Abstract

This study aims to understand and analyze the implementation of Illegal Drilling in Oil and Gas mining in Indonesia as well as to understand and analyze the role of Village Unit Cooperatives to prevent Illegal Drilling in Oil and Gas mining in Indonesia in order to achieve the welfare of rural communities. This law is a type of prescriptive normative legal research using a statute approach. The types of legal materials used are primary legal materials and secondary legal materials. The technique of collecting legal materials that support and relate to the presentation of this research is document study (library study). Document study is a tool for collecting legal materials through written legal materials using content analysis. The results of this study indicate that the role of KUD itself is still not able to prevent illegal drilling, there are still activities that harm the community, which is contrary to the Law of the Republic of Indonesia Number 22 of 2001 concerning Oil and Gas such as management without a permit so that it is included in illegal management. , this illegal drilling activity violates the rules of Law No. 22 of 2001 concerning Oil and Gas which has been set by the government. The state also suffers losses because petroleum is one of the assets of the state and also damages the environment in the vicinity of illegal drilling activities. It is difficult for the government to control the mining of old oil wells or illegal drilling because it has become the livelihood of the community, but it was found that the hope that the exploitation of old wells can contribute to Regional Original Income (PAD) is increasingly far from reality. Likewise, the purpose of community empowerment cannot be carried out properly.

Abstract

 This article aims to find out the Implementation of implementation of the Spatial Plan for the Borobudur Cultural Conservation Area in Magelang Regency along prescriptive normative legal research. Secondary data sources include primary, secondary and tertiary legal materials. The data collection technique used is literature study and several legal facts as the basis for determining conclusions or conclusions. Furthermore, the technical analysis used is the deductive method. Based on the results of the research, it can be concluded that the government as the holder of the control of assets of borobudur temple area has controlled utilization and preservation by conducting legal politics. There is fundamental changes in the scope of roles and functions, policy and strategy of structuring, planning, managing, controlling the utilization of spatial areas of Borobudur cultural heritage by the Central Government, Local Government together with community participation as partners / concession holders (granting rights, permits, or land by the government, to state-owned enterprises, BUMD, companies, individuals, or other legal entities). The obstacles faced in the implementation of the Borobudur Spatial Plan in Magelang District are the determination of the status of cultural heritage areas that are not yet clear, the planning of incomplete management of the area, the determination of zoning that does not protect the entire assets of the region, and the conflict of utilization and management. Alternative problem solving can be achieved by establishing the status of cultural heritage areas effectively and efficiently, integrated and sustainable conservation planning, zoning determination should start from the site, determination of management forms that match the characteristics of the region, and the determination of superior functions and development of cooperation between regions. AbstrakArtikel ini bertujuan untuk mengetahui Pelaksanaan Rencana Tata Ruang Kawasan Cagar Budaya Borobudur di Kabupaten Magelang beserta kendala dan solusinya. Jenis penelitian yang digunakan penulis adalah normatif bersifat preskriptif. Sumber data sekunder meliputi bahan hukum primer, sekunder dan tersier. Teknik pengumpulan data yang digunakan adalah studi kepustakaan dan beberapa fakta hukum   sebagai dasar penentu memperoleh kesimpulan atau konklusi, teknis analisis yang digunakan adalah metode deduktif. Berdasarkan hasil penelitian, dapat disimpulkan bahwa pemerintah selaku pemegang penguasaan aset kawasan candi Borobudur telah melakukan pengendalian pemanfaatan dan pelestarian dengan melakukan politik hukum. Terdapat perubahan mendasar dalam pengaturan ruang lingkup peran dan fungsi, kebijakan dan strategi penataan, perencanaan, pengelolaan, pengendalian pemanfaatan tata ruang kawasan cagar budaya Borobudur oleh Pemerintah Pusat, Pemerintah Daerah bersama partisipasi masyarakat sebagai mitra kerja /pemegang Konsesi ( pemberian hak, izin, atau tanah oleh pemerintah, kepada  BUMN, BUMD, perusahaan, individu, atau entitas legal lain). Kendala yang dihadapi dalam pelaksanaan Rencana Tata Ruang Kawasan Borobudur di Kabupaten Magelang adalah penetapan status kawasan cagar budaya yang belum jelas, perencanaan pengelolaan kawasan yang tidak tuntas, penetapan zonasi yang kurang melindungi keseluruhan aset kawasan, dan konflik pemanfaatan serta pengelolaan. Alternatif penyelesaian permasalahan dapat ditempuh dengan cara menetapkan status kawasan cagar budaya secara efektif dan efisien, perencanaan pelestarian secara terintegrasi dan berkesinambungan, penetapan zonasi seharusnya dimulai dari situs, penetapan bentuk pengelolaan yang sesuai karakteristik kawasan, dan penetapan fungsi unggulan dan pengembangan kerjasama antar kawasan.

Abstract

This study aims to reveal and analyze the implementation of supervision of billboard organizers in Semarang City by the Spatial Planning Office of Semarang City and analyze the efforts made by the Government of Semarang City in order to improve order in Semarang City. The type of research conducted by the author is empirical legal writing. The results of field data and interviews, the implementation of supervision of the implementation of billboards in the City of Semarang by the Spatial Planning Service is not perfect from its implementation in the field based on Regional Regulation Number 4 of 2019 concerning Billboards, then seen from the obstacles in carrying out supervision of billboard organizers and view from the Semarang City environment , which resulted in delays in the implementation of the supervision, so that the implementation is not perfect.

Abstract

This legal research describes and examine two problems. First, how sosial service take action in put in order homeless and beggars according to government rules number 31 year 1980, about countermeasures homeless and beggars in Surakarta city in put in order homeless and beggars. Second, which hinders factors that made Surakarta Social Services (Dinas Sosial Surakarta) in put in order homeless and beggars. This research is normative legal research with prescriptive character and using statutes approach. Legal material primary source is the legislation rule and legal material secondary source are books, article journals, science article, and interviews. This research using silogisme methods with deductive mind patterns with collection technique materials are using study documents and interviews. The purpose from this research consists of two purpose which are subjective and objective. Based on the results of this study, it can be conclude that the role of the Surakarta Social Service in an effort to put in order homeless and beggars under government regulations number 31 year 1980 , is not yet working effectively. Due to the obstacle factors that affect the effectiveness of the role of the Surakarta City Social Service, namely the absence of a halfway house for homeless people and beggars in order to develop their personalities to be a  better person, so can reduce the number of beggars in the city of Surakarta. Lack of cooperation between agencies such as the Social Service and Satpol PP. In addition, there is no Surakarta City regulation regarding efforts and sanctions for homeless people and beggars.
