Penelitian ini mengangkat dua permasalahan berhubungan dengan ketidakjelasan pemaknaan formulasi dan bentuk hukum dari frasa “Severe Penalties” Pasal 3 Bis Paragraf (c) Konvensi Chicago 1944. Pertama, Bagaimana formulasi dan bentuk hukum “Severe Penalties” Pasal 3 bis Paragraf (c) Chicago Convention 1944. Kedua, apakah formulasi dan bentuk hukum “Severe Penalties” di beberapa negara peratifikasi sesuai dengan maksud dan tujuan Pasal 3 bis paragraf (c) Chicago Convention 1944. Untuk menjawab permasalahan diatas penulis menggunakan jenis penelitian yuridis normatif metode pendekatan yang dipakai adalah Pendekatan perundang-undangan (statute approach) dan Pendekatan perbandingan (comparative approach). Jenis dan sumber bahan hukum terbagi menjadi sumber hukum primer, sekunder, dan tersier. Teknik penelusuran bahan hukum dalam penelitian hukum normatif dapat diperoleh melalui penelusuran bahan hukum atau studi kepustakaan (library research) terhadap bahan hukum primer, sekunder, dan tersier. Teknik analisis bahan hukum pada penelitian hukum normatif dapat menggunakan teknik interpretasi yang sesuai, antara lain interpretasi gramatikal, sistematis, formal, ekstensif, restriktif, dan lain-lain. Dari hasil penelitian dengan metode di atas, penulis menemukan bahwa menafsirkan frasa “severe penalties” membutuhkan 3 metode. Yaitu, Penafsiran Tekstual (textual school), interpretasi kehendak para pihak (Intention of the parties school) atau travaux preparatoires (preparatory works), dan menurut Maksud dan Tujuan dari Perjanjian (teleological school). Tujuan dari pemberian frasa “severe penalties” itu sendiri ialah menghukum pelanggar wilayah udara mereka dengan hukuman berat dan tidak membahayakan penumpang yang ada didalamnya. Kata kunci: severe penalties, Pasal 3 bis, Konvensi Chicago 1944 Abstract This research studies the formulation and the legal form of the phrase “severe penalties” in Article 3 bis, Paragraph (c) of the Chicago Convention 1994, and it is specifically focused on two issues regarding the murky definition of the formulation and the legal form of this phrase within the following research problems concerning, first, the formulation and the legal form of the phrase “severe penalties” of Article 3 bis, Paragraph (c) of Chicago Convention 1944 and, second, whether the formulation and legal form of the phrase “severe penalties” in several states ratifying the convention are relevant to the intention and objective of Article 3 bis, Paragraph (c) of Chicago Convention 1944. This research employed a normative-juridical method and statutory and comparative approaches. Primary, secondary, and tertiary data were obtained from library research and analyzed using grammatical, systematic, formal, extensive, and restrictive interpretations, among others. The research results reveal that interpreting this phrase requires three methods: textual school intention of the parties school, or travaux preparatoires (preparatory works) and teleological school. The intention of the phrase “severe penalties” is to punish violators (pilots of airliners holding no flight permits to fly over a territory of a state) under severe penalties without harming the passengers on board.
