Haryono No. 169 Malang e-mail: yusifannisa@student.ub.ac.id Abstrak Pada skripsi ini penulis mengangkat permasalahan berkaitan dengan urgensi konstruksi pengaturan perlindungan hak-hak petani kecil atas varietas tanaman di Indonesia. Pemilihan tema ini dilatarbelakangi oleh ketidaklengkapan hukum terkait aturan perlindungan bagi petani kecil pemulia tanaman atas varietas tanaman yang dihasilkan, hal tersebut menyebabkan banyaknya petani kecil terkriminalisasi. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah diantaranya: (1) Bagaimana analisis hak-hak petani kecil atas varietas tanaman berdasarkan peraturan perundang-undangan di Indonesia? (2) Bagaimana pengaturan hukum yang tepat terhadap hak-hak petani kecil atas varietas tanaman yang memberikan kepastian hukum?. Penelitian ini menggunakan metode penelitian yuridis normatif dengan metode pendekatan perundang-undangan dan pendekatan perbandingan. Bahan hukum yang diperoleh penulis selanjutnya akan dianalisis dengan menggunakan teknik analisis interpretasi sistematis, interpretasi gramatikal dan interpretasi komparatif. Hasil penelitian ini, penulis memperoleh jawaban atas permasalahan yang ada bahwa, Pertama peraturan perundang-undangan di Indonesia belum sepenuhnya melindungi hak-hak petani kecil atas varietas tanaman berdasarkan ketentuan pasal 9 ITPGRFA, pemberian definisi petani kecil yang sempit serta terdapat beberapa pasal yang membatasi hak-hak petani kecil. Kedua, Konstruksi hukum terhadap hak-hak petani kecil terhadap varietas tanaman di Indonesia, terhadap hak-hak yang belum diatur perlu adanya aturan yang baru dan bersifat suigeneris yang lebih melindungi hak-hak petani kecil pemulia tanaman atas varietas tanaman. Kata Kunci: HAKI, Perlindungan Varietas Tanaman, Hak Petani Kecil Pemulia Tanaman Abstract This research studies the urgency in the construction of the regulation of the protection of the rights of crofters regarding plant varieties in Indonesia. This research topic departed from the incompleteness of the law governing the protection of crofters for plant varieties they produce, making crofters prone to criminalization. Departing from this issue, this research aims to investigate (1) how the rights of crofters are analyzed regarding plant varieties they produce according to related legislation in Indonesia and (2) what is the appropriate regulation regarding the protection of the rights of crofters for plant varieties that guarantees legal certainty. This research employed normative-juridical methods and statutory and comparative approaches. Legal materials were analyzed using systematic, grammatical, and comparative interpretations. The research results reveal that the legislation in Indonesia does not fully protect the rights of crofters in Indonesia regarding the plant varieties they produce according to Article 9 of ITPGRFA. The impeding issues lie in the narrow definition of crofters and several articles restricting their rights. In terms of the construction of the rights of the crofters for plant varieties in Indonesia, unregulated rights of crofters regarding plant varieties should be put in a new suigeneris regulation that protects the rights of crofters as plant breeders regarding plant varieties.
