Abstract

The aim of this study is to provide an overview of the gap between legal norms and reality in society, especially in the Kintamani Public Market. The research method used is a type of empirical legal research. The approach uses a statutory approach and a fact approach. The nature of this research is descriptive in nature. Sources of data used are primary data and secondary data. Primary data includes data obtained from interviews at the research location, while secondary data comes from legislation and literature, journals and internet media. The data analysis technique uses a qualitative descriptive analysis technique. The results of this study are the factors that cause children to become workers in the Kintamani Public Market, there are external factors and internal factors. External factors include economic factors, parents, and the environment. While the internal factor is the desire of the child himself to work. This desire originates from the boredom experienced by children when they stay at home, because if they stay at home, there is a lot of work to be done. Then, legal protection for child labor at the Kintamani Public Market is carried out with reference to the rights and obligations of child labour. However, the implementation of this legal protection has not been effective because it is still experiencing obstacles in the form of a lack of socialization from the Regional Government and the desire of traders to prioritize provide-oriented so that wages child labor can be suppressed and traders get the maximum profit.

Abstract

Penelitian ini bertujuan untuk memahami bentuk dugaan persaingan usaha tidak sehat yang dilakukan oleh Google serta dampak hukumnya terhadap pelaku usaha dan konsumen di Indonesia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus, menggunakan bahan hukum primer seperti Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dan Undang-Undang No. 5 Tahun 1999, serta bahan hukum sekunder berupa doktrin dan literatur hukum terkait. Hasil studi menunjukkan bahwa kebijakan GPB Google memenuhi unsur penyalahgunaan posisi dominan sebagaimana diatur dalam Pasal 25 ayat (1) UU Anti-Monopoli, karena memaksa pengembang aplikasi menggunakan sistem pembayaran internal Google dengan tarif tinggi, membatasi akses pesaing, dan menghambat inovasi pasar digital. Tindakan tersebut menimbulkan dampak negatif berupa berkurangnya pilihan konsumen, meningkatnya harga layanan digital, serta menurunnya daya saing pelaku usaha lain. Penelitian ini menegaskan perlunya pembaruan hukum persaingan usaha Indonesia agar adaptif terhadap praktik anti-kompetitif di era ekonomi digital. This study aims to understand the forms of alleged unfair business competition committed by Google and its legal implications for businesses and consumers in Indonesia. The research method used is normative legal research with a legislative and case approach, using primary legal materials such as the 1945 Constitution of the Republic of Indonesia and Law No. 5/1999, as well as secondary legal materials in the form of related legal doctrines and literature. The results of the study show that Google's GPB policy fulfills the elements of abuse of a dominant position as stipulated in Article 25(1) of the Anti-Monopoly Law, because it forces application developers to use Google's internal payment system with high rates, limits access to competitors, and hinders innovation in the digital market. These actions have negative impacts in the form of reduced consumer choice, increased prices for digital services, and decreased competitiveness of other business actors. This research emphasizes the need to update Indonesia's competition law to adapt to anti-competitive practices in the digital economy era.
