Abstract

This article describes the issue of codification of Islamic law in the development of modern legal theory. From the assessment results obtained by understanding some of the literature that was essentially the codification of Islamic law is the codification of the rules of fiqh and usul fiqh rules and the development of theories of Islamic law that is based on Islamic law epistimologi. Therefore, the pattern includes the codification of Islamic law; codification of the rules of fiqh which includes three phases, namely the development of a period of growth and formation, the development and codification and the maturity and refinement. While codification of usul al-fiqh includes not only the rules of jurisprudence but also related to the struggle of who the originator of usul al-fiqh as a mode of philosophical thought in epistimologi Islamic law. Birth of legal theories under Islamic law epistimologi Why refer to the style of traditional and rational thinking in Islamic law underlies epistimologi birth maqasid al-Shari'ah theory developed by Islamic jurists before the era and the era of al-Syātibi maqashid theory after al- Syātibi.

Abstract

Conflict and tension is by Noel James Coulson in Islamic jurisprudence that the law of God is always confronted with the process of human intellectual activity that tries to transform the law of God. Law is a system of commandments determined divinity. Rejecting the principle is basically leaving the faith in Islam. While the transformation of man-made law take its own shape in the system of rights and obligations. The validity of the theory is not appropriate because Coulson puts clerical dissent as a form of conflict and contradiction in the law of Islam, although in epistimologi Islamic law that is intended to understand and find the law is not to define or create it. In the social history of Islamic law distinction paradigms of legal thought, especially among ahl ra'yi and Ahl- Hadith is not something that reflects the nature of the conflict and discord among Islamic jurists but the difference is the difference in viewing epistimologi Islamic law

Abstract

This article studies the development of philosophical thought in Islamic jurisprudence. This study aims at tracing the origin and transformation of philosophical thought in Islamic world, and the influence of philosophical thought in the development of Islamic social law. This article demonstrates that the philosophical thought in Islamic law finds its fundamental bases in the Qur’an and hadits. These fundamental bases have then been developed by Islamic scholars in the philosophy of Islamic law.

Abstract

Abstract: Marriage is a constitutional right of Indonesian citizens, but not all marriages end in favour to women. From a legal and normative standpoint, this study examines how sirri and early marriage marginalize women. This article is library research. Datas were collected by conducting study of primary and secondary legal materials. The findings of this study demonstrate that sirri marriage is manifestly ineffective and contrary to the Indonesian Marriage Law. Women in sirri marriages do not have proper inheritance rights because sirri marriages are not recognized by state law, despite the fact that they are valid under religious law. In a similar vein, it appears that women's rights are not guaranteed in early marriage because couples in general lack the capacity and maturity to manage rights, obligations, and roles within the household; even early marriage appears to be "forced."Abstrak: Pernikahan merupakan hak konstitusional warga negara Indonesia. Akan tetapi, tidak semua pernikahan, baik praktik maupun aturan hukumnya menguntungkan bagi semua pihak, terutama bagi perempuan. Artikel ini mengkaji marginalisasi perempuan dalam kasus nikah sirri dan nikah dini dengan perspektif yuridis-normatif. Data-data dikumpulkan dari bahan hukum primer dan sekunder. Hasil dari penelitian ini menunjukkan bahwa pernikahan sirri jelas tidak efektif dan cukup menyimpang dari ketentuan Undang-undang Perkawinan Indonesia. Kaum perempuan dalam pernikahan sirri tidak diuntungkan dalam pembagian harta warisan karena pernikahan mereka tidak dikuatkan dengan akta nikah, walaupun pernikahan tersebut dinilai sah menurut hukum agama. Hal yang sama juga terjadi pada pernikahan dini karena hak-hak perempuan pada kenyataannya tidak terjamin. Hal ini disebabkan para pasangan dalam pernikahan dini, umumnya, belum memiliki kapasitas dan kedewasaan yang cukup dalam manajemen hak, kewajiban, dan peran dalam rumah tangga. Pernikahan dini bahkan terkesan sebagai pernikahan yang “dipaksakan”.
