<![CDATA[AbstractCurrently, vehicle development does not only focus on developing efficient vehicles but also on creating environmentally friendly vehicles, one of which is the electric bicycle vehicle. Electric bicycles are vehicles with 2 (two) wheels equipped with mechanical equipment in the form of an electric motor. Regulations regarding procedures for use and paths that electric bicycles may pass through have been regulated in Minister of Transportation Regulation No. PM 45 of 2020 concerning Certain Vehicles Using Electric Motor Drives. The problem in this research is how the Pontianak City Government supervises electric bicycle users and how effective the legal provisions regarding Certain Vehicles Using Electric Motor Drives are in Pontianak City.In this study, the authors used empirical methods with a descriptive approach, namely describing the actual situation as it was at the time the research was carried out and uncovering all problems based on facts. This research was conducted using interview techniques and observation techniques. This study aims to determine how the Pontianak City Government supervises the use of electric bicycles and to determine the effectiveness of the Minister of Transportation Regulation No. PM 45 of 2020 concerning Certain Vehicles Using Electric Motor Drives in Pontianak City.Based on the results of the study, it can be concluded that supervision from the Pontianak City Government is still lacking. This is because the Pontianak City Government, especially the Pontianak City Transportation Service, did not take firm action but only warned electric bicycle users who did not comply with the provisions. The Effectiveness of the Minister of Transportation Regulation No. PM 45 of 2020 concerning Certain Vehicles Using Electric Motor Drives in Pontianak City is also not yet effective. AbstrakSaat ini pengembangan kendaraan tidak hanya fokus pada pengembangan kendaraan yang efisien, tetapi juga pada penciptaan kendaraan yang ramah lingkungan, salah satunya yaitu kendaraan sepeda listrik. Sepeda Listrik adalah kendaraan tertentu yang memiliki roda 2 (dua) dilengkapi dengan peralatan mekanik berupa motor listrik. Peraturan terkait tata cara penggunaan serta jalur yang boleh dilalui sepeda listrik telah di atur dalam Peraturan Menteri Perhubungan No. PM 45 Tahun 2020 tentang Kendaraan Tertentu dengan Menggunakan Penggerak Motor Listrik. Adapun masalah dalam penelitian ini adalah bagaimana pengawasan Pemerintah Kota Pontianak terhadap pengguna sepeda listrik serta bagaimana efektivitas ketentuan hukum tentang Kendaraan Tertentu dengan Menggunakan Penggerak Motor Listrik di Kota Pontianak.Dalam penelitian ini penulis menggunakan metode empiris dengan pendekatan deskriptif yakni mendeskripsikan keadaan yang nyata sebagaimana adanya pada saat penelitian dilaksanakan dan menggungkapkan segala permasalahan berdasarkan fakta-fakta. Penelitian ini dilakukan dengan menggunakan teknik wawancara dan teknik observasi. Penelitian ini bertujuan untuk mengetahui bagaimana pengawasan dari Pemerintah Kota Pontianak terhadap penggunaan sepeda listrik serta mengetahui efektivitas dari Peraturan Menteri Perhubungan No. PM 45 Tahun 2020 tentang Kendaraan Tertentu dengan Menggunakan Penggerak Motor Listrik di Kota Pontianak. Berdasarkan hasil penelitian dapat disimpulkan bahwa pengawasan dari Pemerintah Kota Pontianak dinilai masih kurang. Hal ini dikarenakan Pemerintah Kota Pontianak khususnya Dinas Perhubungan Kota Pontianak tidak memberikan tindakan yang tegas tetapi hanya berupa teguran bagi pengguna sepeda listrik yang tidak sesuai ketentuan. Efektivitas dari Peraturan Menteri Perhubungan No. PM 45 Tahun 2020 tentang Kendaraan Tertentu dengan Menggunakan Penggerak Motor Listrik di Kota Pontianak juga belum efektif. Hal ini terjadi karena Peraturan Menteri Perhubungan Nomor 45 Tahun 2020 tentang Kendaraan Tertentu dengan Menggunakan Penggerak Motor Listrik tidak mengatur sanksi apabila pengguna sepeda listrik tidak sesuai dengan ketentuan.
