Abstract

This research aims to describe the contributions of zakat, infak, s}adaqah and wakaf (Islamic philanthropy)toward the civil society movements in Indonesia and the problems surrounding it. This studyraised the case of Yayasan Solopeduli Surakarta, an Islamic philanthropy management agencies. Thisresearch uses the socilogical approache of law. The primary data sources are administrators and managers,and agency activities organized by the Yayasan Solopeduli Surakarta. Secondary data are relevantpapers, brochures and dictionaries. Data were collected by interview and observation and documentation.Data analysis was performed with a fixed ratio (constant comparative method) which includes datareduction, categorization and synthesization, as well as the formulation of an answer. In the analysisprocess, the data are associated with theories of civil society.The findings of this research show thatzakat, infak, s}adaqah and wakaf managed by Yayasan Solopeduli Surakarta contributes to the formationof the pillar of civil society and the enforcement of civil society values. Firsly the charity value asshowed by existence of the agency that always builds the care spirit of the haves for the poor, as well asby most its programs that offer free service concept, in the field of education, health, and other publicservice. Secondly, the independence value, especially from the aid of the government. The impact is, thatthe agency moves freely by itself paradigm. Thirdly juctice value as showed by the most programs thatsupport the poor society. However, actually the agency is far from, but doesn’t recognize the civil societydiscourse as seen by the west. That is why, it doesn’t go along with the contemporery issue of civil society,such as democracy and gender equality. The interpretation of mustahiq surrounds the classic one.

Abstract

AbstractThis research is intended to describe the relationship between religion and State in handling the Halal products certification in Indonesia and Thailand. Halal certification in Indonesia was initially civil society movement that supported by the state, which is taken by LPPOM MUI.  The main objective was to protect Muslim from Haram products.  However, by coming out of law no. 33 2014 about halal product guarantee, the halal certification will be carried out by the state institution, that is Security Agency Halal Products known as BPJPH. While in Thailand, Halal product certification is the authority of Central Islamic Council of Thailand (CICOT) which is similar to the Indonesian Ulema Council (MUI). In Thailand, Halal product certification has much giving supports to the government economic, especially for the purpose of exporting food to the Muslim countries and also to attract Muslim tourist to visit Thailand. Keywords: Religion, Country, Halal Certification  AbstrakPenelitian ini dimaksudkan untuk mendeskripsikan hubungan antara agama dan negara dalam penanganan sertifikasi produk halal di Indonesia dan Thailand. Indonesia pada awalnya sertifikasi halal merupakan gerakan civil society yang didukung negara, yaitu LPPOM MUI. Tujuan utamanya adalah melindungi umat islam dari barang-barang haram. Namun dengan keluarnya Undang-undang Nomor 33 Tahun 2014 Tentang Jaminan Produk Halal, penanganan sertifikasi halal akan dilakukan oleh lembaga negara, yaitu Badan penyelenggara Jaminan Produk Halal (BPJPH).  Sedangkan di Thailand sertifiksi halal menjadi wewenang penuh Central Islamic Council Of Thailand (CICOT), semacam MUI di Indonesia. Di Thailand sertifikasi produk halal sangat membantu negara di sektor ekonomi, terutama untuk kepentingan ekspor makanan ke negara-negara muslim serta menarik wisatawan muslim ke Thailand. Kata Kunci: Agama, negara, sertifikasi halal

Abstract

Tulisan ini merupakan studi terhadap persoalan pendistribusian hasil/manfaat pengelolaan wakaf dalam UU No 41 Tahun 2004 tentang Wakaf. Pendekatan yang dipakai adalah yuridis. Sifatnya deskriptif dan preskriptif. Namun aturan tersebut masih menimbulkan beberapa masalah, antara lain adanya kerancuan antara wakaf produktif dan wakaf konsumtif, kurang jelasnya status wakaf hasil pengembangan dan besarnya yang digunakan untuk pengembangan serta lemahnya keberpihakan kepada kaum dhuafa. Oleh sebab itu perlu ada perubahan aturan untuk menghindari hal-hal tersebut. Perubahan itu antara lain adalah adanya aturan yang membedakan antara wakaf konsumtif dan wakaf produktif, adanya aturan tentang status wakaf hasil pengembangan dan pemisahan aturan antara peruntukan dalam arti penggunaan harta benda wakaf dengan peruntukan dalam arti pendistribusian hasil/manfaat wakaf.

