Abstract

Haryono No. 169 Malang e-mail: achmadism@student.ub.ac.id Abstrak Penelitian ini membahas tentang faktor-faktor penyebab pengendara menggunakan knalpot racing pada sepeda motor dan upaya-upaya yang dilakukan kepolisian terhadap pengendara sepeda motor yang menggunakan knalpot racing di jalanan umum Kota Malang. Penelitian ini dilatarbelakangi oleh ketimpangan Undang-undang Lalu Lintas yang berlaku (Das Sollen) dengan angka pelanggaran lalu lintas terkhususnya terkait knalpot racing yang ada di lapangan (Das Sein). Penulisan ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis kriminologis. Data yang diperoleh baik data primer maupun data sekunder yang didapat akan diolah dan dianalisa menggunakan metode teknik deskriptif kualitatif. Dari penelitian dengan metode diatas penulis memperoleh jawaban atas permasalahan yang ada bahwa faktor-faktor penyebab pengendara menggunakan knalpot racing pada sepeda motor adalah berupa faktor internal yaitu faktor individu, faktor usia, faktor jenis kelamin, dan dari faktor eksternal yakni faktor lingkungan, faktor penegakan hukum, dan faktor perkembangan zaman. Upaya-upaya penanggulangan yang dilakukan oleh Kepolisian Resort Kota Malang terhadap pemakaian knalpot racing pada sepeda motor adalah melalui upaya pre-emtif, preventif, dan represif. Kata kunci: Kepolisian, Kriminologi, Knalpot Racing, Sepeda Motor Abstract This research aims to discuss the contributing factors of replacing a standard exhaust pipe with a racing one on a motorbike and measures taken by the police to take action against motorbike users with this kind of exhaust pipe found on public roads in Malang City. This research topic departed from incongruence between the current Traffic Law (Das Sollen) and the incidence of violations regarding the use of a racing exhaust pipe in real life (Das Sein). With empirical-juridical methods, criminological-juridical approaches, and qualitative-descriptive techniques for the analysis of both primary and secondary data, this research discovers that replacing the standard exhaust pipe with the racing one is triggered by certain factors such as individual factor, age, and sex, while the external factors involve surroundings, law enforcers, and changing time. Measures taken to mitigate this issue by the Sub-Regional Police Department of Malang consist of preemptive, preventive, and repressive actions. Abstract

Corruption is a problem that results in high financial and economic losses in Indonesia. UNCAC has launched recommendations for countries to make arrangements regarding Non-Conviction Based asset Forfeiture (NCB) since 2003 which aims to recover maximum state financial losses. This is based on the fact that the state losses recovered are not proportional to the state financial losses incurred due to corruption crimes. The research used is normative juridical with a statutory approach, conceptual approach, and comparison with other countries. The conception of assets as legal subjects in the NCB is based on the theory of legal fiction where assets in their position as legal subjects make them seem "guilty" when the way of use or the process of obtaining them is against the law. Assets in this case are considered to be able to perform a legal act that can be accounted for as happened in several cases in the United States, the Philippines, Thailand, not to mention Indonesia. Thus, because it focuses on the "fault" of the object, asset forfeiture can still be carried out even though the object or asset has changed hands. Legislation in Indonesia has actually adopted the concept of NCB, but it does not fulfill the basic essence of the concept where the goal is to recover state losses arising from corruption maximally and quickly. Therefore, laws governing asset forfeiture must be made specifically to accommodate this, one of which is through the bill on asset forfeiture.
