Abstract

Background: Aceh is the only Indonesian province authorized to translate Islamic religious norms into binding regional legislation through qanun. Existing scholarship has largely examined qanun as an instrument for implementing Islamic law and has focused on the legal basis of Aceh’s authority. Less attention has been given to how this differentiated regulatory authority is controlled and how its relationship with Indonesia’s national legal system has evolved.  Methods: This study employs normative legal research using statutory, case, and conceptual approaches. It analyses the legal framework governing Aceh’s special autonomy, particularly the Aceh Governance Law, Law No. 1 of 2023, and relevant decisions of the Constitutional Court and Supreme Court concerning the formation, review, and substance of qanun.  Key Findings: The study finds that Article 235(4) of the Aceh Governance Law initially placed qanun concerning the implementation of Islamic law in a distinctive position by limiting their annulment to judicial review by the Supreme Court. Following the Constitutional Court’s removal of the executive’s authority to annul regional regulations, this procedural distinction between Aceh and other regions diminished. Judicial review of qanun, however, has remained limited, with Supreme Court Decision No. 60 P/HUM/2015 constituting a significant example concerning the Qanun Jinayat. The implementation of the 2023 Criminal Code also presents a further challenge concerning the substantive relationship between Aceh’s qanun and national criminal law.  Contributions: This study contributes to the literature by reframing the analysis of Aceh’s legal exceptionalism from the question of legislative authority to the relationship between differentiated regulatory substance and mechanisms of legal control. It demonstrates that Aceh’s distinctiveness cannot be adequately explained by its review mechanism alone, particularly after the convergence of regional regulatory control mechanisms.  Conclusion: Aceh’s special legal status is best understood as differentiated regulatory authority within Indonesia’s unitary legal system rather than as a separate legal order. Its continuing distinctiveness therefore depends primarily on the substantive scope of qanun and their compatibility with the national legal framework.

Abstract

Background Study: Law Number 16 of 2019 sets the minimum marriage age at 19 years while permitting dispensation under Article 7(2) in urgent circumstances. However, the absence of clear substantive criteria risks transforming this exception into a routine practice. Methods: This normative legal study applies statutory, case, and conceptual approaches. It examines relevant legislation, Constitutional Court Decision Number 22/PUU-XV/2017, Supreme Court Regulation Number 5 of 2019, the Compilation of Islamic Law, a court ruling, and marriage dispensation data from the Religious Courts Agency. Funding: The study received no specific funding and was independently conducted using publicly available legal materials, literature, and case data. Contribution: The study argues that the central problem lies not in the 19-year age threshold but in the weak substantive standards for granting dispensation. It reconstructs maqasid al-shari'ah from an explanatory framework into a tiered assessment instrument comprising four elements: qualification of urgent circumstances, assessment of less harmful alternatives, five domains of readiness as evidentiary criteria, and safeguards for the continuity of children's education. Conclusion: Marriage dispensation remains necessary as an exception but requires clear substantive thresholds to prevent it from becoming a parallel rule. This framework offers a more operational basis for adjudication. Further empirical research should examine more rulings and involve judges, children, parents, and other stakeholders.

Abstract

Background Study: Buy Now Pay Later (BNPL) has rapidly become a major consumer financing mechanism in Southeast Asia, creating regulatory challenges for both state and Shariah authorities. Although previous Islamic legal scholarship has primarily assessed BNPL through contract classification and the prohibitions of riba, gharar, and maysir, limited attention has been paid to how institutional authority determines the normative and regulatory force of Shariah principles. This study addresses this gap through a comparison of Indonesia and Malaysia. Methods: Employing a normative juridical methodology, this study combines comparative, statutory, and conceptual approaches. The analysis draws on classical fiqh literature, MUI and DSN-MUI fatwas, the Compilation of Sharia Economic Law, AAOIFI Shariah standards, Indonesian financial regulations, and Malaysia’s statutory and policy frameworks governing Shariah governance and consumer credit. Key Findings: The findings reveal an authority disarticulation in Indonesia, where Shariah norms face institutional discontinuity when BNPL providers lack Shariah Supervisory Boards. State regulation consequently operates mainly through consumer protection and prudential mechanisms. Malaysia demonstrates a more integrated statutory architecture, although substantive Shariah concerns remain, particularly regarding tawarruq-based BNPL structures. Contribution: This study contributes the concept of authority disarticulation, distinguishes formal from substantive Shariah compliance, and develops a four-dimensional framework for analyzing Shariah authority design. Conclusion: The study proposes a two-track codification model combining universal behavioral standards for all BNPL providers with Shariah-specific labeling and certification. Such integration is necessary to align normative authority, regulatory enforcement, and consumer protection while preserving the substantive integrity of Shariah-compliant BNPL products.

Abstract

Background Study: This study examines the legal vacuum in Regional Regulation of Pekalongan Regency Number 3 of 2023 concerning the Facilitation of Pesantren Development in relation to Law Number 18 of 2019 concerning Pesantren. The primary concern is the absence of provisions governing the position, duties, coordination, and funding of the Majelis Masyayikh, which plays a crucial role in pesantren quality assurance. Methods: This study employs a normative juridical method using statutory, conceptual, and comparative approaches. It analyzes relevant legislation, secondary legal materials, and compares Pekalongan Regency Regulation with West Bandung Regency Regulation Number 5 of 2022 and Grobogan Regency Regulation Number 1 of 2023. Key Findings: The findings reveal a legal vacuum (rechtsvacuum/al-faragh al-tasyri‘i) in the Pekalongan Regency Regulation due to its inadequate accommodation of the Pesantren Law's mandate concerning the Majelis Masyayikh, quality assurance, institutional coordination, and funding. These omissions undermine legal certainty, weaken institutional coordination and quality oversight, and potentially widen disparities in pesantren educational quality. Contribution: This study integrates regulatory harmonization, the distribution of authority from the perspective of siyasah dusturiyah, and substantive evaluation through maqasid al-shariah. It proposes regulatory reconstruction addressing the institutional position and coordination of the Majelis Masyayikh, funding mechanisms, community participation, and quality assurance monitoring and evaluation. Conclusion: Regional Regulation of Pekalongan Regency Number 3 of 2023 has not fully operationalized the Pesantren Law's mandate. Regulatory harmonization and reconstruction are necessary to ensure that pesantren facilitation extends beyond administrative support to effective quality assurance and the realization of public welfare and the common good.