Abstract

Abstract Research on the Ijtihad of the Indonesian Islamic Da'wah Institute (LDII) marriages of Islamic Society in the perspective of maslahah mursalah. This study aims to answer questions about. First, how is the LDII marriage ijtihad. Second, what is the perspective of maslahah mursalah towards ijtihad. The purpose of this research is to make LDII members more open by using the fiqh books of ulama' as references. In order to be able to interpret the verses in the text are more general. Because the purpose of Islam is for the benefit of the people, and if the ijtihad is neither prohibited nor recommended in the text, then maslahah mursalah can be used in reviewing a law. The data for this study were obtained based on related books and the LDII of Tegalmulyo Hamlet, Polan Village, Polanharjo District, Klaten Regency as supporting data that became the object of research. The data collection technique in this study used descriptive analytical techniques with a deductive mindset. In this case, the theory of maslahah is analyzed to general data, in this case the marriage ijtihad of the Indonesian Islamic Da'wah Institute (LDII) in the perspective of maslahah mursalah. The results of the research show that LDII ijtihad in marital affairs is their own fellow mass organization, with the manqūl theory as the basis. This is evidenced by the existence of a marriage team within LDII to take care of marriage, as a form of realizing the ideals of LDII marriage, which is to navigate the ark of an eternal and happy household. Keywords: Ijtihad; LDII; Maslahah Mursalah.   Abstrak Penelitian ini mengenai ijtihad Lembaga Dakwah Islam Indonesia tentang perkawinan lintas organisasi masyarakat Islam dalam perspektif maslahah mursalah. Penelitian ini bertujuan untuk menjawab pertanyaan mengenai. Pertama, bagaimana adanya ijtihad perkawinan LDII tersebut. Kedua, bagaimana perspektif maslahah mursalah terhadap ijtihad tersebut. Tujuan dari penelitian ini yaitu agar anggota LDII lebih terbuka dengan menggunakan kitab-kitab fiqh ulama' sebagai rujukan. Agar dapat menafsirkan ayat-ayat dalam nas lebih bersifat umum. Karena tujuan agama Islam adalah untuk kemaslahatan umat, dan apabila ijtihad tersebut tidak ada larangan maupun yang menganjurkan dalam nas maka maslahah mursalah dapat digunakan dalam mengkaji suatu hukum. Data penelitian ini diperoleh berdasarkan buku-buku terkait dan LDII Dukuh Tegalmulyo, Desa Polan, Kecamatan Polanharjo, Kabupaten Klaten sebagai pendukung data yang menjadi objek penelitian. Teknik pengumpulan data penelitian ini menggunakan teknik deskriptif analitik dengan pola pikir deduktif. Dalam hal ini kemudian teori maslahah dianalisis kepada data yang bersifat umum, dalam hal ini ialah ijtihad perkawinan lembaga Dakwah Islam Indonesia (LDII) dalam pespektif maslahah mursalah. Hasil dari penelitian menunjukkan bahwa ijtihad LDII dalam urusan perkawinan adalah sesama ormas mereka sendiri, dengan teori manqūl sebagai landasannya. Hal ini dibuktikan dengan adanya tim perkawinan yang ada di dalam LDII untuk mengurusi perkawinan, sebagai bentuk agar terwujudnya cita-cita perkawinan LDII, yaitu mengarungi bahtera rumah tangga yang kekal dan bahagia.
