Haryono No. 169 Malang e-mail: eltafaa@student.ub.ac.id Abstrak Selama ini penyelenggara e-health hanya berpedoman pada beberapa aturan yaitu perlindungan konsumen, perlindungan data pribadi dan telemedicine saja. Indonesia masih belum memiliki aturan secara komprehensif dan terkhusus mengenai e-health maupun perlindungan data konsumen pengguna layanan tersebut. Berdasarkan hal itu, penulis bertujuan menganalisis dengan mengangkat rumusan masalah yaitu: (1) Bagaimana perlindungan hukum bagi konsumen sebagai pengguna layanan kesehatan oleh platform penyelenggara e-health dalam melindungi data kesehatan konsumen di Indonesia? (2) Bagaimana pengaturan terbaik mengenai perlindungan hukum bagi konsumen pengguna platform layanan e-health terkait standar pengamanan khusus bagi data kesehatan di Indonesia? Penulisan skripsi ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan, pendekatan konseptual dan pendekatan perbandingan. Dari hasil tersebut, penulis memperoleh bahwa ketidaklengkapan pengaturan mengenai e-health ditunjukkan dengan belum adanya aturan mengenai e-health secara khusus, terlebih mengenai data kesehatan milik konsumen. Platform penyelenggara e-health hanya berpedoman pada aturan perlindungan konsumen, perlindungan data pribadi, dan telemedicine. Maka dibutuhkan pengaturan yang khusus mengatur mengenai hal tersebut. Pengaturan terbaik mengenai perlindungan hukum bagi konsumen layanan e-health terkait standar pengamanan khusus bagi data kesehatan di Indonesia dapat merujuk pada aturan milik Amerika Serikat yang tercantum pada Security Rule dalam Code of Federal Regulation 2013 yang berisikan beberapa standar pengamanan seperti administrative, physical, dan technical safeguard. Namun perlu dikaji terlebih dahulu mengenai hubungan hukum bagi para pihak yang terlibat dalam layanan e-health yakni platform penyelenggara, konsumen, serta dokter. Kata Kunci: e-health, perlindungan hukum, konsumen, data kesehatan Abstract E-health has been based on several regulations concerning consumer protection, personal data protection, and telemedicine. Indonesia, however, does not have any overarching regulations concerning e-health and the protection of the personal data of consumers as service users. Departing from this issue, this research aims to investigate (1) the legal protection of consumers as e-health users by the e-health platform in protecting the data of the consumers in Indonesia and (2) the best regulation regarding legal protection for consumers as e-health platform users in the case of the standard of special security of health data in Indonesia. This research employs a normative-juridical method and statutory, conceptual, and comparative approaches. The research result reveals that this regulatory incompleteness is marked by the absence of specific regulations governing e-health, especially regarding the health data of users. So far, the platform providing e-health has only referred to the regulations concerning consumer protection, personal data protection, and telemedicine. This indicates that a specific regulation is required to govern the issue by referring to the regulations that apply in the USA, specifically in Security Rule in Code of Federal Regulation 2013 which regulates security standards including administrative, physical, and technical safeguard. It is also essential to first analyze the legal connection for the sake of all parties involved in e-health services such as the platform, consumers, and doctors.
