Haryono No. 169 Malang e-mail: Jeremydwi69@gmail.com ABSTRAK Penelitian ini bertujuan untuk mengetahui bentuk perlindungan perlindungan hak cipta konten digital di media sosial terhadap pelanggaran hak cipta dan untuk mengetahui pelaksanaan upaya pencegahan atas pelanggaran hak cipta di media sosial oleh Direktorat Jenderal Kekayaan Intelektual Kementerian Hukum dan Hak Asasi Manusia sebagaimana yang diamanatkan oleh Pasal 54 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Adapun jenis penelitian ini adalah sosio legal dengan metode pendekatan yuridis sosiologis. Jenis data primer dan sekunder yang diperoleh penulis dan akan dianalisis dengan metode deskriptif analitis disertai dengan wawancara dengan beberapa instansi terkait. Berdasarkan hasil penelitian ini maka dapat diketahui bahwa Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta telah memberikan perlindungan hak cipta dalam bentuk preventif dan represif untuk mencegah terjadinya pelanggaran hak cipta, tetapi masih terdapat beberapa jenis konten yang masih belum dilindungi secara eksplisit dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Sedangkan Direktorat Jenderal Kekayaan Intelektual Kementerian Hukum dan Hak Asasi Manusia sudah melakukan upaya penanganan pelanggaran hak cipta namun masih belum mempunyai divisi khusus yang bekerja untuk mengawasi pembuatan dan penyebarluasan konten pelanggaran hak cipta sehingga sampai saat ini tugas yang diamanatkan Pasal 54 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta belum bisa terlaksana. Kata Kunci: Pelaksanaan, Pengawasan, Perlindungan, Pelanggaran, Hak Cipta ABSTRACT This research aims to find out how the protection of copyright of digital contents on social media is given regarding the violations of copyright and to find out the preventive measures to tackle the violations of the copyright on social media taken by the Directorate General of Intellectual Property of the Ministry of Law and Human Rights as governed in Article 54 of Law Number 28 of 2014 concerning Copyright. This research referred to socio-legal methods and socio-juridical approaches. Primary and secondary data were analyzed using descriptive analysis methods. Interviews with several related agencies also took place. The research results reveal that Law Number 28 of 2014 concerning Copyright provides protection of copyright in both preventive and repressive actions to prevent violations of copyright. However, several contents are left unprotected in this law. The Directorate General of Intellectual Property of the Ministry of Law and Human Rights has taken some measures to handle the violations but without special divisions assigned to supervise the creation and dissemination of the contents.
