Abstract

Haryono No. 169 Malang e-mail: averosananta07@gmail.com ABSTRAK Sejak disahkannya UU Nomor 1 Tahun 2015, Indonesia menyelenggarakan Pilkada secara serentak di seluruh wilayah Indonesia. Implikasinya adalah daerah yang telah habis masa jabatan kepala daerah dan wakil kepala daerahnya tidak dapat langsung melaksanakan Pilkada sehingga mengalami kekosongan jabatan kepala daerah sampai dengan pelantikan kepala daerah yang dipilih melalui Pilkada. UU Pilkada memberikan solusi dengan mengangkat seorang Penjabat Kepala Daerah dari kalangan ASN. Namun, hingga sampai saat ini pemerintah belum menerbitkan peraturan pelaksana untuk melengkapi aturan pengangkatan Penjabat Kepala Daerah. MK dalam Putusan Nomor 167/PUU-XIX/2021 yang ditegaskan kembali dalam Putusan Nomor 15/PUU-XX/2022 telah memberi rekomendasi kepada pemerintah untuk menerbitkan peraturan pelaksana supaya pengangkatan Penjabat Kepala Daerah tidak mengabaikan prinsip demokrasi dan kedaulatan rakyat. Oleh karena itu, peraturan pelaksana yang berbentuk peraturan pemerintah dan mengatur dari tahap pengusulan, penyeleksian, pengangkatan, hingga pertanggungjawaban dengan berdasar pada prinsip demokrasi pancasila adalah sangat diperlukan untuk melengkapi landasan yuridis dalam pengangkatan Penjabat Kepala Daerah. Kata Kunci: reformulasi pengaturan, Penjabat Kepala Daerah, demokrasi pancasila ABSTRACT Following the promulgation of Law Number 1 of 2015, Indonesia conducts regional head elections (Pilkada) concurrently all across Indonesia. The regional areas led by regional heads and vice-heads with expired tenure will not be able to immediately conduct another election, leading to idle seats of official positions until the inauguration of the elected regional heads takes place. The Law concerning Regional Head Elections offers a solution where the member of state civil apparatuses could be appointed as an official. On the contrary, the government has not issued any delegated regulation supplementary to the rule governing the appointment of a regional head. The Constitutional Court with its Decision Number 167/PUU-XIX/2021, re-declared in Decision Number 15/PUU-XX/2022, has urged the government to issue a delegated regulation to ensure that the appointment of a regional head does not overlook the principles of democracy and sovereignty. Therefore, a government regulation serving as a delegated regulation should govern the matter, ranging from recommendation, selection, and appointment, to responsibilities according to the principle of the democracy of Pancasila. This principle is considered essential to complete the juridical foundation in the appointment of a regional head. Abstract

The policy of transitioning to simultaneous elections in 2024 in Indonesia has given rise to polemics regarding human rights and democracy. There is no justification for the government to disregard citizens' civil and political rights in appointing interim regional heads. This research seeks to examine the phenomenon of the appointment of interim regional heads as an integral part of fulfilling citizens' civil and political rights. By using normative juridical or legal doctrinal research methods, this research demonstrates that the process of appointing interim regional heads is problematic. The government only relies on one regulation while ignoring the others, such as government and non-governmental organizations' recommendations. As a result, the appointment of interim regional heads appears less democratic, potentially leading to actions taken behind closed doors without involving public participation. This indicates that the centralized appointment of interim regional heads is more politically driven than merely focused on effectiveness and efficiency.
