Eka Mardianingsih, Fakultas Syariah dan Hukum UIN Sunan Kalijaga Yogyakarta ekamardianingsih92@gmail.com, ABSTRACT This article discusses long-distance marriage contracts using the MUI fatwa study from the maqasid sharia perspective. Marriage contracts are generally carried out in close proximity, not remotely, but in this paper we will discuss long-distance marriage contracts with a focus on MUI fatwas using literature. The findings in this study are that a marriage contract is said to be valid if the pillars and conditions of marriage are met and cannot be reduced in any way. What is meant by the unification of the "ittihad al-majlis" contract assembly is that the consent and acceptance must be carried out within the time interval contained in one marriage contract ceremony, without interrupting other activities. Thus, if there is no unity between the assembly for pronouncing consent and the assembly for pronouncing consent, or a break between the assembly for pronouncing consent and the assembly for pronouncing consent, then the marriage contract is considered invalid. Clearly successive and not intermittent is another word for the unification of the assembly of the contract "ittihad al-majelis. Keywords: marriage ceremony, long distance, MUI, maqasid al-shariah

Abstract

Abstract Indonesia itself in the context of children outside of marriage means lineage and civil relations with the mother, but it can be with the father if this can be properly and properly proven. Whereas in Malaysia, as the author quotes about the Malaysian Fatwa Council, children born out of wedlock (level children in the Malaysian language) also cannot be assigned to their fathers. This has an impact on also not being able to inherit from each other. Whereas in Tunisia an illegitimate child is assigned to his biological father but does not inherit from each other. Meanwhile, in the context of trusteeship, it can be concluded that a trustee can give approval and may disagree. Keyword: lineage, guardianship, Muslim state Abstrak Indonesia sendiri dalam konteks anak di luar perkawinan maka nasab dan hubungan perdata kepada ibunya, akan tetapi bisa kepada ayahnya jika bisa dibuktikan secara layak dan patut. Sedangkan di Malaysia sebagaimana yang penulis kutip tentang Majelis Fatwa Malaysia maka anak hasil dari pernikahan di luar perkawinan (anak taraf dalam bahasa Malaysia) juga tidak bisa dinasabkan kepada ayahnya. Hal ini berdampak kepada juga tidak bisa saling mewarisi. Sedangkan di Tunisia anak yang tidak sah dinasabkan kepada ayah biologisnya akan tetapi tidak saling mewarisi. Sedangkan dalam konteks perwalian maka dapat disimpulkan bahwa seorang wali dapat memberikan persetujuan dan bisa tidak mensetujui. Kata Kunci: nasab, perwalian, Negara Muslim
