Abstract

The existence of single candidate in the 2015-2020 simultaneous Local Election (Pilkada) period tends to dramatically increase along with the rise of the political parties coalition supporting single candidate, thus closing the opportunity for other candidates to advance through a political party. In the practice of organizing single-candidate elections, several cases have been exposed to the public, which suggests that there were problems before the single candidate was decided. This study describes the various phenomena that arise in the organization of single-candidate elections and formulates appropriate structuring strategies. This research was normative and sociological legal research. Normatively using a statute approach and case approach, while sociologically using a qualitative approach. Several phenomena were found, namely; the increasing support of political parties for single candidate is due to the pragmatic political parties that are oriented towards victory and instant profit (political dowry), resulting in a large financial burden that must be prepared by prospective candidates. This condition is exceptionally favorable for candidates with sufficient financial capabilities which then motivates political parties to smooth the victory. Appropriate structuring measures are needed, including; first, the need to reduce the nomination threshold for political parties. Second, organizing party coalitions both related to the time of formation and the maximum limit of the coalition, and third, tightening the eligibility requirements for single candidate by considering the level of voter turnout.

Abstract

This research aims to explain the legal politics and success of moving the capital city of the Republic of Indonesia from Java to Kalimantan in maintaining state sovereignty. The data used in this research comes from literature in the form of print and electronic media. The results show that the relocation of the Indonesian National Capital is a strategic step based on a strong legal basis, consensus between government institutions, and participation of people's representative institutions in responding to the development of increasingly complex threats, including non-military threats involving various aspects. In this effort, integration with the concept of sishankamrata, involving intelligence, defense, security, and cyber components, supported by the principles of constitutionalism, checks and balances, and participation across state institutions is important to maintain harmony in Indonesia's constitutional system. While the relocation of the capital city is an ambitious move with significant impacts on defense, the economy and the constitution, the government's steps taken to date reflect a determination to ensure success and constitutional sovereignty in this process. The success of the new capital city in safeguarding the country's sovereignty relies heavily on careful implementation, good inter-agency coordination, and transparency in the use of public resources, with the need for further evaluation as the move nears full implementation, especially in the case of the new capital city.

Abstract

The mandate of Article 29 paragraph (2) of Law No.2/2008 requires that the recruitment of candidates for regional head/deputy regional head by political parties must be carried out in a democratic and open manner. However, the arrangement and implementation are left to each political party. This study analyzes the problem of recruitment of regional head candidates by political parties in a democratic and open manner which then provide ideas as alternative solutions. This research is normative legal research with a statute approach. The theory of democracy is used as a qualitative analysis guide and is presented descriptively. The results of this study conclude that the recruitment of prospective regional head/deputy regional head candidates, whose arrangements and implementation are left to political parties, tends to be carried out in an undemocratic and not open manner. Political parties tend to do so exclusively at the party elite level. Even though at the regional level a selection of prospective candidates was carried out by several political parties, the final decision was determined by the leadership at the central level. In addition, the pattern of recruitment is also very vulnerable to money politics. This is because political parties have full authority in recruiting prospective regional head candidates, so that they are not covered by The General Election Supervisory Agency (Bawaslu) and General Election Commissions (KPU) supervision. In the future, improvements need to be made so that arrangements regarding the recruitment of prospective regional head/deputy regional head candidates are strictly regulated in the Regional Head Election Law (Pilkada Law), not in the statutes of each political party.
