<![CDATA[ABSTRACT The under cover buy technique is a special technique in the process of investigating narcotics crimes, where this technique plays a role in reconnaissance of suspected perpetrators of narcotics crimes and collecting evidence of narcotics crimes. This under cover buying technique can only be carried out by members of the Police from the Directorate of Drug Investigation, the Narcotics Investigation Unit, and members of the National Narcotics Agency (BNN). To carry out the under cover buy technique, every member of the Police from the Directorate of Drug Investigation, the Narcotics Investigation Unit, as well as members of the National Narcotics Agency must receive a warrant from their superiors. In practice, this under cover buy technique is also carried out by members of the Police from the Directorate of Narcotics Investigation of the West Kalimantan Regional Police in uncovering narcotics crimes because they greatly influence the uncovering of narcotics crimes. However, in fact, the use of the under cover buy technique by members of the National Police from the West Kalimantan Regional Police Narcotics Investigation Directorate has not been effective.The formulation of the problem in this study is: "Why is the Use of Under Cover Buy Techniques by Police Members at the Directorate of Narcotics Investigation of the West Kalimantan Regional Police in Exposing Narcotics Crimes Not Yet Effective?". While the aim of the study was to reveal the factors causing the ineffectiveness of the use of under cover buy techniques by members of the National Police at the West Kalimantan Regional Police Narcotics Investigation Directorate in uncovering narcotics crimes and the efforts made by the West Kalimantan Police Narcotics Investigation Directorate to make purchasing techniques effective. narcotics covertly (under cover buy) by members of the National Police at the Directorate of Narcotics Investigation of the West Kalimantan Regional Police in uncovering narcotics crimes. The legal research method used by the author is an empirical legal research method with a descriptive research nature.Based on the results of the research, it can be concluded that the causal factors for the ineffective use of under cover buy techniques carried out by them in uncovering narcotics crimes are because the perpetrators of narcotics crimes know their identity as members of the National Police who buy narcotics and the risks they face in purchasing narcotics under cover buy is very high. Efforts made by the Directorate of Narcotics Research of the West Kalimantan Police to streamline the technique of buying narcotics under cover by members of the National Police at the Directorate of Narcotics Research of the West Kalimantan Police in uncovering narcotics crimes by using the services of informants outside the Police, for example Kendall or Cepu who is a former Narcotics dealers who used to have frequent contact with narcotics distribution networks/syndicates, so that it was easier for Kendall or Cepu to enter into the narcotics distribution network/syndicate and were not suspected by those in the narcotics distribution network/syndicate. A B S T R A K Teknik pembelian terselubung (under cover buy) adalah suatu teknik khusus dalam proses penyelidikan terhadap tindak pidana narkotika, dimana teknik ini berperan dalam pengintaian terhadap terduga pelaku tindak pidana narkotika dan pengumpulan barang bukti tindak pidana narkotika. Teknik pembelian terselubung (under cover buy) ini hanya dapat dilakukan oleh anggota Kepolisian dari Direktorat Reserse Narkoba, Satuan Reserse Narkoba, dan anggota Badan Narkotika Nasional (BNN). Untuk melakukan teknik pembelian terselubung (under cover buy), setiap anggota Kepolisian dari Direktorat Reserse Narkoba, Satuan Reserse Narkoba, maupun anggota BNN harus mendapat surat perintah dari pimpinannya. Dalam prakteknya, teknik pembelian terselubung (under cover buy)ini juga dilakukan oleh anggota Kepolisian dari Direktorat Reserse Narkoba Polda Kalbar dalam mengungkap tindak pidana narkotika karena sangat mempengaruhi dalam mengungkap tindak pidana narkotika. Namun faktanya, penggunaan teknik pembelian narkotika secara terselubung (under cover buy) yang dilakukan oleh anggota Polri dari Direktorat Reserse Narkoba Polda Kalbar masih belum efektif.Rumusan masalah dalam penelitian ini adalah: “Mengapa Penggunaan Teknik Pembelian Narkotika Secara Terselubung (Under Cover Buy) Oleh Anggota Polri di Direktorat Reserse Narkoba Polda Kalimantan Barat Dalam Mengungkap Tindak Pidana Narkotika Belum Efektif ?”. Sedangkan tujuan penelitian adalah untuk mengungkapkan faktor penyebab belum efektifnya penggunaan teknik pembelian narkotika secara terselubung (under cover buy) oleh anggota Polri di Direktorat Reserse Narkoba Polda Kalimantan Barat dalam mengungkap tindak pidana narkotika dan upaya yang dilakukan Direktorat Reserse Narkoba Polda Kalimantan Barat untuk mengefektifkan teknik pembelian narkotika secara terselubung (under cover buy) oleh anggota Polri di Direktorat Reserse Narkoba Polda Kalimantan Barat dalam mengungkap tindak pidana narkotika. Metode penelitian hukum yang digunakan penulis adalah metode penelitian hukum empiris dengan sifat penelitian deskriptif.Berdasarkan hasil penelitian, maka diperoleh kesimpulan bahwa faktor penyebab belum efektifnya penggunaan teknik pembelian terselubung (under cover buy) yang dilakukan oleh mereka dalam mengungkap tindak pidana narkotika dikarenakan pelaku tindak pidana narkotika mengetahui identitas mereka sebagai anggota Polri yang melakukan pembelian narkotika dan risiko yang dihadapi mereka dalam melakukan pembelian narkotika secara terselubung (under cover buy) sangat tinggi. Upaya yang dilakukan Direktorat Reserse Narkoba Polda Kalbar untuk mengefektifkan teknik pembelian narkotika secara terselubung (under cover buy) oleh anggota Polri di Direktorat Reserse Narkoba Polda Kalbar dalam mengungkap tindak pidana narkotika dengan cara menggunakan jasa informan di luar Kepolisian, misalnya kendal atau cepu yang merupakan mantan pengedar narkotika yang dulunya sering berhubungan dengan jaringan/sindikat peredaran narkotika, sehingga kendal atau cepu ini lebih mudah untuk masuk ke dalam jaringan/sindikat peredaran narkotika dan tidak dicurigai oleh orang-orang yang berada di dalam jaringan/sindikat peredaran narkotika tersebut.
