Haryono No. 169 Malang e-mail: wuisangjojo@gmail.com ABSTRAK Penelitian ini ditujukan untuk mengidentifikasi Implikasi Hukum dari Persetujuan antara Pemerintah Republik Indonesia dan Pemerintah Republik Singapura tentang penyesuaian batas antara FIR Jakarta dan Singapura serta untuk menganalisis proses pengesahan dari Persetujuan antara Pemerintah Republik Indonesia dan Pemerintah Republik Singapura tentang penyesuaian batas antara FIR Jakarta dan Singapura yang telah dilakukan menggunakan istrumen Peraturan Presiden Nomor 109 Tahun 2022. Adapun jenis penelitian ini adalah yuridis normative dengan menggunakan metode pendekatan Statuta, Pendekatan Kesejarahan, dan Pendekatan Konseptual. Jenis data primer dan sekunder yang diperoleh penulis telah dianalisis dengan metode deskriptif kualitatif. Berdasarkan hasil penelitian ini, dapat diketahui bahwa terdapat beberapa implikasi hukum setelah meratifikasi perjanjian penyesuaian batas FIR, yaitu bertambahnya luasan Total FIR Indonesia dan pendelegasian beberapa wilayah ruang udara Pemerintah Republik Indonesia kepada Pemerintah Republik Singapura. Serta dapat ditarik kesimpulan bahwa pengesahan perjanjian tersebut masih dianggap belum tepat, karena masih belum sesuai dengan amanat dari Pasal 458 Undang-Undang Nomor 1 Tahun 2009 tentang Penerbangan, serta tidak sesuai dengan Pasal 10 Undang-Undang Perjanjian Internasional yang diperkuat dengan Putusan Mahkamah Konstitusi Nomor 13/PUU-XVI/2018. Kata Kunci: Implikasi, perjanjian, pendelegasian, ruang udara, FIR Singapura ABSTRACT This research aims to identify the legal implication of the treaty between the Government of the Republic of Indonesia and the Government of the Republic of Singapore regarding the border adjustment between FIR Jakarta and Singapore and analyze the process of the validation of the treaty between both governments. This validation refers to Presidential regulation Number 109 of 2022. This research employed normative-juridical methods and historical and conceptual approaches. Both primary and secondary data were analyzed based on descriptive-qualitative methods. The research results reveal that this treaty between the two governments has added an area of 249,575 km2 of FIR Jakarta. The total area of FIR Jakarta was previously 2,593,150 km2. This area was extended in size by 245.575 km2. However, within the airspace area where adjustments have been made, there are several airspace areas whose air navigation should be delegated by the Government of the Republic of Indonesia to the Government of the Republic of Singapore. In this treaty, the Government of the Republic of Indonesia has been committed to setting coordination with the Government of the Republic of Singapore to provide appropriate navigation service, and guarantee the safety, order, and air traffic according to the regulation set by ICAO. The validation of the treaty between the two governments regarding the border adjustments of the FIR of both countries according to the ratification of the Government of the Republic of Indonesia is not yet appropriate since it refers to Article 10 of Law Number 24 of 2000 concerning International Treaties, elucidated by the Constitutional Court Decision Number 24 of 2000 concerning International Treaties.
