transaksi penjualan menggunakan sistem/mekanisme pemesanan yang sesuai dengan bahan pembuatan sapu lidi, sehingga diperoleh dengan cara yang baik dan halal.
