Abstract

Transportasi memiliki peranan yang sangat penting untuk perpindahan setiap orang dari satu tempat ke tempat yang lain. Jasa transportasi yang paling banyak memberikan keunggulan adalah jasa transportasi udara antara lain jangkauan yang luas, waktu tempuh yang relatif singkat serta tarif yang dapat dijangkau oleh masyarakat. Namun, seiring dengan perkembangan jaman masalah transportasi udara pun mulai timbul salah satunya adalah keterlambatan penerbangan yang diakibatkan oleh faktor cuaca ataupun kesalahan dari pihak pengangkut.Dari hasil penelitian yang didapat, dalam pelaksanaan tanggung jawab maskapai Lion Air kepada penumpang atas keterlambatan penerbangan, pihak masakapai berpedoman pada ketentuan Ordonanasi Pengangkutan Udara (Stbld.1939-100) serta Peraturan Menteri Nomor 77 Tahun 2011 dan Peraturan Menteri Nomor 25 Tahun 2008. Dalam mekanisme pemberian ganti kerugian pihak maskapai mengacu pada ketentuan-ketentuan yang dimuat dalam tiket penerbangan dan dalam ketentuan jaminan asuransi penerbangan serta mengacu pada Peraturan Menteri Nomor 77 Tahun 2011 dan Peraturan Menteri Nomor 25 Tahun 2008.

Abstract

A notary is a public official who has the authority to make an authentic deed. A notary deed is an authentic deed and has perfect evidentiary power. An authentic deed contains the legal actions of the parties that have been agreed upon and without coercion from any party. Often an authentic deed contains a false statement from the parties to seek profit from that party. Method The approach used in the preparation of this journal is a Normative Juridical approach. The specification of this research is Analytical Descriptive. From the results of the research, it was found that, First, the notarial deed has been drawn up by the outward, formal, and material aspects, the deed must be considered valid and binding on the parties, second, there are no specific regulations governing legal protection for a notary, only contained in Article 66 UUJN. Abstract

Marriage in Batak traditional society is a sacred tradition and its implementation must adhere to the rules established by the ancestors. In Batak customs, intermarriage within the same clan is considered as incest, which is prohibited by Law No. 1 of 1974 concerning marriage. The legal requirement for a valid marriage is that it must be conducted according to the laws of each respective religion and belief system. The research journal utilizes a Normative Juridical approach, and the study is of a Descriptive Analytical nature. The research findings indicate that firstly, intermarriage within the same clan in Batak traditional society is considered valid and not prohibited by marriage laws. This is because intermarriage within the same clan does not fall under the category of incest as prohibited by Article 8 of the marriage laws. Secondly, if intermarriage within the same clan is still conducted, the customary legal consequence in Batak society is that the marriage is considered invalid, and there are customary sanctions that will be imposed if the intermarriage persists. However, from a national legal perspective, there are no clearly defined sanctions in the marriage laws for intermarriage or incestuous relationships.
