Abstract

The potential for Waqf in Indonesia is huge, as in the case of Muna Regency. This research explains the problems of Waqf in the Muna cultural approach. The aim is to analyze the problems of waqf institutions in a religious and cultural context. The research method used is qualitative, and it looks at the unique cultural paradigm in waqf land management. This research source uses primary data by conducting interviews with the main actors of Waqf, traditional leaders, religious leaders, and leaders of religious institutions. Secondarily, data is obtained from sources or other supporting parties related to the research object, such as reference books, monographs, proceedings, research reports, and journals. The researcher offers a Waqfnomic Model, namely Economic-Cultural Waqf or culture-based Waqf, whose implementation involves traditional and religious leaders and can be displayed online using information technology, making it more millennial, simple, and easy to access. Access is right on target and legally friendly.

Abstract

This article discusses the implementation of the eco-metaverse in Indonesia, with a focus on the economic aspects of the metaverse. This article begins by providing an overview of the metaverse concept and its potential impact on various sectors, including education, commerce, and entertainment. Then, this article examines the principles of metaverse economics, such as the concepts of values, principles and norms, and how these concepts can be applied in the context of the metaverse. This research uses a qualitative research paradigm with a sharia economic approach. Data and information were collected through interviews, literature studies and focus group discussions (FGD). The condition of the eco-metaverse in Indonesia has begun to develop, although it is not yet running optimally. Several ways of using the Metaverse that can be considered in the context of sharia economics are Education and Knowledge, Communication and Empowerment, Economics and Business, and Socio-Cultural Life. Eco-metaverse development can be carried out through the waqf and syirkah application model on the sharia banking platform in the metaverse. Apart from that, another model being developed is a platform for selling MSME products through metverse where sellers and buyers can interact directly virtually. Based on the results and discussion in this research, it is highly recommended to; Explaining sharia-based eco-metaverse applications. There is a need for sharia-based eco-metaverse education, so that more and more people build or join the eco-metaverse. In implementing a sharia-based eco-metaverse, institutions are needed that oversee the consistent application of sharia principles in a transparent and interconnected eco-metaverse.

Abstract

This study aims to determine the perceptions of employees of the BNI Syariah BankBranch of Kendari regarding the concept of al-Ibrah, as well as to investigate theexistence of Al-Ibrah it has been implemented or not. Sharia Commercial Banks in Indonesia are growing promising in the future. Thirteen Sharia Commercial Banks have been recorded. But there is one action that is not yet familiar to do, which is doing Al-Ibrah or bleaching of receivables. BNI Syariah Branch employees still have a cross opinion about this concept. This action is actually legally guaranteed through the DSN-MUI Fatwa No. 47 / DSN-MUI / II /2005 concerning Settlement of Murabahah Receivables for Customers Who Are Not Able to Pay. Kendari Branch BNI Syariah as part of the Sharia Commercial Bank is not in a position to reject the existence of Al-Ibrah, but to avoid it from the outset the principle of caution has been applied in offering financing products through Musyarakah, Mudharabah, Murabahah, Istishna, or borrowing through Qardh

Abstract

Artikel ini bertujuan untuk mengetahui praktik dominasi murtahin terhadap rahin pada praktik gadai sawah di Desa Anggohu Kecamatan Tongauna Kabupaten Konawe. Kajian ini memfokuskan pada bentuk dan motif dominasi murtahin terhadap rahin pada praktik gadai sawah di Desa Anggohu Kecamatan Tongauna Kabupaten Konawe. Serta bagaimana tinjauan hukum Islam terhadap praktik dominasi murtahin kepada rahin dalam praktik gadai sawah di Desa Anggohu Kecamatan Tongauna Kabupaten Konawe. Lahan atau persawahan di masyarakat tidak hanya berfungsi sebagai aset produktif, tetapi juga berfungsi sebagai komoditas yang dapat ditransaksikan seperti jual beli, sewa, pinjam meminjam, sesuai dengan kebutuhan masyarakat yang seringkali menimbulkan berbagai permasalahan dalam praktiknya. Pelaksanaan praktik gadai sawah yang dilaksanakan di Desa Anggohu Kecamatan Tongauna Kabupaten Konawe tersebut belum memenuhi rukun dan syarat akad gadai secara sempurna, dan belum mencapai rukun dan syarat keabsahan akad yang dijelaskan dalam hukum Islam. Dalam praktik gadai sawah tersebut ditemukan bentuk eksploitasi yang dijelmakan dalam bentuk dominasi atau pengusaan secara fisik dan non fisik dari pihak yang memilki kekuasaan dalam modal (kapital), dengan tujuan pemanfaatan objek gadai oleh murtahin. Dalam pelaksanaannya mensyaratkan adanya imbalan jasa maupun bentuk-bentuk yang dapat menimbulkan kerugian salah satu pihak. Setelah dikajian dan analisis melalui hukum bisnis Islam hal tersebut tidak diperbolehkan meskipun hasil yang diperoleh hanya sedikit saja, karena dalam pengambilanya bermaksud untuk menarik manfaat yang dapat menguntungkan yang berlipat ganda serta merugikan sebelah pihak. Jumhur ulama’ memperbolehkan mengambil manfaatnya, akan tetapi hanya sekedar pengganti dari biaya pemeliharaan dan penyimpanan, karena apabila kegiatan pinjam-meminjam mensyaratkan adanya pengambilan manfaat dapat dikategorikan sebagai riba.
