Abstract

Ajaran agama Islam mengajarkan bahwa kita hidup agar saling menjaga perasaan dan kenyamanan antar sesama manusia agar tercapai kedamaian di muka bumi ini. Salah satu perbuatan yang dilarang adalah bertindak zalim, yang bisa merugikan orang lain karena seseorang merampas hak orang lain. Salah satu perbuatan zalim yang muncul belakangan ini adalah adanya Citayam Fashion Week, dimana hal tersebut merupakan fashion show yang diadakan di zebra cross, dimana orang banyak berlalu-lalang sehingga kegiatan tersebut akan mengganggu orang yang berkendara. Di dalam tulisan ini akan mengkaji hal yang esensial bagaimana hukum Islam meninjau fenomena Citayam Fashion Week tersebut digunakan yuridis normatif dengan menggunakan metode pendekatan Al – Qur’an dan kasus. Penelitian ini akan melibatkan studi literatur terkait hukum Islam, prinsip-prinsip keadilan sosial, dan nilai-nilai moral dalam Islam. agar memperoleh pandangan yang komprehensif tentang Citayam Fashion Week Hasil penelitian ini diharapkan dapat memberikan kontribusi dalam upaya menjaga ketertiban umum dan merumuskan panduan etis bagi pelaksanaan ajang fashion show dalam konteks Islam. Dari hal tersebut diperoleh bahwa fenomena yang dibuat oleh remaja tersebut dapat dilarang karena dapat menjadi sebuah kezaliman terhadap pengguna jalan lain karena mengganggu lalu lintas, tindakan tersebut dapat membahayakan diri sendiri dan orang lain, mengganggu ketertiban umum, membuat lingkungan kotor karena membuang sampah tidak pada tempatnya dan menggunakan pakaian yang tidak sesuai syariat islam

Abstract

The number of street crimes involving teenagers and children by the perpetrators requires effective preventive measures. This research aims to analyze the urgency of using criminal law theory and social control to prevent street crime crimes. Data sources are reviewed and analyzed through literature study, and the research method used is normative forensics. This research identifies relevant data sources such as criminal law theory and social control theory that are relevant to the prevention of street crime klitih committed by teenagers. This research identifies data sources related to criminal law theory and social control theory related to criminal behavior in overcoming street crime. The collected data were analyzed to understand the existing legal basis for street crime prevention and to understand the impact of criminal law and social control theory on the prevention of such crimes. The results of this study show that criminal law plays an important role in preventing street crime. Criminal law provisions relating to street crime, including criminal offenses, sanctions and related legal processes, can act as a deterrent and provide protection to the community. Furthermore, social control theory also plays an important role in the prevention of these crimes by involving social institutions, families, schools, and communities in controlling the behavior of adolescents and children.

Abstract

In Indonesia, social media's pervasive influence has led to the emergence of online prostitution, presenting complex challenges for law enforcement and criminal justice. Unlike traditional forms, online prostitution operates discreetly on digital platforms, complicating regulation and enforcement efforts. The research in this article uses normative legal research methods.  This research examines the socio-cultural, legal, and technological dimensions of this phenomenon, assessing the adequacy of existing legal frameworks and the efficacy of cyberpatrol units in addressing it. Insights aim to inform policy and law enforcement strategies to combat social media-based online prostitution effectively. The result of this research is the intersection of online prostitution and social media platforms presents a complex interplay between technology, commerce, and societal norms within digital environments. Leveraging the communicative potential of social media, individuals discreetly engage in commercial sex work, navigating a dynamic ecosystem that transcends geographical boundaries to create a global marketplace for commercial sexual services. Multimedia elements and specialized terminology tailored to the online sex industry augment the visibility of commercial sexual offerings and facilitate transactional negotiations. However, regulatory frameworks have not effectively addressed the challenges posed by online prostitution, creating a legal vacuum that hinders comprehensive law enforcement. This underscores the critical role of law enforcement agencies, such as the Cyber Police, in combating illicit activities in the digital sphere. By adopting a proactive and data-driven approach informed by social media analytics, law enforcement agencies can optimize their surveillance and intervention strategies to effectively combat online prostitution, safeguard vulnerable individuals, and uphold the integrity of digital platforms. Through continuous collaboration, capacity building, and innovative strategies, law enforcement agencies can mitigate the proliferation of cyber threats and ensure the safety and security of digital communities.

