Abstract

AbstrakPerjanjian jual beli tanah di bawah tangan tersebut tetap rawan, karena tidak memberikan kepastian hukum. Kepastian hukum adalah keadaan dimana suatu peraturan dibuat dan diundangkan secara pasti karena mengatur secara jelas dan logis. Jelas dalam artian tidak terdapat kekaburan norma atau keraguan (multitafsir) dan logis dalam artian menjadi suatu sistem norma dengan norma lain sehingga tidak berbenturan atau menimbulkan konflik norma. Sertipikat tanah menjadi hal yang penting bagi masyarakat karena merupakan bukti yang kuat dan sah secara hukum atas kepemilikan bidang prosedur dan tata cara yang sesuai dengan peraturan perundang-undangan yang berlaku. Menerangkan siapa yang mempunyai hak, kalau ada disertai turunan surat-surat jual beli tanahnya. Tanda bukti kewarganegaraan yang sah dari yang mempunyai hak, sebagai yang dimaksud dalam Pasal 2 sub b. Pelaksanaan jual beli tanah pada hakekatnya merupakan salah satu pengalihan hak atas tanah kepada pihak lain, yaitu dari pihak penjual kepada pihak pembeli tanah. Dalam proses pelaksanannya tidak mungkin dilaksanakan balik nama tanpa melibatkan PPAT, maka berdasarkan ketentuan perbuatan hukum jual beli tanah yang dilakukan dihadapan PPAT dapat dibuktikan dengan Akta Jual Beli (AJB) tanah yang dibuat oleh PPAT. Legal certainty is a situation where a regulation is made and promulgated with certainty because it regulates clearly and logically. Clear in the sense that there is no ambiguity or doubt (multiple interpretations) and logical in the sense that it becomes a system of norms with other norms so that they do not clash or cause norm conflicts. Land certificates are important for the community because they are strong and legally valid proof of ownership in the field of procedures and procedures in accordance with the applicable laws and regulations. Explain who has the rights, if any, accompanied by derivatives of the land sale and purchase documents. Proof of valid citizenship from those who have rights, as referred to in Article 2 sub b. The implementation of buying and selling land is essentially a transfer of land rights to another party, namely from the seller to the land buyer. In the implementation process it is not possible to transfer the name without involving the PPAT, so based on the provisions of the legal act of buying and selling land carried out before the PPAT, it can be proven by a land sale and purchase deed (AJB) drawn up by the PPAT.. Abstract

This study on Personal Data Protection in Digital Business Transactions in Indonesia is a critical analysis of the intersection between digital sovereignty, the protection of human rights, and legal certainty in the digital economy. This research is motivated by the digital transformation, which has increased the risk of personal data breaches in Indonesia. Although Law No. 27 of 2022 has been enacted, its effectiveness is hampered by institutional constraints and low digital literacy. This study aims to analyze the effectiveness of the implementation of the Personal Data Protection Law and its alignment with international standards such as the General Data Protection Regulation. Using a normative legal approach, the research findings reveal a functional legal vacuum resulting from the absence of an independent supervisory body. An analysis of Lawrence Friedman’s legal systems theory highlights the unpreparedness of the legal structure and culture, while Gustav Radbruch’s theory identifies legal lacunae in cross-border transactions. This article offers novel insights through the reconstruction of legal norms, including: a model for the functional harmonization of the Personal Data Protection Act and the General Data Protection Regulation; the strengthening of a hybrid-autonomous supervisory authority; the formulation of cross-border data transfer rules; and the application of the doctrine of strict liability to digital platforms. The study’s conclusion underscores the need for regulatory synchronization to transform declarative norms into instruments that ensure legal certainty and genuine accountability on the part of data controllers.
