Abstract

AbstractThis article examines prostitution as a social deviation that is closely related to morality. This study aims to describe the prostitution deviation based on the types, in order to perform law enforcement reconstruction based on the viewpoint of community behavior, so that it will find the effect, impact and size of the morality of the prostitutes in Lampung Province. Using a socio-legal approach and direct observation methods, this study seeks to understand the law more than its normative aspect, but also looks at the social aspects that surround the law and dynamically communicate with the law. The results indicate that the practice of prostitution develops in accordance with the development of society. Prostitution in developed economies (Bandar Lampung and Metro) is offered in a more diverse pattern and utilizes technology and social media, as compared to the practice of prostitution in the developing economies (Lampung Timur) carried out in a conventional pattern. In terms of the etiology of deviation, prostitution arises because of individual and systemic factors.  AbstrakArtikel ini mengkaji tentang prostitusi sebagai deviasi sosial yang terkait erat dengan moralitas. Kajian ini bertujuan memaparkan deviasi prostitusi berdasarkan tipe-tipenya, agar dapat melakukan rekonstruksi penegakan hukum yang berbasis pada sudut pandang perilaku masyarakat, sehingga akan menemukan akibat, dampak dan ukuran moralitas pelaku prostitusi di Provinsi Lampung. Memanfaatkan pendekatan sosio legal dan metode observasi langsung, kajian ini berupaya memahami hukum lebih dari aspek normatifnya, namun juga melihat aspek social yang berada di sekitar hukum dan secara dinamis berdialektika dengan hukum tersebut. Hasil kajian ini menunjukkan bahwa praktik prostitusi berkembang sesuai dengan perkembangan masyarakat. Prostitusi di daerah ekonomi maju (Bandar Lampung dan Metro) ditawarkan dalam pola yang lebih beragam dan memanfaatkan teknologi dan media social, bila dibandingkan dengan praktik prostitusi pada daerah ekonomi berkembang (Lampung Timur) yang dilakukan dengan pola konvensional. Dari sisi etiologi deviasi, prostitusi muncul karena factor individual dan sistemik.

Abstract

This article examines the problems and new directions of the reform of the Compilation of Islamic Law (KHI) towards the codification of the Islamic Family Law Law. KHI nevertheless has problems, the absence of a formal legislative process and a textualistic fiqh approach make the norms in the KHI less responsive to issues such as justice, equality and the social dynamics of Indonesian Muslim society. This article aims to identify the normative and legal roots of the KHI, as well as the legal political strategies that can be used to transform it into an Islamic Family Law Act in the national legal system. This research is a literature study with a historical and doctrinal approach, using Mahfud MD legal political theory and Jasser Auda maqāṣid al-syari’ah. The first finding shows that the legal position of the KHI is weak because it does not have a legitimate legislative basis in the post-reform national legal system, and its substance reflects a patriarchal construction that is not in line with constitutional values. The second finding shows that the renewal requires a legal political strategy that is transformational, multidisciplinary and participatory, therefore that the resulting Islamic family law is not only legally-formally valid, owever also socially legitimate and substantively just.
