<![CDATA[Abstract This study aims to determine the legal considerations of judges in the Mempawah Religious Court's decision regarding inheritance dispute lawsuits Case No. 441/Pdt.G/2020/PA.Mpw. As well as being able to find out the legal consequences of the decision of the religious court in decision Number 441/Pdt.G/2020/PA.Mpw. This research method is a normative juridical legal research method using a case approach (The Case Approach). This approach is carried out by examining cases related to the legal issues at hand. The cases reviewed are cases that have obtained court decisions with permanent legal force. Based on the results of research conducted using a case approach, it shows that the decision which was declared unacceptable in case No. 441/Pdt.G/2020/PA.Mpw. Based on the judge's legal considerations that the lawsuit cannot be accepted is that there is no legal standing or legal basis in a lawsuit. And the object of the lawsuit filed is still unclear regarding its ownership rights (obscuur libel). The author agrees with the judge's decision and legal considerations in this case which prioritizes the principle of legal certainty in a civil case. AbstrakPenelitian ini bertujuan untuk mengetahui pertimbangan hukum hakim pada putusan Pengadilan Agama Mempawah terhadap gugatan sengketa waris No perkara 441/Pdt.G/2020/PA.Mpw. Serta dapat mengetahui akibat hukum terhadap putusan pengadilan agama dalam putusan Nomor 441/Pdt.G/2020/PA.Mpw. Metode penelitian ini adalah metode penelitian hukum yuridis normatif dengan menggunakan pendekatan kasus (The Case Approach). Pendekatan ini dilakukan dengan melakukan telaah pada kasus-kasus yang berkaitan dengan isu hukum yang dihadapi. Kasus-kasus yang ditelaah merupakan kasus yang telah memperoleh putusan pengadilan berkekuatan hukum tetap. Berdasarkan hasil penelitian yang dilakukan dengan pendekatan kasus menunjukan bahwa putusan yang dinyatakan tidak dapat diterima pada perkara No 441/Pdt.G/2020/PA.Mpw. Berdasarkan pertimbangan hukum hakim bahwa tidak dapat diterima gugatan tersebut ialah tidak terdapat legal standing atau dasar hukum dalam sebuah gugatan. Dan objek gugatan yang diajukan masih tidak jelas mengenai hak kepemilikannya (obscuur libel). Penulis sepakat dengan putusan serta pertimbangan hukum hakim dalam perkara tersebut yang mengedepankan asas kepastian hukum dalam suatu perkara perdata.
