Abstract

Haryono No. 169 Malang e-mail: celinesttg@student.ub.ac.id ABSTRAK Pada tulisan ini, penulis mengangkat permasalahan terkait Konsekuensi Yuridis Terhadap Putusan Pengadilan Yang Tidak Mengupayakan Diversi Dalam Sistem Peradilan Pidana Anak. Pemilihan tema yang diangkat oleh penulis dilatarbelakangi oleh kewajiban diversi yang diatur dalam Pasal 7 ayat (1) Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak namun pada kenyataannya masih terdapat perkara anak yang diputus oleh pengadilan tanpa diupayakan diversi terlebih dahulu. Berdasarkan hal tersebut, penulis mengangkat rumusan masalah: (1) Apa konsekuensi yuridis terhadap putusan pengadilan yang tidak mengupayakan diversi dalam sistem peradilan pidana anak? (2) Apa upaya hukum yang dapat dilakukan oleh anak atau penasihat hukumnya dalam mengahadapi putusan yang tidak mengupayakan diversi dalam sistem peradilan pidana anak? Penulisan ini menggunakan metode penelitian yuridis normatif dengan menggunakan pendekatan penelitian Pendekatan Perundang-Undangan dan Pendekatan kasus. Hasil dari penelitian ini menunjukkan bahwa konsekuensi yuridis terhadap putusan pengadilan yang tidak mengupayakan diversi dapat dikatakan batal demi hukum. Dalam hal terpidana anak atau penasihat hukumnya ingin mengupayakan pembatalan putusan maka dapat mengajukan banding ketika putusan tersebut belum mempunyai kekuatan hukum tetap atau mengajukan peninjauan kembali apabila putusan sudah berkekuatan hukum tetap. Kata Kunci: Sistem Peradilan Pidana Anak, Diversi, Putusan Pengadilan ABSTRACT This research studies the issue of a juridical consequence of a court decision not offering any chance for diversion in the judicial system of juvenile crime. This research topic departs from the responsibility of offering diversion as intended in Article 7 paragraph (1) of Law Number 11 of 2012 concerning the Judicial System of Juvenile Crime. In reality, lots of juvenile cases are judged without being preceded by the offering of diversion. Based on this issue, this research investigates: (1) what is the juridical consequence of a court decision not offering any diversion in the judicial system of juvenile crime and (2) what legal remedies can be taken by the child or the lawyers concerned in dealing with the court decision not offering a chance of diversion in the judicial system of juvenile crime? This research employed normative-juridical methods and statutory and case approaches. The research results discover that the court decision not offering diversion can be deemed null and void. The child or the lawyer concerned can file an appeal if the decision does not hold any permanent legal force or request a judicial review when it already holds a permanent legal force. Abstract

This study aims to determine the application of the Restitutio in Integrum principle in Indonesian laws and regulations governing restitution to victims of criminal acts. It is currently known that the weakness of restitution execution power in Indonesia has made the fulfillment of restitution to victims difficult to realize. This is because there is no binding force, so that the implementation of restitution is oriented towards the goodwill of the perpetrator of the crime. The research method used in this article is normative juridical with statute approach and conceptual approach. This study argues that restitution arrangements in various laws and regulations in Indonesia do not accommodate forced efforts if the perpetrators of criminal acts do not carry out restitution. In this case, the lacuna results in the difficulty of executing payments that should be received by victims of criminal acts. Therefore, it is necessary to strengthen the application of the principle of restitutio in integrum which is studied through substance, structure, and legal culture as an effort to realize protection as well as justice for victims of inclusive criminal acts.
