Abstract

Pasal 1338 ayat (1) KUHPer mengatakan semua perjanjian yang dibuat oleh kedua belah pihak atau lebih menjadi sah dan berlaku selayaknya undang-undang bagi yang membuatnya. Perjanjian yang dibuat oleh semua masyarakat menjadi hak dan kebebasan bagi masyarakat untuk membuat kesepakatan, denga tetap megacu pada aturan dan undang-undang yang berlaku.  Di dalam penelitian ini penulis menggunakan adalah metode yuridis normatif, yaitu menggunakan data sekunder dan mempelajari kajian pustaka berupa literatur-literatur, teori-teori hukum, data-data tertulis, dokumen ilmiah, serta peraturan-peraturan perundang-undangan. Sedangkan teknik analisis yang digunakan analisis deskriptif normatif kualitatif. Penelitian yang memiliki acuan pada norma hukum yang terdapat dalam berbagai peraturan perundang-undangan, serta jurnal-jurnal hukum yang berkaitan dengan pokok bahasannya, dikenal dengan penelitian yuridis normatif kualitatif. Analisis tersebut kemudian disusun secara sistematis dan dituangkan dalam bentuk kata-kata. Dalam Putusan No. 321/Pdt.G/ Pn.Jkt.Pst disebutkan bahwa PT. Bank Jtrust Indonesia, Tbk. melakukan perbuatan cidera janji (wanprestasi) dengan tidak melaksanakan kewajibannya berdasarkan akta-akta perjanjian pembiayaan bersama sehingga membuat PT. Group Lease Finance Indonesia melayangkan gugatan ke pengadilan negeri jakarta pusat untuk meminta pertanggungjawaban untuk perbuatan melawan hukum yang telah dilakukan oleh tergugat.

Abstract

The protection of heirs' rights to inherited assets that fall under general bankruptcy proceedings has become a significant legal issue in Indonesia. Under the Indonesian legal system, heirs are entitled to receive the inheritance of a decedent. However, this right is often hindered when the inherited assets are included in the bankruptcy estate (boedel pailit) to settle the debts of the deceased. This study employs a normative legal research methodology. Based on the findings, the Bankruptcy Law and the Indonesian Civil Code (KUHPerdata) provide a legal basis for heirs to safeguard their rights, including through the mechanism of beneficium inventarii. Nonetheless, the implementation of this protection faces several challenges, such as limited legal awareness, complex legal procedures, and the lack of consistent jurisprudence. Through an analysis of regulations and Supreme Court decisions, such as Case Number 3471 K/Pdt/2023, this study highlights the need for harmonization between inheritance and bankruptcy laws, as well as the simplification of legal procedures to ensure the protection of heirs' rights without undermining the principle of paritas creditorum. Legal education, the development of consistent jurisprudence, and collaboration among stakeholders are identified as strategic steps to achieve a balance between creditors' interests and heirs' rights.

Abstract

This study aims to analyze legal certainty as a guarantee of protection for the plaintiff’s righs in cases of breach of contact in property sales transactions. Breach of contract in property sales often involves diputes that can cause financial and legal harm to the plaintiff. Therefore, it is important to undertstand how legal certainty can play a role as a mechanism for protecting the plaintiff’s rights in the resolution of such disputes. This research examines the application of positive law, particularly regulations related to property sales and breach of contract, as well as legal remedies available to the aggrieved party. The approach used in this research is a normative approach, analyzing laws, regulations, and relevant jurisprudence. The findsings of the study show that although there is a clear legal framewrok governing the rights of the study show that although there is a clear legal framwork governing the rights and obligations of parties in property sales transactions, there are still gaps in the implementation of legal certainty that may hinder the protection of the plaintiff’s rights. Therefpre, there is a need for legal reforms and more assertive law enforcement to ensure that legal certainty can provide optimal protection for the aggrieved party in breach of contract cases.

Abstract

Land disputes are legal issues that arise due to conflicts or clashes of interest among parties concerning the control, use, or ownership of land. These disputes have become an inevitable issue in modern society, particularly given the increasing demand for land driven by population growth, urbanization, and economic development. The research method employed in this study is normative juridical, which focuses on the examination of library materials or secondary data. This data includes documents, legislation, and various literatures relevant to the legal topic or issue under investigation. Land disputes often stem from differing interpretations regarding the legal status of certain parcels of land, particularly concerning ownership and usage rights. Several primary factors triggering land disputes can be summarized as follows: (1) The lack of proper land administration in the past; and (2) Structural imbalances in land control and ownership. Efforts to resolve legal issues related to land disputes are explicitly regulated under Presidential Regulation No. 20 of 2015 concerning the National Land Agency (Badan Pertanahan Nasional or BPN). Specifically, Article 3 clauses (3) and (4) of this regulation mandate the Head of the National Land Agency to formulate and implement policies in several strategic areas. The resolution of land disputes is generally pursued through legal means by bringing the case to court. Additionally, land disputes may also be resolved through negotiation or mediation, which offers several advantages compared to judicial proceedings. One of the primary benefits of resolution through negotiation is the efficiency in terms of time, cost, and effort required. The aim of the research conducted by the author is to identify the causative factors and resolution efforts concerning land ownership disputes.
