Abstract

This research has the purpose to find out the default contract regulation in the loan agreement based on Indonesia's positive law, and find out the judge’s legal consideration when given the decision in the case court Number 10/PDT.G.S/2019/PN.SMR. The research method of this research is normative legal research which uses the conceptual approach, the statute approach, and the case approach, this research uses qualitative analysis. The result of this study showed that the default in contract regulation especially in the loan agreement has regulated in Article 1313 Indonesia Civil Code about the contract, Article 1754 Indonesia Civil Code about loan agreement, and especially Article 1265 Indonesia Civil Code about null and void the agreement. Furthermore, the judge’s legal consideration when deciding the case in the court decision Number 10/PDT.G.S/2019/PN.SMR stated the defendant has default in contract based on the claim in the court, and the evidence in the court process such as a statement letter on July 26, 2019. This is a new deal or agreement between the plaintiff with the defendant which exists as the principle of consensually vide (Article 1320 Indonesia Civil Code), this agreement is like legislation for the parties (article 1338 Indonesia civil Code). This is a type of novation/ restructuring that regulated in Article 1413 paragraph 1 Indonesia Civil Code. Because of this, the agreement on this case is the letter of statement on 26 July 2019.

Abstract

Keberadaan media sosial telah mengubah bagaimana akses terhadap teknologi digital berjaringan. Untuk menghadapi perkembangan ilmu pengetahuan dan teknologi yang semakin canggih dan arus globalisasi yang semakin hebat. Motivasi belajar serta Pemanfaatan Jejaring sosial seperti Telegram,Instagram,Whatsapp serta Youtube telah menjadi tren di kalangan remaja, oleh karenanya media tersebut dapat digunakan sebagai alternatif media pembelajaran. Penelitian ini bertujuan untuk mengetahui penggunaan media sosial sebagai media bantu pembelajaran pendidikan agama islam, dan mengetahui motivasi belajar siswa dengan menggunakan jejaring sosial sebagai media bantu pembelajaran pendidikan agama Islam. Penelitian menggunakan pendekatan kualitatif dengan jenis studi kasus. Penggunaan studi kasus dimaksudkan untuk mengetahui bagaimana pemanfaatan media sosial sebagai media yang efektif untuk meningkatkan motivasi dan hasil belajar siswa. Data diperoleh melalui wawancara, observasi dan dokumentasi. Hasil tersebut dianalisis menggunakan tiga langkah: reduksi, display, dan verifikasi. Hasil penelitian menunjukkan bahwa desain pembelajaran PAI dapat memanfaatkan media sosial melalui penggunaan strategi pembelajaran terpadu, yaitu dengan menggabungkan pembelajaran tatap muka di kelas dan memanfaatkan media sosial sebagai pembelajaran di luar kelas,dilakukan dengan memanfaatkan fitur Group, dengan langkah-langkah: (1) Membuat akun media sosial untuk kelas eksperimen; (2) Menambahkan siswa ke dalam group; (3) Mengunggah file; dan (4) Melakukan diskusi.

Abstract

This study aims to explore the use of image media in improving the quality of student learning outcomes at Tadika Al Fikh Orchard Bandar Parkland Selangor Malaysia. In the context of education, image media is expected to increase students' interest and understanding of the material being taught. The method used in this study is a qualitative approach with data collection techniques through observation, interviews, and documentation. The results show that the use of image media can strengthen the attractiveness of learning, increase student engagement, and facilitate understanding of basic concepts. In addition, the interaction between teachers and students also increases, creating a more dynamic learning atmosphere. Thus, this study concludes that image media is an effective tool in improving the quality of student learning outcomes at Al Fikh Kindergarten, as well as providing recommendations for wider application in the learning process in educational institutions.  Penelitian ini bertujuan mengeksplorasi penggunaan media gambar dalam peningkatan kualitas hasil belajar siswa di Tadika Al Fikh Orchard Bandar Parkland Selangor Malaysia. Dalam konteks pendidikan, media gambar dapat meningkatkan minat dan pemahaman siswa terhadap materi yang diajarkan. Metode yang digunakan dalam artikel ini adalah pendekatan kualitatif dengan teknik pengumpulan data melalui observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa penggunaan media gambar dapat memperkuat daya tarik pembelajaran, meningkatkan keterlibatan siswa, serta memfasilitasi pemahaman konsep-konsep dasar. Selain itu, interaksi antara pengajar dan siswa meningkat dan menciptakan suasana belajar yang lebih dinamis. Dengan demikian, artikel ini menyimpulkan bahwa media gambar merupakan alat yang efektif dalam meningkatkan kualitas hasil belajar siswa di Tadika Al Fikh, serta memberikan rekomendasi untuk penerapan yang lebih luas dalam proses pembelajaran di lembaga pendidikan. Abstract

The Gumarang Akbar Syariah Mataram Savings and Loans Cooperative (KSPPS) is an institution that manages zakat and waqf funds for the welfare of the people. This study aims to determine the process of cash waqf management and to determine the effectiveness of cash waqf management at KSPPS Gumarang Akbar Syariah Mataram. The type of research used is qualitative with a descriptive approach and the data collection techniques used are observation, interviews and documentation. The results of this study indicate that the waqf implemented by KSPPS Gumarang Akbar Syariah Mataram is in the form of cash waqf. In collecting waqf funds, the proceeds from collecting waqf money are used for empowerment/economic welfare of the people and for social-religious activities. And the management of cash waqf carried out by KSPPS Gumarang Akbar Syariah Mataram has not been implemented effectively because the funds managed are still very minimal. And if seen from the regulations BWI Regulation Number 1 of 2009 concerning guidelines for the management and development of movable waqf assets in the form of money, they are still carried out in a simple manner or have not been implemented in accordance with these guidelines.
