Haryono No. 169 Malang e-mail: rakamukti@student.ub.ac.id Abstrak Penulis mengulas efektivitas Pasal 6 ayat (1) Peraturan Menteri Negara Lingkungan Hidup Nomor 5 Tahun 2006, dilatarbelakangi kepadatan penduduk di Kota Malang yang berimplikasi padat kendaraan dengan rumusan masalah : (1) Mengapa Pasal 6 ayat (1) Peraturan Menteri Negara Lingkungan Hidup Nomor 5 Tahun 2006 tentang uji emisi kendaraan bermotor lama yang terdaftar di daerah Kota Malang tidak efektif?; (2) Bagaimana hambatan dan upaya yang dapat dilakukan untuk mengoptimalkan efektivitas Pasal 6 ayat (1) Peraturan Menteri Negara Lingkungan Hidup Nomor 5 Tahun 2006 tentang uji emisi kendaraan bermotor lama yang terdaftar di daerah Kota Malang?. Penelitian menunjukkan, pelaksanaan uji emisi kendaraan di Kota Malang belum efektif karena faktor hukum, penegak hukum, fasilitas, dan masyarakat. Faktor penghambat yaitu: 1) faktor internal: a) persiapan kurang matang; b) belum ada perintah uji emisi bagi roda dua; c) sulit memberhentikan kedaraan; 2) faktor eksternal: a) faktor cuaca yaitu musim penghujan; b) alat uji emisi rusak. Upaya yang dapat dilakukan yaitu: a) persiapan yang lebih matang; b) pengusulan uji emisi kendaraan untuk roda dua; c) sosialisasi seluruh masyarakat; d) persiapan cadangan alat uji emisi; e) dilakukan waktu musim kemarau. Penulis menggunakan metode sociolegal dengan pendekatan yuridis sosiologis melalui teknik wawancara, studi dokumentasi, observasi, angket. Kata Kunci: Efektivitas Hukum, Uji Emisi Kendaraan Bermotor, Dinas Lingkungan Hidup Kota Malang Abstract Departing from population density issues, this research studies the problem of the effectiveness of Article 6 paragraph (1) of the Ministerial Regulation Number 5 of 2006 by investigating the following research problems: (1) why is Article 6 paragraph (1) of the Regulation of the Minister of Environment Number 5 of 2006 concerning emission test for registered old vehicles in Malang considered ineffective and (2) what impeding factors exist and what measures can be taken to optimize the effectiveness of Article 6 paragraph (1) as mentioned regarding the emission test of registered old vehicles in Malang city? The research results discover that the emission test for registered old vehicles in Malang City has not been performed effectively due to several factors such as law, law enforcers, facilities, and the members of the public. Moreover, impeding factors come from both internal and external, where the former involves a) insufficient preparation; b) absence of an order to conduct emission test for two-wheel vehicles; c) problems in stopping moving vehicles, while the external one involves a) weather issues; problem escalates in rainy days; b) out-of-order emission testing device. The measures suggested involve a) a more prepared plan; b) a proposal for emission test for two-wheels; c) introduction of the program to the public; d) availability of spare emission testing devices; e) considering emission tests in dry seasons. This research employed socio-juridical methods garnering the data from interviews, documentation, observation, and questionnaires.
