Abstract

The compensation for running a job is to get wages. There is one form of wage protection through minimum wage. The fact is there are still workers who have not earned a wage based on minimum wage after they run their jobs. One of them is the retainers of the court (Abdi Dalem) of Sultan palace of Yogyakarta. This study aims to analyze the validity of the wage system applied to the court servants who accept below the minimum wage. This study applies socio-legal approach. The result of this research is the Abdi Dalem get salaries in the form of “kecuca” which amount is less than the minimum wage of Yogyakarta Province. Sultan Hamengkubuana X should be prosecuted for violation of Article 90 paragraph (2) jo. Article 187 of Law Number 13 Year 2003. The right to pursue of the courtiers has never been implemented because the working relationship between the courtiers and the Sultan is devotion. The sense of service is the soul of the agreement on which the working relationship is based. What has been agreed upon by the parties is binding as the law for the party making it (Article 1338 B.W. (Burgerlijkwetboek). The significance of this research is that the principle of local wisdom which is the basis of working relations can be unleashed. The contribution of this research is the emergence of an understanding that the employment relationship is not solely aimed at earning wages. A sense of tranquility after work becomes the choice of the destination of the courtiers to serve the Sultanate of Yogyakarta

Abstract

The status of stevedoring labor legal relations is still debated among labor law experts. As a permanent worker, outsourcer, daysman, or no employment relationship. Focus the study to analyze the status of the legal relationship between stevedoring workers and the legal consequences, along with legal remedies that can be taken by stevedoring workers, if they have not received maximum rights. The case and statutory approaches are used in this legal research. The results of the research study after analysis of the substance and procedure are the status of legal relations of stevedoring labor, more precisely as daily workers, and as members of cooperatives. The legal consequence of the employment relationship status of stevedoring workers with cooperatives is the right to share the remaining operating results, at the end of the year. The legal consequence of the loading and unloading labor service work is wages based on daily time units. There is no right to severance pay, service award money, or reimbursement money because it is not stipulated in the Cooperative Annual Member Meeting. Legal actions that can be taken by stevedoring workers if they do not get their rights can file a default lawsuit in the local District Court. The recommendation given is that cooperatives can establish additional rights for bonfire loading workers, such as rights that should obtain permanent employment, through the annual meeting of cooperative members. Abstrak: Status hubungan hukum tenaga kerja bongkar muat, sampai sekarang masih menjadi perdebatan di kalangan ahli hukum ketenagakerjaan. Sebagai pekerja tetap, pekerja alih daya, pekerja harian, atau tidak ada hubungan kerja. Penelitian ini bertujuan untuk menganalisis status hubungan hukum tenaga kerja bongkar muat dan akibat hukum, beserta upaya hukum yang dapat dilakukan oleh tenaga kerja bongkar muat, apabila belum mendapat hak secara maksimal. Penelitian hukum ini menggunakan pendekatan perundang undangan dan kasus. Hasil penelitian setelah dilakukan analisis substansi dan prosedur adalah status hubungan hukum tenaga kerja bongkar muat, lebih tepat sebagai pekerja harian, dan sebagai anggota koperasi. Akibat hukum atas status hubungan kerja tenaga kerja bongkar muat dengan koperasi adalah adanya hak atas pembagian sisa hasil usaha, di akhir tahun. Akibat hukum atas telah dijalankannya pekerjaan jasa tenaga kerja bongkar muat adalah upah berdasar satuan waktu harian. Tidak ada hak atas uang pesangon, uang penghargaan masa kerja dan uang penggantian hak, karena tidak ditetapkan dalam Rapat Anggota Tahunan Koperasi. Upaya hukum yang dapat dilakukan oleh tenaga kerja bongkar muat apabila tidak mendapatkan haknya dapat mengajukan gugatan wanprestasi di Pengadilan Negeri setempat. Rekomendasi yang diberikan adalah koperasi dapat menetapkan tambahan hak bagi tenaga kerja bongkar muat, seperti hak yang seharusnya diperoleh pekerjaan tetap, melalui rapat tahunan anggota koperasi. Kata Kunci: Tenaga Kerja Bongkar Muat, Pekerja Harian, Koperasi, Hubungan Kerja.

Abstract

Digital transformation in Indonesia’s land administration is being realized through the implementation of Electronic Land Certificates, aiming to enhance efficiency, transparency, and legal certainty. This study explores the evidentiary strength and legal protection afforded to holders of electronic land certificates. Using a normative legal approach, the analysis draws on relevant legal frameworks, including the Electronic Information and Transactions Law, the Consumer Protection Law, and Ministry Regulation No. 3 of 2023 of the National Land Agency/Agrarian Affairs and Spatial Planning. The findings indicate that electronic land certificates are legally valid as evidence in court, safeguarded by data security regulations, and supported by encryption technologies, electronic signatures, and QR codes. Legal protection is provided through both preventive and repressive measures, covering rights to information, personal data security, and dispute resolution mechanisms. However, several challenges persist, especially in regard to digital literacy and infrastructure, and system integration. In conclusion, the successful adoption of electronic land certificates depends on regulatory coherence, technological readiness, and active public participation to establish a secure and reliable digital land administration system
