<![CDATA[ABSTRACT This study entitled Implementation of Profit Sharing Between Pt. Gojek With Drivers Judging from Permenhub Number 667/2022 Concerning Guidelines for Calculation of Service Fees for Using Motorcycles Used for the Benefit of the Community which is Done with Applications in Pontianak City. With the lack of certainty that the commission deducted from the Go-Jek driver application makes the Decree of the Minister of Transportation Number 667 of 2022 not implemented, because in practice many drivers feel that the amount of commission taken by the company is still large enough so that they cannot cover operational expenses when the driver it works so that it cannot reach the UMR which is detrimental to the drivers.This study uses empirical legal research using a qualitative approach. With the intention to explain the situation that occurred based on the appropriate data and facts in the field. If you pay attention to the contract agreements entered into by the company for drivers, there is still a discrepancy with what happened in the field where drivers are charged a different commission than stated in the Decree of the Minister of Transportation Number 667 of 2022.From the Decree of the Minister of Transportation Number 667 of 2022, the Gojek company in implementing the eighth decree in terms of the highest application rental fee of 15% is not carried out by the Gojek company which still applies a 20% discount on shipping costs plus an application service fee from the previous Rp. 2,000 to IDR 4,000.Based on the research method used, the implementation of the Decree of the Minister of Transportation Number 667 of 2022 has not been maximally implemented in the field by PT. Go-Jek Indonesia towards drivers who are partners with the company so that there are still many drivers who still complain about the amount of commission. Therefore, it is necessary for the government and the ministry of transportation to oversee companies that impose commissions that exceed what the company claims for the drivers themselves and provide sanctions against companies that impose fraud in taking the amount of the commission. Keywords: Commission; driver; Gojek; Contract; Partnership. Abstrak Penelitian ini berjudul Pelaksanaan Bagi Hasil Antara Pt. Gojek Dengan Driver Ditinjau Dari Kepmenhub Nomor 667/2022 Tentang Pedoman Perhitungan Biaya Jasa Penggunaan Sepeda Motor Yang Digunakan Untuk Kepentingan Masyarakat Yang Dilakukan Dengan Aplikasi Di Kota Pontianak. Dengan kurang adanya kepastian komisi yang dipotong dari aplikasi driver Go-Jek tersebut menjadikan Keputusan Menteri Perhubungan Nomor 667 Tahun 2022 tidak terlaksana, karena dalam pelaksanaannya banyak driver yang merasa jumlah komisi yang diambil pihak perusahaan masih cukup besar sehingga tidak dapat menutup pengeluaran biaya operasional saat driver tersebut berkerja sehingga tidak dapat mencapai UMR yang merugikan para driver.Penelitian ini menggunakan penelitian hukum empiris dengan menggunakan pendekatan kualitatif. Dengan maksud untuk menjelaskan keadaan yang terjadi berdasarkan data dan fakta yang sesuai di lapangan. Jika diperhatikan dalam kontrak perjanjian yang dilakukan oleh perusahaan terhadap para driver masih memiliki ketidaksesuaian dengan yang terjadi pada fakta lapangan yang dimana para driver dikenakan komisi yang berbeda dengan yang dicantumkan dalam Keputusan Menteri Perhubungan Nomor 667 Tahun 2022.Dari Keputusan Menteri Perhubungan Nomor 667 Tahun 2022 tersebut perusahaan Gojek dalam penerapan keketapan kedelapan dalam perihal biaya sewa penggunaan aplikasi paling tinggi 15% tersebut tidak dilaksanakan oleh perusahaan Gojek yang masih memberlakukan potongan ongkos kirim sebesar 20% yang ditambah dengan biaya jasa aplikasi dari yang sebelumnya Rp. 2.000 menjadi sebesar Rp.4.000.Berdasarkan metode penelitian yang digunakan, bahwa pelaksanaan Keputusan Menteri Perhubungan Nomor 667 Tahun 2022 tersebut belum maksimal penerapannya di lapangan oleh Perusahaan PT. Go-Jek Indonesia terhadap para driver yang menjadi mitra dari perusahaan sehingga masih banyak driver yang masih mengeluhkan perihal jumlah komisi. Oleh karena itu, perlu adanya upaya pemerintah dan kementerian perhubungan untuk mengawasi perusahaan yang memberlakukan komisi yang melebihi dengan apa yang diklaim pihak perusahaan terhadap driver itu sendiri dan memberikan sanksi terhadap perusahaan yang memberlakukan kecurangan dalam pengambilan jumlah komisi.Kata Kunci : Komisi; driver; Gojek; Kontrak; Kemitraan.]]>