Abstract

Bullying is not a new phenomenon; even today, it frequently occurs in both societal and school environments. Bullying encompasses not only physical violence but also verbal and psychological abuse. The aim of this research is to explore the objective conditions of legal protection for bullying victims in junior high schools in the Yogyakarta region. The research questions are: How does the school provide legal protection for bullying victims? What are the obstacles faced by schools in offering legal protection to children who are victims of verbal and physical bullying? This research is classified as empirical legal research, employing both sociological and normative approaches. This data was collected through literature review and field studies, including interviews with relevant sources. The results of this study produce data that forms of bullying can be categorized into three types: physical, verbal, and psychological. The legal protection that schools can offer to bullying victims includes preventive measures such as prevention, and responsive measures involving consequences, punishments, or sanctions.

Abstract

Supervision of Civil Servants as a Preventive Measure Against Corruption at Customs Agencies The focus of this study is on the preventive measures implemented by Customs agencies to combat corruption and the challenges faced in these efforts, particularly regarding cases of corruption involving individual employees. This research employs a conceptual approach, a method of legal analysis that assesses whether the applied legal concepts align with their foundational principles. Customs agencies undertake various preventive measures to prevent corruption, including internal control monitoring, employee supervision, gratification control programs, strengthening employee integrity, assistance with facility disclosures, and enforcement of internal compliance. To enhance integrity and prevent corruption violations, Customs collaborates and works with various parties. The obstacles to preventing corruption at Customs are not due to incorrect application or lack of evaluation. Instead, the primary issue lies with individual corruption cases, specifically gratification, which is carried out personally without involvement from other parties or agencies.

Abstract

This article investigates the legal implications of necrophilia within the framework of Islamic law, specifically addressing whether such acts can be categorized as zinā ‘adultery’. The primary aim of this research is to analyze how Islamic teachings interpret and regulate sexual relations with deceased individuals, with a focus on the fundamental principles of human dignity and sanctity. Utilizing a qualitative method alongside a case study approach, this study involves a comprehensive review of Islamic texts, legal cases, and scholarly interpretations. The data sources encompass Islamic literature, the Qur'an, Hadith, and legal references, including scientific journals and academic books. The theoretical framework is anchored in the concepts of maqāşid syarī’ah, particularly the preservation of religion ‘ḥifẓ al-dīn’, intellect ‘ḥifẓ al-aql’, and life ‘ḥifẓ al-nafs’. The findings indicate that necrophilia is regarded as a serious violation under Islamic law, representing a breach of both moral and legal standards, which results in stringent penalties. In conclusion, this study underscores the importance of upholding the dignity of the human body after death, as mandated by Islamic law. This research contributes by clarifying how Islamic law addresses necrophilia and reinforcing societal norms related to the sanctity of life and death.

Abstract

This article critically examines the emerging practice of swinger relationships in Indonesia, analyzing its legal implications under both Indonesian criminal law and Islamic criminal law. The primary objectives are to investigate the divergent regulatory frameworks concerning adultery in the context of consensual non-monogamous relationships within Indonesian criminal law and Islamic law, the sanctions prescribed by the Indonesian Criminal Code and Islamic ḥudud law; and the scope and nature of legal protections afforded to individuals engaged in swinger practices. Employing a qualitative research design with a phenomenological approach, this study analyzes primary sources such as the Indonesian Criminal Code (KUHP) and classical Islamic jurisprudence texts, alongside secondary sources comprising scholarly articles, legal commentaries, dissertations, and expert opinions. Data collection was conducted through a systematic literature review. The findings underscore fundamental distinctions between the secular orientation of Indonesian criminal law, which criminalizes adultery only when involving at least one legally married party and requires a formal complaint for prosecution, and the religiously anchored Islamic criminal law, which categorizes zina as a ḥudud offense with fixed divine penalties and stringent evidentiary standards. Legal protections under Indonesian law emphasize procedural safeguards and due process rights to prevent arbitrary prosecution, whereas Islamic law prioritizes the protection of individual honor (ḥifẓ al-‘irḍ) and social morality through rigorous evidentiary requirements and the prohibition of false accusations (qazf). Notably, Islamic legal provisions demonstrate substantive justice by exempting pregnant and nursing women from ḥudud punishments, reflecting considerations of humanity and equity. This research contributes novel insights into the complexities of harmonizing Indonesia’s secular criminal legal framework with its predominant religious values, particularly in addressing consensual non-monogamous sexual conduct such as swinger practices. It highlights the tension between evolving social behaviors and entrenched legal-religious norms, thereby informing ongoing debates on legal pluralism and human rights protections in Indonesian society.
