Abstract

Industri pakaian bekas (trifting) telah menjadi satu isu yang secara signifikan dalam perdagangan internasional. Saat ini, banyak negara yang memperketat aturan impor untuk meminimalkan dampak negatifnya terhadap industri lokal. Namun, industri pakaian bekas tetap memiliki penggemar setia dan kini menjadi salah satu tren yang semakin populer. Tujuan diadakan suatu penelitian ini antara lain untuk menganalisis bagaimana peningkatan daya saing industri dapat mengatasi kasus impor pakaian bekas. Salah satunya dengan menggunakan metode penelitian yang dipergunakan merupakan studi literatur dari beberapa artikel dan jurnal terkait. Hasil analisis menunjukkan bahwa peningkatan daya saing industri dapat digarab dengan salah satu cara terkait meningkatkan kualitas produk, memperluas pasar ekspor, dan meningkatkan efisiensi produksi tersebut. Selain itu, pemerintah juga dapat memberikan insentif dan dukungan untuk industri lokal agar lebih kompetitif di pasar internasional.

Abstract

This research uses a doctrinal approach based on international agreements and international conventions that aim to provide an understanding of the civil war in Syria that is linked to international conventions. The UN Security Council uses regulations to punish those who use chlorine, one of which is in the civil war, because it is related to article VII of the UN Charter. The provisions governing civil war are set forth in article 3 Kof the 1949 Jenewa convention. The Geneva Conventions and additional protocols are aimed at protecting the enemy. Syria must take responsibility for a civil war in which the United Nations as an international organization plays a role in ensuring world peace, the ICRC carries out protection and humanitarian assistance, and the international court plays a role in prosecuting war crimes and crimes against humanity. In relation to article 146 of the IV Geneva Convention which means that everyone who has been proven to have committed an offense categorized as a gross human rights violation must be tried using the national re of his country to ensure legal certainty and provide justice to the victims affected. Abstract

The involvement of minors in criminal acts such as murder presents a complex legal dilemma. On one hand, criminal law demands accountability for serious offenses; on the other hand, child offenders must be viewed as individuals undergoing development and thus entitled to special legal protection. This paper analyzes the criminal liability of children in cases of murder by comparing the approaches of the Indonesian Penal Code (KUHP) and Law No. 11 of 2012 on the Juvenile Criminal Justice System (UU SPPA). Using a normative legal method and comparative approach, the study focuses on the fundamental principles of general and special criminal law, and how these are applied in judicial practice. The findings show that the KUHP leans toward a retributive model of justice, while the UU SPPA prioritizes restorative and rehabilitative approaches. In serious offenses like murder, children can still be held criminally liable, but through a legal process that takes into account their psychological and social conditions, as well as their future development. This study highlights the importance of harmonizing the KUHP and UU SPPA to achieve a justice system that is fair to both victims and child offenders.

Abstract

The crime of premeditated murder is a serious crime in the criminal law system regulated in Article 340 of the Criminal Code, with the element of “with premeditation” as the main differentiator from ordinary murder. This research examines the application of Article 340 of the Criminal Code in a murder case that occurred in Wonogiri in 2025, where the perpetrator allegedly killed his affair lover and made efforts to systematically disappear. The method used is normative juridical with statutory, conceptual, and case approaches, as well as descriptive-analytical qualitative analysis of primary, secondary, and tertiary legal materials. The results showed that proving the element of planning in Article 340 of the Criminal Code does not only refer to the intention of the perpetrator, but also to the existence of a time lag and a series of careful preparations, such as choosing a quiet place, removing traces by wrapping the body and casting the burial location. These actions indicate that the perpetrator had full control and awareness, so that this murder did not occur spontaneously or due to momentary emotional impulses. The complex motive of the affair strengthens the suspicion of a long-standing conflict that triggered the planning of the crime. Thus, the application of Article 340 of the Criminal Code against the perpetrators in this case is juridically and sociologically appropriate, providing a deterrent effect and maintaining the integrity of the criminal justice system in Indonesia. Proportional law enforcement against the crime of premeditated murder is important to uphold justice for victims and society.
