Abstract

Haryono No. 169 Malang e-mail: enjelinaputri99@student.ub.ac.id ABSTRAK Penelitian ini bertujuan mengidentifikasi dan menganalisis fenomena sosial kejahatan seksual perkosaan yang dapat menimbulkan kehamilan baik pada orang dewasa maupun pada anak. Perkosaan pada anak yang mengakibatkan kehamilan membuat anak menanggung beban fisik, moril, hingga psikologis untuk mengandung “seorang bayi” hasil tindak pidana perkosaan. Korban yang masih anak harus diperhatikan dan dijamin hak-haknya, anak sebagai korban merupakan tekanan yang berat apalagi jika harus ditambah mempertahankan bayi hasil tindak pidana. Korban berhak mendapatkan hak jaminan pelayanan kesehatan dan pengecualian aborsi. Aborsi dalam hukum di Indonesia terdapat dua ketentuan yakni dalam KUHP merupakan perbuatan yang dilarang namun dalam pasal 75 ayat (2) Undang-Undang Kesehatan terdapat dua pengecualian dapat dilakukannya aborsi dengan alasan kehamilan akibat perkosaan. Jenis metode penelitian adalah penelitian empiris, menggunakan pendekatan yuridis sosiologis. Lokasi penelitian yaitu di wilayah Kabupaten Jombang dengan memfokuskan pada Organisasi Perangkat Daerah (OPD) yaitu DPPKBPPPA (Dinas Pengendalian Penduduk Keluarga Berencana Pemberdayaan Perempuan dan Perlindungan Anak), Unit PPA Polres Jombang, Dinas Kesehatan dan WCC (Women’s Crisis Center) sebagai lembaga non pemerintah. Penelitian dilakukan di Jombang karena di wilayah ini terdapat kasus pengajuan aborsi legal oleh anak korban perkosaan. Penerapan pasal 75 ayat (2) Undang-Undang nomor 36 tahun 2009 tentang Kesehatan mengenai pengecualian aborsi bagi korban perkosaan tidak dilakukan dan diterapkan dengan baik di Kabupaten Jombang. Penerapan pasal 75 ayat (2) tidak terlaksana disebabkan oleh beberapa faktor dan hambatan. Antara lain faktor hukum, sarana dan prasarana, agama hingga budaya masyarakat dan kode etik kedokteran, yang dapat mempengaruhi efektivitas dari pelaksanaan hukum dari pasal 75 ayat (2). Terkait mekanisme juga ditemukan tidak sesuai dengan ketentuan pelaksana Peraturan Menteri Kesehatan Nomor 3 tahun 2016. Kata Kunci: Pelayanan Kesehatan, Aborsi, Korban Perkosaan, Anak ABSTRACT This research aims to identify and analyze the social phenomenon of sexual violence that involves rape and causes pregnancy in an adult or a child. Pregnancy in children due to rape will leave physical, moral, and psychological burdens. The rights of the child as a victim of rape should be guaranteed. Being a victim for a child will leave a particular burden, and this burden is worsened when the child concerned has to face the reality that she has to keep the baby. Such a young victim has the right to be assured of access to health services and abortion exemption. Abortion is governed in Penal Code that prohibits the action, but Article 75 paragraph (2) of Law concerning Health mentions two exemptions in abortion, where abortion is allowed if pregnancy is caused by rape. This research employed an empirical method and socio-juridical approaches. The research took place in the Regency of Jombang, focusing on the Agency of Population Control for Family Planning, Woman Empowerment and Child Protection (DPPKBPPPA) as an Organization of Local Instruments (OPD), Child Protection Unit of the Sub-Regional Police Department of Jombang, Health Agency, and Women’s Crisis Center (WCC) as an NGO. This research picked Jombang as the research site simply because there have been some cases of requesting legal abortion for children as the victims of rape in the area. Article 75 paragraph (2) of Law Number 36 of 2009 concerning Health related to the exemption in abortion for the victims of rape is not appropriately implemented in the Regency of Jombang due to several impeding factors such as law, infrastructure and facilities, religions, local culture, and medical ethics that could affect the effectiveness of the implementation of the law of Article 75 paragraph (2). Moreover, the mechanism found is not relevant to the provision of the implementation of the Regulation of the Minister of Health Number 3 of 2016. Abstract

The development of technology and information has had a significant impact on social changes in Indonesia. Rapidly growing digitalization makes communication and mobilization easier, but on the other hand, it also opens up opportunities for crimes in cyberspace, one of which is cybercrime in the field of decency, also known as Sexual Cybercrime. This phenomenon includes acts such as the distribution of pornography, verbal sexual harassment, child exploitation, and grooming for the purpose of sexual harassment. These crimes not only cause troubling social impacts but also pose a major challenge to law enforcement. In response to this phenomenon, the Indonesian government has adopted legal tools such as the Electronic Information and Transaction Law (ITE Law) and the Pornography Law to regulate and tackle crimes that occur in cyberspace. This paper highlights the importance of responsive law in the face of social change due to technological advances. The author emphasizes that the existence of adaptive regulations is very important to protect the public from the negative impacts of technology, especially in preventing and handling Sexual Cybercrime. The research method used is normative juridical, employing statutory and case approaches. The research objective is to analyze the response of law in the face of social changes related to Sexual Cybercrime.

Abstract

Restorative justice, originally designed to protect the future of the offender's child, in practice creates new inequalities by failing to ensure justice and protection for victims, particularly in the context of sexual crimes with severe physical and psychological consequences. This research emphasizes the need to critically evaluate the application of restorative justice in child rape cases, so that it does not become a shortcut to solving cases without comprehensively considering the rights of victims and the principles of substantive justice. This research criticizes the application of restorative justice in the juvenile criminal justice system, particularly in rape cases involving children as both perpetrators and victims. Using a normative legal approach, this research analyzes how restorative justice is prioritized as a form of peaceful resolution, but may ignore the rights and overall recovery of victims.

Abstract

This research began with confusion regarding changes in the direction of legal regulatory policies regarding abortion in Indonesia. This is proven by the amendment to the Health Law Number 17 of 2023 which is part of the health omnibus law, which can result in multiple interpretations because it refers to the criteria specified in the criminal code. However, it is not explained which criminal law book will be used, which could create gaps in the application of criminal law in cases of legal abortion in Indonesia. The possibility of interpretation in determining the criminal law book is due to the transition period for the implementation of the new criminal law book, namely Law Number 1 of 2023, which will still come into force in 2026. The difference in the policy direction of the old criminal law book and The new one is very significant because the new one regulates the exceptions to which abortion can be carried out, whereas the old one does not see any reason and categorizes abortion as a criminal offense and will be subject to imprisonment for those who violate it. These differences in provisions will certainly have quite different legal consequences if the legal regulations are incorrectly applied in dealing with the issue of legal abortion in Indonesia. If they are incorrect then the disadvantage is the pregnant mother who has the right to abortion. This research uses normative legal research by looking at conceptual approaches and also legislation. With the aim of seeing how the legislation regarding abortion continues to undergo changes and the legal consequences that arise from these policies.
