<![CDATA[Abstrack: This article discusses the division of gono gini property based on the contribution of the husband and wife during the marriage which aims to find out in real terms using existing rulings so that the public can find out the case if during the marriage the wife's party meets the needs in the household. Because it is not uncommon for many wives to come to work at this time in order to help ease the burden on the husband and meet household needs because the husband is not working. This article uses literature research methods in obtaining data as well as with qualitative juridical and descriptive analysis. The results of the discussion showed that the division of gono gini property could differ from the reading of Article 97 of the Compilation of Islamic Law by using contra legem carried out by the panel of judges, namely the wife's party gets 2/3 part and the husband's party gets 1/3 part of the common property as long as there are no other provisions, namely the marriage agreement or the property separation agreement. Abstrak: Artikel ini membahas tentang pembagian harta gono gini berdasarkan kontribusi suami istri selama perkawinan yang bertujuan untuk mengetahui secara nyata menggunakan putusan-putusan yang telah ada agar masyarakat dapat mengetahui penyelesaian kasus apabila selama perkawinan pihak istri yang memenuhi kebutuhan dalam rumah tangga. Karena tidak jarang pula pada saat ini banyak istri yang ikut bekerja agar dapat membantu meringankan beban suami maupun memenuhi kebutuhan rumah tangga karena suami tidak bekerja. Artikel ini menggunakan metode penelitian kepustakaan dalam memperoleh data serta dengan analisis yuridis dan deskriptif kualitatif. Hasil pembahasan menunjukkan bahwa pembagian harta gono gini dapat berbeda dari bunyi Pasal 97 Kompilasi Hukum Islam dengan menggunakan contra legem yang dilakukan oleh majelis hakim yakni pihak istri mendapatkan 2/3 bagian dan pihak suami mendapatkan 1/3 bagian dari harta bersama selama tidak terdapat ketentuan lain yakni perjanjian perkawinan maupun perjanjian pemisahan harta.]]>
