Abstract

Penelitian ini mengkaji tentang Pengaturan Perlindungan Hukum terhadap distributor terkait Wanprestasi. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum empiris dengan jenis pendekatan fakta yang disajikan secara deskripti. Berdasarkan latar belakang yang dibahas, adapun permasalahan pokok yang akan dikaji dalam penelitian ini 1)Bagaimana pengaturan perlindungan hukum terhadap distributor terkait reseller yang wanprestasi dan 2)Upaya yang dapat dilakukan distributor saat menghadapi kerugian yang disebabkan reseller yang wanprestasi. Berdasarkan hasil penelitian dapat disimpulkan bahwa 1)Perlindungan hukum terhadap distributor di Indonesia tercantum dalam beberapa peraturan perundang-undangan yaitu Peraturan Menteri Perdagangan Republik Indonesia Nomor 24 Tahun 2021 tentang “Perikatan Untuk Pendistribusian Barang oleh Distributor atau Agen, 2)Upaya yang dapat dilakukan distributor dalam menghadapi Reseller yang wanprestasi dengan menuntut pemenuhan perjanjian, pembatalan perjanjian atau meminta ganti kerugian kepada Reseller yang melakukan wanprestasi. Selain itu, langkah hukum sesuai undang-undang yang bisa diambil yang di atur dalam Pasal 1243 KUHPerdata.

Abstract

E-commerce is a process of buying and selling transactions which in practice are carried out online via electronic media. The buying and selling process no longer requires face-to-face meetings and the transaction process is carried out online. This has led to an increase in cases of online fraud. This research aims to determine the regulations and criminal responsibility for perpetrators of online buying and selling crimes. This paper uses a normative research method using a statutory approach, a conceptual approach. The results of this research show that regulations regarding criminal acts of fraud are generally regulated in Article 378 of the Criminal Code, and to strengthen the legal basis they can be accommodated through Article 28 paragraph (1) of the ITE Law. Criminal liability for perpetrators of online buying and selling fraud must fulfill the elements of each article, namely Article 378 of the Criminal Code and Article 28 paragraph (1) of the ITE Law and the imposition of responsibility in Article 28 paragraph (1) of the ITE Law which explains losses in the case of buying and selling. in the online world

Abstract

The authority of the police in handling cases of criminal acts of persecution committed by foreign nationals that go viral through social media is often a public discussion. The problem in this case is how the authority of the police in handling cases of criminal acts of persecution committed by foreign nationals that went viral on social media and the inhibiting factors in handling the case. This research was carried out in the jurisdiction of the South Kuta Police Chief. The type of research used is empirical law using legal system theory, law enforcement theory and authority theory. From the results of the research conducted in this case, the police often wait for complaints or reports first, because there are no reports or complaints that the perpetrators flee or hide, there is a lack of evidence obtained by the police. The police already have an online service to receive complaints from the public, making it easier for people to use their personal social media to participate in law enforcement in Indonesia.
